"Public Policy" In The Conflict Of Laws, Monrad G. Paulsen, Michael I. Sovern

In deciding a conflict of laws question, a judge will sometimes say, "The foreign law ordinarily applicable will not be applied in this case because to do so would violate our public policy." The textwriters, language in the cases, and the Restatement agree: the "normal" operation of choice of law rules is subject to a "public policy" limitation. This paper is an attempt to explore the meanings and significance of "public policy," used in this general way, in the conflict of laws.

This report from the House Committee on Interior and Insular Affairs, dated July 27 1955, was written to accompany United States (US) House Resolution 5566 which proposed to terminate the Indian Claims Commission by April 10, 1962. This report recommends the bill to pass with some amendments. The report first recommends a statutory citation be replaced with a more detailed citation. The second recommendation of the report is to add a new section related to appointed attorneys and the Administrative Procedure Act. Attempts to clarify the problem of law among non-literate peoples has been largely one of isolating with accuracy its distinguishing characteristics. Non-literate law is not written down or codified. Often, it is not sustained by any formal police force, and courts are lacking. Legislation, in the proper sense of the term, may be an attribute of developed legal systems only. A further difficulty is fostered by the fact that in any examination of law among peoples of other cultures, the investigator is hampered by concepts of legality derived from too close acquaintance with his own legal system. Municipal Corporations - Validity Of Covenant To Maintain Parking Meters In Bond Issue To Finance Off-Street Parking Facilities, William G. Cloon, Jr. S.Ed.

Michigan Law Review

An act of the state legislature authorized the issuance of municipal bonds to finance off-street parking facilities. The city was authorized to pledge revenue from existing on-street parking facilities to service the bonds but was to retain the right to change the location of the parking meters and other on-street facilities for enumerated reasons so long as the change did not materially lessen the revenue to be derived from those facilities. Acting in pursuance of authority granted by the enabling act, the city covenanted to maintain its parking meters subject to the reservations required by the act. In an action …

This report, dated March 14, 1955, from the United States (US) Senate Committee on the Judiciary is a study of juvenile delinquency in the US. The study aimed to define and characterize juvenile delinquency, to determine its cause and contributing factors, to study sentencing and corrective measures in use, and to determine if juveniles are breaking Federal narcotics laws. The study took place over a 17 month period. Under the subheading "Special problems" is a section on "Juvenile delinquency among Indian children." In 1956, the committee released a report focused exclusively on "Juvenile Delinquency Among the Indians."
