This Article reviews and analyses scholarship at the intersection of anthropology and law. The first half of the Article provides context for understanding the boundaries, animating concerns, and tensions that have characterised the anthropology of law as an area of interdisciplinary inquiry. We focus especially on the subdiscipline’s Anglo-American history and show how a promising early period of engagement dissipated as both anthropologists and legal scholars lost enthusiasm for each others’ insights and methods. Then, we expand our analysis outward. Because legal anthropology belongs within, and is increasingly attentive to, the broader field of law and society scholarship, we explore …

The legal treatise remains a pillar of the American legal system and the rule of law, despite claims it might be dying and variations in quantitative citations to treatises over time. Indeed, several treatises evidence increased citation in U.S. Supreme Court opinions during the last several decades. Surprisingly, the U.S. Supreme Court, including the Robert’s Court in Dobbs v. Jackson Women’s Health Organization, increasingly sees fit to rely on proto-treatises, such as Bracton, Coke, and Blackstone. Prior to the 2022 Dobbs decision, Black women already experienced negative maternal health outcomes at an alarmingly disparate rate in comparison to White women. Given that the Dobbs decision emboldens state power to enforce abortion restrictions or protections, there has been significant strides made in both directions. Nonetheless, within states where reproductive rights have been significantly eroded, the heightened abortion restrictions may compound the limited access that Black women previously had before Dobbs. The South China Sea is home to natural resources and reefs that benefit its surrounding states. International law divides these waters to grant certain rights to each coastal state so as to ensure fair distribution of the waters. As of late, China’s actions in the South China Sea frequently violate the distribution of waters under international law. They have infringed upon the Philippine’s waters and attempted to establish authority over most of the South China Sea, rather than remaining within their own waters. This thesis examines themes of American national identity perpetuated in Pennsylvania surrounding private property through historical, literary and legal analysis. Ideals of private property and land ownership are broken into three transitions throughout Pennsylvania history: the American frontier and initial land claiming by settlers, mass-deforestation and the introduction of widespread agriculture, and finally industrialization and the introduction of mining and fracking. Each of these transitions highlights the physical changes to the region and how they were influenced by American ideals of private property, productivity, and profitability.

This study examines the relationship between jurisdictional definitions of rape and rape offense rates across various states in the U.S., with the goal of proposing a standardized federal definition to enhance consistency in data collection and improve the efficacy of legal responses. Despite extensive research on rape, no prior studies have explored the impact of jurisdictional definition variances on state rape offense rates. This seminal study aimed to fill this gap by analyzing the correlation between state-specific rape definitions and reported rape offenses, utilizing a theoretical breakdown of definitions into eight components and a rubric for evaluation.

Teachers of students with visual impairments (TSVIs) have long expressed frustrations about the difficulty of getting a dyslexia diagnosis for students with visual impairments, but there is limited data to validate their concerns. Moreover, although most U.S. states have passed dyslexia laws that require universal screening and/or intervention for students with dyslexia, the laws may not be applied equally across all populations of students. A mixed-methods approach can validate TSVIs’ perspectives by revealing whether dyslexia legislation is associated with TSVIs’ perceptions of how their students’ needs are being met. [There is a war being waged against African Americans, and their ability to speak out against racial injustice, which is more intense than any past attempt at suppression, since post-reconstruction in America. An analysis of opinion poll data on housing issues. The article finds that Americans generally believe that their community needs more housing of all types, but are more closely divided about whether such housing should be in their own neighborhoods. The article further finds that members of minority groups, lower-income Americans, and younger Americans are more pro-housing than older, affluent whites.

Over 1700 complete streets policies have been adopted by state and local government; these policies typically provide that streets shall be designed to benefit all users, not just motorists. This article analyzes some complete streets policies, and concludes that even above-average policies are often too vague and underfunded to significantly change the status quo. The article suggests a variety of reforms that might make complete streets policies more effective.

The article discusses the lack of legal documentation faced by Ukraine in defending its borders and national interests, taking into account its historical experience. Attention is drawn to the issues encountered by Protestant churches, especially, but not exclusively, the Seventh-day Adventist Church. A proposal has been made to utilize the volunteer non-combatant potential of churches, regulating it legislatively without involving the Ukrainian court system. The question of alternative (non-combatant) service during mobilization and in times of war in Ukraine is analyzed. With ever-increasing gridlock and polarization at the national level, many new policy changes in the U.S. have come at the state level, including legislation that takes the form of democratic backsliding by restricting the right to vote, limiting free speech and expression, and gerrymandering state and federal legislative districts. The recent wave of anti-LGBTQ+ politics and policies in Florida pose potential risks to the mental health and well-being of Florida’s LGBTQ+ students. The present study surveyed LGBTQ+ students attending private colleges in Florida to measure their self-reported stress levels in comparison to non-LGBTQ+ students, the level at which they believed specific sources of stress contributed to their stress levels, their level of distress upon experiencing discrimination, their sense of sexual identity distress, and their awareness of and involvement in advocacy against Florida’s anti-LGBTQ+ bills. This Article identifies transactional innovation in public offering markets as a case study of how going-public transactions would work if issuers could choose to relax some of the investor protections provided under the securities laws. In recent years, private companies that wanted to go public had a meaningful choice between a traditional initial public offering and a merger with a special purpose acquisition corporation (SPAC). Most of the direct and indirect investor protections that ordinarily apply in the initial public offering context are relaxed in the SPAC context.

The group we know today as the “Religious Right” (“R.R.”) has been in contention with the LGBTQ+ movement since the early 1970s. Using a single case study method, I analyze how, if at all, Religious Right framing and LGBTQ+ counter-framing evolved at a point in time where the R.R. recognized it was losing its fight against same-sex marriage. Using Arizona’s 2013 Senate Bill 1045 (one of the nation’s first bathroom bills) as a case study, I find that the Religious Right translates protectionist framing from its anti-gay marriage crusade into its anti-trans rights offensive, and the LGBTQ+ movement also responds …

This conceptual overview offers a comprehensive overview of systemic pathways that negatively impact the mental health of Black Men throughout their lives. Our argument highlights the importance for counselors and mental health professionals to utilize a thorough social risk assessment that considers these pathways in order to effectively address the mental health needs of Black Men while fostering positive working relationships. This overview strongly advocates for the use of context and structural determinants when evaluating mental health symptoms. Without an appropriate understanding of social risk and determinants, counselors may inadvertently perpetuate disparities by decontextualizing symptomology, and reproducing racist discourse.

In this paper, we discuss the challenges and rewards of carrying out qualitative research on the police in the African American1 community. Using data drawn from interviews with seventy-seven African American adults in Durham, NC, we found that community member hostility toward research(ers) and fear of both neighbors and the police lowered African Americans’ willingness to be interviewed about their perceptions of and experiences with U.S. police. These findings were observed primarily in public housing and middle-income communities. On a positive note, we found that greater awareness of policing issues increased African Americans’ willingness to participate in research about the …

In the current paper, we examine departmental and court decision-making in criminal cases against police officers. The study has two objectives: 1) to examine variables that impact departmental decisions in criminal cases against police officers, and 2) to examine factors that affect case disposition/conviction decisions by the courts. To achieve these objectives, we analyzed nationally representative arrest data using multiple statistical approaches. The results obtained revealed important patterns that are critical to our understanding of how the courts and police departments decide matters relating to police criminality. I delve deep into the extensive and intricate history surrounding judicial independence as an institutional concept, which has caused signs of concern for many legal and institutional scholars. If any group is to endure over time, individual frustrations, while inevitable, must be usually experienced as acceptable, or at least tolerable. Failing that, little would prevent the losers in these conflicts from leaving or revolting, which would be cumulatively debilitating to the group. I argue that two key factors have driven more Filipinos to pursue unauthorized entry into the US since the 1980s despite heightened risks. First, US immigration policy changes enacted in the 1980s and 1990s implemented stricter numerical caps that severely limited available visas for Filipino immigrants to use legal immigration pathways into the United States.
