Facing State-Created Danger In Facial Recognition Technology, Esha Jain

Washington Law Review

When the police wrongfully arrest someone, that person faces distinct harms. Various scholarship, news articles, and studies document that AI-powered facial recognition technology (FRT) disproportionately misidentifies individuals from marginalized racial groups when used irresponsibly. Many of those sources indicate that police reliance on FRT without adequate vetting results in wrongful arrests. Yet law enforcement continues to misuse FRT.

This Comment contends that the 42 U.S.C. § 1983 state-created danger doctrine offers a potential remedy for plaintiffs harmed by police reliance on FRT. To prevail under this doctrine, plaintiffs must prove affirmative conduct, deliberate indifference, and proximate causation. If successful, these …

This is a joint report by the National Center for the Study of Collective Bargaining in Higher Education and the Professions at Hunter College (National Center) and the Center for the Defense of Academic Freedom (CDAF) at the American Association of University Professors. It presents excerpts from forty-five collective bargaining agreements in higher education to demonstrate the wide range of ways academic freedom is defined in contracts, or not, and how the negotiated definitions incorporate, quote, follow, mirror, or deviate from the principles set forth in the 1940 Statement of Principles on Academic Freedom and Tenure (hereinafter 1940 Statement).

Asexuality is sexual orientation defined by those who experience little to no sexual attraction. Despite asexuality being as common as red headedness or left handedness, it has been severely overlooked in research and conversations. Because many people are not aware of the existence of asexuality, it has not been directly attacked by anti-queer campaigns. Still, there have been some recent shifts in this dynamic as asexuality becomes more visible. I conducted a linear regression on the 2022 Ace Community Survey results. Most studies take a unitary state-centric approach to assessing China’s relationship with international economic law. In contrast, we provide a more nuanced approach that assesses variation in China’s engagement. We examine the role of different Chinese state and non-state actors, considering their interests, ideological frames, institutional contexts, and relation to state power. We illustrate our analytic framework by examining China’s response to and engagement with international dispute settlement systems in three areas: international commercial arbitration, international trade dispute settlement, and investor–state arbitration. According to virtue jurisprudence, good laws can be conducive to virtuous living; poor laws can contribute to character vices and entrench prejudices. This article focuses on what lies beyond the strict categorization of virtue and vice simpliciter—the ethos and mindset of a people. Using a case study of Singapore, this article examines how law, conceived of in the broadest sense as including policies chosen in a legal regime that leaves the concretization of policies to government bodies, can diminish the capacity and desire of individuals to live examined lives in pursuit of eudaimonia or flourishing. This phenomenological qualitative study explores the lived experiences of Kentucky parents seeking Competitive Integrated Employment (CIE) for their children with intellectual and developmental disabilities (I/DD). Guided by the research questions—How do parents experience this process, and what barriers or supports do they encounter?—the study highlights systemic challenges despite legislative efforts such as the Americans with Disabilities Act and the Workforce Innovation and Opportunity Act. In-depth interviews with five parents revealed three themes: (a) parental transformation and the pursuit of meaningful work, (b) systemic challenges in accessing CIE, and (c) overcoming protective instincts: navigating fear, independence, and self-advocacy. This fact sheet presents 2024-2025 violent and property crime data for the Mountain West states of Arizona, Colorado, Nevada, New Mexico, and Utah. Crime data are sourced from the Real-Time Crime Index (RTCI) created by AH Datalytics. The RTCI table, “Reported UCR Part One Crimes Year to Date” compares violent and property crime rates during the time frames of January-October 2024 and January-October 2025 for states across the U.S. This fact sheet highlights the violent and property crime rates in each Mountain West state and considers how these data have changed between January-October 2024 and January-October 2025.

Food insecurity is a devastating force in the United States, as shown by its destructive impact on vulnerable groups like children, racial minorities, and those in poverty. Non-white urban communities of color especially have significantly higher rates of household food insecurity due to systemic racism in American food systems. This thesis investigates what factors affect the financial sustainability of social enterprises (SEs) in Egypt, situating them within a constrained MSME, legal and sectoral context marked by informality, weak innovation and recurrent shocks. This research examines Egyptian feminist critiques of neoliberal economic policies through a Third World feminist and feminist political economy framework. It argues that neoliberalism in Egypt has produced controlling power dynamics through restructuring labor markets, social reproduction, and legal systems in ways that disproportionately impoverish women, particularly working-class women. The research maps diverse feminist engagements with neoliberal reforms, including structural adjustment programs, privatization, labor reduction, and legal liberalization. Federalism involves political struggles around the territorial division of powers. Typically, these struggles tend to occur when the federal government seeks to act in areas of constituent unit jurisdiction. Yet, recent political developments in Texas (Operation Lone Star) and Alberta (Alberta Sovereignty in a United Canada Act) have showcased state/provincial governments seeking to reject federal legislation within seemingly federal jurisdictions. This study constructs an index reflecting Central Bank Digital Currency (CBDC) news coverage and evaluates its impact on bank stability. The CBDC Attention Index (CBDCAI) is formulated based on more than 533 Reuters Digital News Report articles from 2019 to 2023. Employing the System Generalized Method of Moments (GMM) approach with data from 92 banks across ASEAN-5 nations, and implementing quantile regression for robustness checks, the findings demonstrate a significant relationship between the CBDCAI and bank stability, alongside variables such as bank size and capitalization. The increasing emphasis on sustainability has intensified tensions with competition law, particularly when cooperative initiatives create risks for market competition or consumer welfare. The main challenge is to identify regulatory strategies that balance sustainability objectives with competitive market principles. This requires a systematic assessment of both sustainability benefits and competition related risks. Existing studies largely rely on legal discussions or case-based evaluations and provide limited quantitative guidance for prioritizing regulatory approaches. A legislative text published for the benefit of its 56 member countries, the Commonwealth of Nations officially adopted the Model Law on Digital Trade (MLDT) in September 2025. The Commonwealth MLDT addresses a persistent barrier to digital trade (i.e., all trade that is digitally ordered and/or digitally delivered): the laws of many jurisdictions do not sufficiently recognise the legal requirements of electronic commerce (e-commerce) and continue to emphasise paper-bases for commercial communications and transactions in domestic and cross-border contexts.
