The Social Psychology Of Inclusion: How Diversity Framing Shapes Outcomes For Racial-Ethnic Minorities, Jamillah Bowman Williams
The Social Psychology Of Inclusion: How Diversity Framing Shapes Outcomes For Racial-Ethnic Minorities, Jamillah Bowman Williams
Georgetown Law Faculty Publications and Other Works
Research on the efficacy of organizational diversity efforts has yielded mixed results. It remains unclear when positive or negative outcomes should be expected, and why. This article fills a gap in the sociological literature by examining critical social psychological mechanisms. In Experiment 1, I found that common diversity messaging led to increased bias towards racial minorities. In Experiment 2, I examined how alternative framing may influence these outcomes. Findings revealed that the common “business case” emphasizing profit and performance gains made decision-makers less likely to select a Black job candidate than emphasizing civil rights law. I then examined social psychological …

Most people are unaware how much public policy is either lacking in any empirical-research support or driven by bad research. Political actors motivated by ideology or donor/constituent demands propose new government practices—in areas ranging from policing to funding of treatments for gender dysphoria in youth to welfare-qualification rules—that will greatly impact people’s lives, and if anyone asks what basis they have for thinking the impact will be good, they can readily find some study to support their case. Especially when powerless populations are put at risk, neither the legislative process nor peer review in the publication process provides a real …

Digital Forensics For Mobility As A Service Platform: Analysis Of Uber Application On Iphone And Cloud, Nina Matulis, Umit Karabiyik
Annual ADFSL Conference on Digital Forensics, Security and Law
Uber is a ride-hailing smartphone application (app) that allows users to order a ride in a highly efficient manner. The Uber app provides Mobility as a Service and allows users to easily order a ride in a private car with just a few clicks. Uber stores large amounts of data on both the mobile device the app is being used on, and in the cloud. Examples of this data include geolocation data, date/time, origin/destination addresses, departure/arrival times, and distance. Uber geolocation data has been previously researched to investigate the privacy of the Uber app; however, there is minimal research relating …
Smart Home Forensics: Identifying Ddos Attack Patterns On Iot Devices, Samuel Ho, Hope Greeson, Umit Karabiyik
Smart Home Forensics: Identifying Ddos Attack Patterns On Iot Devices, Samuel Ho, Hope Greeson, Umit Karabiyik
Annual ADFSL Conference on Digital Forensics, Security and Law
Smart homes are becoming more common as more people integrate IoT devices into their home environment. As such, these devices have access to personal data on their homeowners’ networks. One of the advantages of IoT devices is that they are compact. However, this limits the incorporation of security measures in their hardware. Misconfigured IoT devices are commonly the target of malicious attacks. Additionally, distributed denial-of-service attacks are becoming more common due to applications and software that provides users with easy-to-use user interfaces. Since one vulnerable device is all an attacker needs to launch an attack on a network, in regards …
Perspectives Of Religious Faith Leaders On Hate Crime Policies, Alphonso Manns
Perspectives Of Religious Faith Leaders On Hate Crime Policies, Alphonso Manns
Walden Dissertations and Doctoral Studies
AbstractPrejudice and discrimination stigmatize members of the lesbian gay bisexual transgender and queer (LGBTQ) community as abnormal, which has been attributed to religious opposition and the exercise of ministerial privileges or religious liberty within the law. Religious organizations may indirectly contribute to the public legal rights of members of the LGBTQ community. But little is known about the perspectives of religious faith leaders (RFLs) and how they influence the development and implementation of pro-equality and hate crime policies. The purpose of this study was to explore the experiences of RFLs from one community in a midwestern state. The narrative policy …

Reducing Racial Disparity Of Youths Referred To The Juvenile Center, Kimberly Paige
Walden Dissertations and Doctoral Studies
In 2018, The Juvenile Center in St. Louis, Missouri acknowledged that they needed to decrease the racial disparity in the numbers and percentages of Black youths who were overrepresented compared to White youths at the front-end intake step of the facility. The purpose of this qualitative study was to gain insight as to whether there were alternative actions for police officers after they arrested the youths but before they referred them to the front-end intake step of The Juvenile Center. The main method of collecting data was an ethnographic interview in the form of a questionnaire to gather the community …
Barriers In Quality Healthcare Delivery In The Veterans Healthcare Systems, Kelly A. Walker
Barriers In Quality Healthcare Delivery In The Veterans Healthcare Systems, Kelly A. Walker
Walden Dissertations and Doctoral Studies
The VHA and Department of Veterans Affairs (DVA) have been labeled negligent in providing healthcare for U.S. veterans. Strategies to resolve the problems included legislative changes, watchdog responsibilities, and removal of top officials within the VA. The case studies presented underscore reported problems within Veterans Healthcare Systems. The present research was conducted to determine if the negligence was the result of a toxic work environment and whether the problems continue to affect healthcare delivery to U.S. veterans. Beccaria’s Rational Choice Theory served as the theoretical basis of the research. A mixed method, transformative design was used to conduct the study. …

Decreasing Ambiguity For Public Administrators Implementing The Foreign Sovereign Immunities Act Of 1976, Barbara Ahmed
Walden Dissertations and Doctoral Studies
Abstract The U.S. Congress created and adopted the Foreign Sovereign Immunities Act (FSIA) to address foreign diplomatic immunity matters. The purpose of this generic qualitative study was to analyze the policy implications of implementing FISA by public administrators. Mettler and SoRelle’s policy feedback theory provided the theoretical foundation for this study. The area of interest for this study was the 50 U.S. states with a focus on two metropolitan areas that include a large diplomatic contingent. Data collected were 180 legal cases brought against foreign diplomats from 2016-2021. In addition, legal cases were retrieved from a legal database and analyzed …

Still Awaiting Justice: An Analysis On The Impact Of Anti-Immigrant Sentiment On The Reproductive Autonomy Of Migrant Women, Annays Esperanza Yacaman
Senior Independent Study Theses
My research aims to explain the impact of anti-immigrant sentiment on the reproductive autonomy of migrant women. Legislators typically act as their constituents feel on a certain issue, so I aimed to explore how legislators responded with legislation when their constituents held higher levels of anti-immigrant sentiment, hypothesizing that this would lead to more legislation limiting the reproductive autonomy of migrant women. I explore topics of eugenics and how anti-immigrant sentiment has led to modern day eugenics.
My hypothesis did not manifest itself in the expected way, but the results do provide evidence for a causal link between legislation meant …
Regulating For Energy Justice, Alexandra B. Klass, Gabriel Chan
Regulating For Energy Justice, Alexandra B. Klass, Gabriel Chan
Articles
In this Article, we explore and critique the foundational norms that shape federal and state energy regulation and suggest pathways for reform that can incorporate principles of “energy justice.” These energy justice principles—developed in academic scholarship and social movements—include the equitable distribution of costs and benefits of the energy system, equitable participation and representation in energy decision making, and restorative justice for structurally marginalized groups.
While new legislation, particularly at the state level, is critical to the effort to advance energy justice, our focus here is on regulators’ ability to implement reforms now using their existing authority to advance the …

The authors of Noise: A Flaw in Human Judgment are a trio of intellectual heavy hitters: Nobel Prize-winner Daniel Kahneman, constitutional law scholar Cass Sunstein, and former McKinsey consultant (and current management professor) Olivier Sibony. As prolific as they are prominent, the three of them have collectively produced over fifty books and hundreds of articles, including some of the most cited research in social science. If academic publishing ever becomes an Olympic sport, they’ll be prime medal contenders, particularly if they get to compete as a team or on a relay. Their combined coverage of law, economics, psychology, medicine, education, …

À La Carte Cable: A Regulatory Solution To The Misinformation Subsidy, Christopher R. Terry, Eliezer J. Silberberg, Stephen Schmitz, John Stack, Eve Sando
Catholic University Journal of Law and Technology
Although “fake news” is as old as mass media itself, concerns over disinformation have reached a fever pitch in our current media environment. Online media outlets’ heavy reliance on user-generated content has altered the traditional gatekeeping functions and professional standards associated with traditional news organizations. The idea of objectivity-focused informational content has primarily been substituted for a realist acceptance of the power and popularity of opinion-driven “news.” This shift is starkly visible now: mainstream news media outlets knowingly spread hoaxes, conspiracy theories, and the like.
This current state of affairs is not some freak accident. The Supreme Court’s First Amendment …

Roadmap To Reconciliation: An Institutional And Conceptual Framework For Jewish-Muslim Engagement, J. R. Rothstein, Esq., Shlomo Pill, Ariel J. Liberman, Esq.
Touro Law Review
This paper calls for the establishment of a comprehensive academic and theological center to be created and located at a prestigious secular university in the United States. As the first of its kind in North America, it should be affiliated with both American Muslim and Jewish institutions. Modeled on similar Jewish-Christian centers, its mission will be to foster both a neutral ground for dialogue and the development of a theology of Jewish-Muslim coexistence.

The Implications Of A Militarized Police Force In The United States, Nhat Dang
The Implications Of A Militarized Police Force In The United States, Nhat Dang
Themis: Research Journal of Justice Studies and Forensic Science
The police model in America is slowly changing. From the early days of America, the police were modeled after the London Metropolitan Police. Over time, this has changed from a civilian police model into a more militaristic one. Police militarization in America can be traced to the implementation of the 1033 program, which granted local law enforcement agencies surplus military equipment such as weapons, surveillance gadgets, and armored vehicles. This research paper examines the effects of increasing police militarization on public perception and public trust of police.
Detection Of Overlapping Passive Manipulation Techniques In Image Forensics, Gianna S. Lint, Umit Karabiyik
Detection Of Overlapping Passive Manipulation Techniques In Image Forensics, Gianna S. Lint, Umit Karabiyik
Annual ADFSL Conference on Digital Forensics, Security and Law
With a growing number of images uploaded daily to social media sites, it is essential to understand if an image can be used to trace its origin. Forensic investigations are focusing on analyzing images that are uploaded to social media sites resulting in an emphasis on building and validating tools. There has been a strong focus on understanding active manipulation or tampering techniques and building tools for analysis. However, research on manipulation is often studied in a vacuum, involving only one technique at a time. Additionally, less focus has been placed on passive manipulation, which can occur by simply uploading …

Ashley Ahlbrand's contribution to this volume is "Capturing Impact: Telling the Story of Your Scholarship Beyond the Citation Count."
When we conduct research, what is our end goal? Who is our audience? Since the mid-20th century, with the development, first, of journal citation indexes, then journal impact factors, then journal citation metrics for individuals, academia has seen increased pressure to publish and be cited in journals within one 's discipline. These citation metrics are used to compare schools and to evaluate scholars for promotion and tenure, for grant consideration, and for bestowing other awards and honors. Discipline-specific journal citations tend …
The Civil Right To Belong: A Case Study On Immigrant Integration Of Muslim Students In Educational Institutions, Mamoona H. Siddiqui
The Civil Right To Belong: A Case Study On Immigrant Integration Of Muslim Students In Educational Institutions, Mamoona H. Siddiqui
Theses and Dissertations
Constitutional equal protection values serve as social integration policies for new Americans and generations that follow. They promise equal opportunity, fair treatment, protection from unlawful discrimination, and freedom to preserve cultural identities in their new communities. However, in times of national security crises and political polarization, the disjuncture in the way equal protection doctrines have been historically implemented often reflect deep-rooted inequities that impact underrepresented communities. American Muslims are one such community in which members have experienced anti-Muslim and anti-immigrant sentiment particularly after 9/11 and political polarization on immigration and civil rights policies. The study explores the equal protection doctrine …
Johnson V. M'Intosh: Christianity, Genocide, And The Dispossession Of Indigenous Peoples, Cynthia J. Boshell
Johnson V. M'Intosh: Christianity, Genocide, And The Dispossession Of Indigenous Peoples, Cynthia J. Boshell
Cal Poly Humboldt theses and projects
Using hermeneutical methodology, this paper examines some of the legal fictions that form the foundation of Federal Indian Law. The text of the U.S. Supreme Court’s 1823 Johnson v. M’Intosh opinion is evaluated through the lens of the Convention on the Prevention and Punishment of the Crime of Genocide to determine the extent to which the Supreme Court incorporated genocidal principles into United States common law. The genealogy of M’Intosh is examined to identify influences that are not fully apparent on the face of the case. International jurisprudential interpretations of the legal definition of genocide are summarized and used as …

In the spring of 2009, the United States was mired in the greatest recession it had faced since the Great Depression. In March, the Dow Jones Industrial Average had fallen to 6,594.44, a total decline of 53.4 percent from its peak in the fall of 2007. The official unemployment rate was over 9 percent and still trending upward, eventually exceeding 10 percent. With the support of Congress, the Federal Reserve (the Fed) and other financial regulators had launched an array of initiatives to contain the fallout of what had become a global financial crisis. These interventions, including a massive recapitalization …

It Takes Two: Professional Interconnections And Potential Collaborations Between Small-Town Family Attorneys And Couple/Family Therapists, Wendy Lenk Mcclary
Antioch University Dissertations & Theses
Attorneys who specialize in family practice may experience significant rates of mood disorders and substance reliance. Law schools typically do not provide supportive coursework or mentoring to help students learn to manage their feelings and those of crisis-impacted clients. Lawyers may well consider that understanding emotional needs and providing emotional support does not fall within their codes of practice. Societal stigma may prevent family attorneys and their clients from seeking therapy. Small-town attorneys may be particularly vulnerable to professional stress and safety concerns. The purpose of this study was to explore and understand the lived experiences of family attorneys practicing …

Artificial intelligence (“AI”)-enabled products are expected to drive economic growth. Training data are important for firms developing AI-enabled products; without training data, firms cannot develop or refine their algorithms. This is particularly the case for AI startups developing new algorithms and products. However, there is no consensus in the literature on which aspects of training data are most important. Using unique survey data of AI startups, we find that startups with access to proprietary training data are more likely to acquire venture capital funding.

The First Amendment’s Free Exercise Clause often requires courts to balance competing interests of the highest order. On the one hand, the Constitution recognizes the free exercise of religion as a fundamental right. On the other hand, the government sometimes has compelling reasons for limiting free exercise, especially in situations involving dangers to health and safety. The shutdown and social distancing orders issued during the early phases of the COVID-19 pandemic not only restricted free exercise but also limited what many people consider to be the core of that exercise: religious worship. But the orders did so in order to …
Criminal Justice Expertise, Benjamin Levin
Criminal Justice Expertise, Benjamin Levin
Scholarship@WashULaw
For decades, commentators have adopted a story of mass incarceration’s rise as caused by “punitive populism.” Growing prison populations, expanding criminal codes, and raced and classed disparities in enforcement result from “pathological politics”: voters and politicians act in a vicious feedback loop, driving more criminal law and punishment. The criminal system’s problems are political. But how should society solve these political problems? Scholars often identify two kinds of approaches: (1) the technocratic, which seeks to wrest power from irrational and punitive voters, replacing electoral politics with agencies and commissions; and (2) the democratic, which treats criminal policy as insufficiently responsive …
