[Purpose/significance]To explore the direction for provincial governments to further plan data policies, with the aim of providing support for the establishment and improvement of data infrastructure systems in various regions. [Method/process] This article adopts the method of text similarity calculation to compare the policy texts of 22 provinces' data policies released before 2023 with the "Twenty Data Articles", and selects the "Twenty Provincial Version Data Articles" of 8 provinces for policy evaluation research. [Result/conclusion]The data shows that in terms of comparing data infrastructure systems, the data policies introduced by 22 provincial governments before 2023 show a relatively high overall similarity …

This dissertation addresses a key puzzle: Why do states sometimes adopt nationally polarized policies, such as climate change legislation, even when doing so does not align with strict partisan interests? The analysis focuses on “landslide states,” where a single party overwhelmingly dominates, and the minority party cannot realistically expect to gain a majority. In these environments, reduced partisan conflict allows minority party legislators to break from traditional partisan paths. As a result, I argue that electoral motivations drive them to signal moderation by advancing liberal policy agendas or incorporating provisions that minimize backlash from their core constituents in landslide states. …

How do school-level dynamics impact the everyday experiences of students with disabilities, compared to their abled peers? Extant research has mostly focused on the experiences of individual students with disabilities, and their teachers. We know far less about how school-level dynamics shape students’ experiences. Historically, American schools formally separated students with and without disabilities, though the specific mode varied over time -- ranging from explicit institutionalization to segregation in special education programs. At least since the passage of the Americans with Disabilities Act in 1990, efforts to educate students with disabilities alongside their abled peers in mainstreamed settings have increased …

This study examined the role of affordable housing in promoting economic stability among low- and moderate-income households in Connecticut. Focusing on income security, employment opportunities, and housing retention, this research highlighted the significance of affordable housing as a means to alleviate financial strain, support job retention, and foster community resilience. Utilizing a phenomenological approach, the study gathered insights from tenants, policymakers, and developers through conducting interviews and a focus group. Refugees are regarded as one of the most pressing humanitarian issues worldwide due to intricate social, economic, and demographic factors. Changes in U.S. immigration policy across successive administrations, particularly regarding the refugee ban and the duration of the resettlement process, have significantly impacted admission procedures. Consequently, family separations occur during the resettlement process, compelling families to navigate immigration policies while managing the challenges of being apart. This separation from their children greatly affects refugees’ ability to integrate into American society.

From Flames To Change: An Exploration Of Housing, Fire, And Inequity, Helen Underhill, Charles R. Jennings, Brian Meacham, Danielle Antonellis

Housing and fire safety are deeply connected: inadequate and poorly maintained housing poses heightened fire risk for occupants. An individual or household’s housing situation (including limited or constrained choice) interacts with issues such as affordability, access, location, quality, safety, occupancy levels, tenure type, and resident or immigration status. These dynamics shape vulnerability, and inequity becomes most visible in the event of a fire. The extreme end of this spectrum includes the unhoused, who occupy structures entirely outside of regulatory systems with little or no fire protection.

Conventional narratives tend to represent the post-World War II international criminal proceedings as a men’s project, thus obscuring the many women who participated, as lawyers, journalists, analysts, interpreters, witnesses, and defendants. Indeed, two women stood trial before Nuremberg Military Tribunals. This article examines the case of the only woman found not-guilty: Inge Viermetz, who had been an administrator at Lebensborn, the Nazi SS adoption and placement agency. The article outlines the prosecution’s child-taking case against Viermetz, as well as her successful gendered self-portrayal as a conventionally feminine caregiver. This paper explores the sexual development of children, the sexual education they receive, as well as the history of sex laws in the United States, to determine whether the laws regarding education and age of consent adequately protect children. A qualitative survey is also conducted with undergraduate students at the University of South Carolina to determine what topics were discussed in their sexual education curriculum, as well as their sexual behaviors as a minor. After the 2018 Farm Bill passed, loopholes were quickly found that led to the popularization of delta-8 THC, a derivative of delta-9 THC, more commonly known as marijuana. Use of this substance became particularly high in states that criminalized marijuana, such as South Carolina. This scoping review aimed to assess South Carolina’s current delta-8 policies in the context of health-related impacts among college-aged students. This Essay draws upon two decades of the author’s research on rural United States communities to explicate ways in which the regulatory state has intervened in rural areas and economies, often with the claim of protecting land, natural resources, and/or wildlife. The outcomes are frequently disastrous for the human populations of those communities and generally are not planned for or mitigated by policy. This Essay, written for a symposium that honors and amplifies Ann Eisenberg’s 2024 book, Reviving Rural America: Toward Policies for Resilience, contemplates benefits that could flow from taking seriously Eisenberg’s conceptualization of rural America as a commons. In particular, I argue that the mutual respect and collaboration necessary for a successful commons could help heal the rural-urban rift, which has widened dramatically in the last few decades. Recent studies suggest that rural residents have what scholars call a rural consciousnesses, which means that living in a rural place is a key aspect of their identity. One feature of this identity …

In recent times, Malaysian courts have resorted to a ritual incantation of unconscionability and the notion of a remedial constructive trust to justify a declaration of a constructive trust. This methodology is unhelpful for approaching constructive trusts and has led the law to develop in an unprincipled and unpredictable fashion. Our central thesis is that the key Malaysian decisions could have been decided on the basis of pre-existing legal principles upon which English and Commonwealth courts have declared a constructive trust. Since the financial crisis of 2008, left-leaning legal thought has experienced a renaissance within the American academy. From law and political economy to critical race theory to feminist legal studies to Marxist legal theory, new perspectives have flourished, and marginalized traditions have been revived and revised. These new perspectives and revisionist projects all share an intellectual debt to the critical legal studies (“CLS”) movement of the late 1970s and 1980s. That movement’s critique was focused on functional accounts of law: accounts that understood legal change as primarily responsive to the demands of extralegal social and economic forces. A robust and extensive body of empirical research, and a rich historical record, documents a recurring and pervasive influence of race in the application of California’s death penalty. This article reviews the legal and social science research to document multiple paths through which institutions and processes produce these racial disparities over many decisions in many cases across four decades. The article reviews relevant literature by decision, institution, or actor and presents key findings. Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc. is one of the most cited Supreme Court cases in history, with over 18,000 citations in federal courts alone (Merrill, 2012). It has reached doctrinal status and was widely considered a vital precedent, one that guided the fields of environmental and administrative law. However, in June of 2024, the Supreme Court released their opinion in Loper Bright Enterprises v. Raimondo, which overturned Chevron. Background: Florfenicol, an antibiotic permitted in veterinary medicine, currently lacks an established maximum residue limit (MRL) in meat products in Thailand, effectively mandating undetectable residue levels. In May 2024, Thailand Pesticide Alert Network reported florfenicol residues in swine, raising concerns about consumer safety, rational veterinary drug use, and the potential for antimicrobial resistance (AMR). While jury duty is legally mandated, voting remains optional, despite both civic responsibilities being foundational to democratic participation. คณะกรรมการกำกับกิจการพลังงาน (กกพ.) มีข้อจำกัดในการกำกับดูแลการประกอบกิจการไฟฟ้าเพื่อรองรับและส่งเสริมการเปลี่ยนผ่านด้านพลังงานสู่สังคมคาร์บอนต่ำตามพระราชบัญญัติการประกอบกิจการพลังงาน พ.ศ. 2550 (“พ.ร.บ. การประกอบกิจการพลังงานฯ”) ฉบับปัจจุบัน เนื่องจากยังไม่อาจออกใบอนุญาตประกอบกิจการไฟฟ้าสำหรับกิจการที่เกิดขึ้นใหม่ เช่น การประกอบกิจการนำเข้าและการส่งออกไฟฟ้า การรวบรวมโหลดไฟฟ้า การจัดการระบบจัดเก็บไฟฟ้า การประกอบกิจการโรงไฟฟ้าเสมือน และการประกอบกิจการไฟฟ้าและการให้บริการไฟฟ้าโดยผ่านระบบเทคโนโลยีสารสนเทศ ดังนั้น จึงควรมีการแก้ไขนิยามของกิจการไฟฟ้าตามกฎหมายให้ครอบคลุมการประกอบกิจการเหล่านี้ พ.ร.บ. การประกอบกิจการพลังงานฯ ควรถูกแก้ไขเพื่อรองรับสถานะของผู้ใช้ไฟฟ้าที่ผลิตไฟฟ้าได้เองให้ชัดเจน และมีบทบัญญัติที่รองรับสิทธิของบุคคลเหล่านี้ในการผลิต ใช้ และขายไฟฟ้าส่วนให้ผู้ใช้ไฟฟ้ารายอื่นได้ นอกจากนี้ เพื่อให้กฎหมายมีศักยภาพในการรับรองและคุ้มครองสิทธิในการเชื่อมต่อและใช้ระบบโครงข่ายไฟฟ้าเพื่อการส่งผ่านไฟฟ้าที่ผลิตจากพลังงานหมุนเวียนเพื่อรองรับการซื้อขายไฟฟ้าระหว่างเอกชนซึ่งมิได้เป็นเจ้าของโครงข่ายไฟฟ้าเอง กฎหมายจึงควรเพิ่มบทบัญญัติกำหนดหน้าที่ของผู้ประกอบกิจการไฟฟ้าที่มีระบบโครงข่ายให้คำนึงถึงการใช้ระบบโครงข่ายของผู้ผลิตไฟฟ้าจากทรัพยากรพลังงานหมุนเวียนอีกด้วย โดยยังคงรักษาความเชื่อถือได้ของระบบโครงข่ายไฟฟ้าเอาไว้ เมื่อการเปลี่ยนผ่านด้านพลังงานอาศัยการมีปฏิสัมพันธ์และการทำธุรกรรมแบบกระจายศูนย์ซึ่งผู้ผลิตและผู้ใช้ไฟฟ้าซื้อขายและส่งมอบไฟฟ้ากันโดยแบบที่มีการแข่งขันกัน กกพ. จึงควรมีอำนาจเพิ่มเติมในการเสนอให้คณะกรรมการนโยบายพลังงานแห่งชาติให้ความเห็นชอบการตั้งตลาดพลังงาน และเพื่อส่งเสริมตลาดไฟฟ้าในประเทศไทย พ.ร.บ. การประกอบกิจการพลังงานฯ และควรเพิ่มบัญญัติซึ่งกำหนดห้ามมิให้ผู้รับใบอนุญาตประกอบกิจการระบบโครงข่ายไฟฟ้ามีพฤติกรรมหรือการประกอบการอันมีลักษณะเป็นอุปสรรคต่อการจัดตั้งและพัฒนาของตลาดไฟฟ้า เพื่อให้การกำกับดูแลการประกอบกิจการไฟฟ้าสามารถก้าวตามพลวัตการเปลี่ยนผ่านด้านพลังงานในระดับสากล กกพ. จึงควรมีอำนาจกำกับกิจการพลังงานให้เป็นไปตามมาตรฐานตามกรอบความร่วมมือระหว่างประเทศด้านพลังงานและสิ่งแวดล้อมที่มีผลผูกพันประเทศไทย ในมิติของอัตราค่าบริการ พ.ร.บ. การประกอบกิจการพลังงานฯ ควรถูกแก้ไขให้เป็นฐานทางกฎหมายให้ กกพ. สามารถกำกับดูแลอัตราค่าบริการให้เหมาะสมกับกิจการไฟฟ้าแต่ละประเภท นอกจากนี้ กฎหมายควรกำหนดให้สัญญาเพื่อจัดหาไฟฟ้าโดยเฉพาะอย่างยิ่งที่รัฐรับซื้อไฟฟ้าจากเอกชนข้อสัญญาที่ทำให้เกิดความยืดหยุ่นในการคิดอัตราค่าไฟฟ้าซึ่งอาจลดต่ำลงจากการเปลี่ยนแปลงสภาพเศรษฐกิจ สังคม การลงทุน หรือเทคโนโลยีในมาตรฐานของสัญญาเกี่ยวกับการให้บริการพลังงาน

การท่องเที่ยวแห่งประเทศไทย (ททท.) เป็นหน่วยงานรัฐวิสาหกิจซึ่งมีหน้าที่ในการประชาสัมพันธ์และส่งเสริมการท่องเที่ยวไทย ททท. มีสำนักงานสาขาที่ตั้งอยู่ในเขตสหภาพยุโรป รวมทั้งมีสำนักงานใหญ่และสำนักงานภูมิภาคหลายสำนักงานที่ตั้งอยู่ในประเทศไทยและมีการเก็บรวบรวมข้อมูลส่วนบุคคลในเขตของสหภาพยุโรปและในประเทศไทย ดังนั้น ททท. จึงอยู่ภายใต้บังคับที่จะต้องปฏิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลของสหภาพยุโรปและของไทย แต่อย่างไรก็ตาม ททท. มีการดำเนินกิจกรรมที่มีความหลากหลายที่เกี่ยวข้องกับการประมวลผลข้อมูลส่วนบุคคล จึงก่อให้เกิดปัญหาในการปฏิบัติตามภาระหน้าที่ตามกฎหมาย ยกตัวอย่างเช่น การบ่งชี้ว่า ททท. มีสถานะเป็นผู้ควบคุมข้อมูลหรือผู้ประมวลผลข้อมูล การบ่งชี้ฐานทางกฎหมายสำหรับการประมวลผลข้อมูลในแต่ละกิจกรรม งานวิจัยนี้จึงมุ่งศึกษาประเด็นปัญหาและอุปสรรคของ ททท. ในการปฏิบัติตามข้อบังคับทั่วไปเกี่ยวกับการคุ้มครองข้อมูล หรือที่เรียกกันว่า General Data Protection Regulation (GDPR) และพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 รวมทั้งมุ่งเสนอแนะวิธีการที่เหมาะสมในการบริหารจัดการปัญหาและอุปสรรคดังกล่าว เช่น การจัดทำคู่มือกำหนดแนวปฏิบัติขององค์กรในการปฏิบัติตามกฎหมาย ทั้งนี้ เพื่อเป็นการลดความเสี่ยงที่ ททท. จะมีความรับผิดที่เกิดขึ้นจากการไม่ปฏิบัติตามกฎหมาย อันจะส่งผลเสียต่อชื่อเสียงของ ททท. และประเทศไทยต่อไป

ประเทศไทยมิได้มีกฎหมายภายในประเทศที่รับรองคุ้มครองสิทธิในการแสวงหาที่ลี้ภัยจากการประหัตประหาร (Right to Seek Asylum from Persecution) ของผู้พลัดถิ่น (Forcibly Displaced Persons) ซึ่งรวมถึงผู้ลี้ภัย (Refugees) เป็นการเฉพาะ ทั้งนี้ เมื่อเดือนกันยายน พ.ศ. 2566 สำนักงานตรวจคนเข้าเมืองได้เริ่มคัดกรอง “ผู้ได้รับการคุ้มครอง” ตามระเบียบสำนักนายกรัฐมนตรีว่าด้วยการคัดกรองคนต่างด้าวที่เข้ามาในราชอาณาจักรและไม่สามารถเดินทางกลับประเทศอันเป็นภูมิลำเนาได้ พ.ศ. 2562 หรือที่รู้จักกันในนาม National Screening Mechanism (NSM) โดยคนต่างด้าวที่ผ่านการคัดกรองจะได้รับการคุ้มครองจากการถูกบังคับส่งกลับไปยังประเทศต้นทางที่อาจมีภยันตราย (Protection Against Refoulement) แม้ประเทศไทยจะมิได้เป็นภาคีต่ออนุสัญญาว่าด้วยสถานภาพผู้ลี้ภัย ค.ศ. 1951 และพิธีสารที่เกี่ยวข้องก็ตาม แต่กระบวนการคัดกรอง NSM ปรากฏลักษณะสำคัญที่คล้ายคลึงกับกระบวนการพิจารณาสถานภาพผู้ลี้ภัย (Refugee Status Determination: RSD) ซึ่งสำนักงานข้าหลวงใหญ่ผู้ลี้ภัยแห่งสหประชาชาติ (UNHCR) ได้ดำเนินการในประเทศไทยมาหลายทศวรรษ อย่างไรก็ดี เมื่อกระบวนการคัดกรอง NSM ถูกดำเนินงานโดยหน่วยงานภาครัฐ อีกทั้งเป็นกระบวนการภายใต้กฎหมายว่าด้วยคนเข้าเมืองซึ่งยึดโยงกับความมั่นคงของชาติและผลประโยชน์ทางการเมืองในระดับภูมิภาค จึงอาจมีข้อพิจารณาอื่นนอกเหนือไปจากความเสี่ยงต่อการประหัตประหาร แตกต่างไปจากบริบทความคุ้มครองระหว่างประเทศ อันเป็นเจตนารมณ์ของกระบวนการคัดกรองผู้ลี้ภัยโดยทั่วไป ดังนั้น จึงเกิดข้อถกเถียงว่ากระบวนการคัดกรอง NSM อาจมิใช่กระบวนการพิจารณาสถานภาพผู้ลี้ภัยในระดับชาติตามความคาดหวังของประชาคมโลก แต่เป็นเพียงข้อโต้แย้งภายใต้กระบวนการตรวจคนเข้าเมืองที่ยังคงปรากฏข้อจำกัดแก่การเข้าถึงสิทธิขั้นพื้นฐาน และอาจยังมิใช่วิธีการแก้ไขปัญหาผู้ลี้ภัยอย่างยั่งยืน

แม้สิทธิชุมชนจะเป็นสิทธิระดับรัฐธรรมนูญมากว่าสองทศวรรษก็ตาม แต่การขาดความชัดเจนในรายละเอียดของสิทธิ นับเป็นอุปสรรคสำคัญต่อการที่ศาลปกครองจะวินิจฉัยรับรองสิทธิชุมชนให้เกิดผลในทางปฏิบัติ จากปัญหาดังกล่าวจึงเป็นที่มาของงานวิจัยฉบับนี้ที่มุ่งศึกษาแนวคิดและทฤษฎีเกี่ยวกับสิทธิชุมชน และคำวินิจฉัยคดีปกครองเกี่ยวกับสิทธิชุมชนของต่างประเทศ เพื่อนำมากำหนดเป็นแนวทางทางกฎหมายในการวินิจฉัยคดีพิพาทเกี่ยวกับสิทธิชุมชนในศาลปกครองของไทย ผลการศึกษาพบว่า “สิทธิชุมชน” เป็น “สิทธิเชิงกลุ่ม” ซึ่งมีพัฒนาการมาจากกฎหมายสิทธิมนุษยชนและกฎหมายสิ่งแวดล้อมระหว่างประเทศ โดย “ชุมชน” สามารถใช้สิทธิทางศาลได้โดยการมอบหมายให้ปัจเจกบุคล และ/หรือ นิติบุคคล ที่เป็นตัวแทนหรือผู้แทนของชุมชนนำคดีไปฟ้องต่อศาลในนามของชุมชน และในกรณีที่ศาลปกครองพิจารณาแล้วเห็นว่า ผู้ฟ้องคดีเป็นผู้ทรงสิทธิชุมชนตามรัฐธรรมนูญและมีสิทธิในการเข้าถึงและใช้ประโยชน์จากทรัพยากรธรรมชาติและสิ่งแวดล้อม เช่น มีสิทธิในการดำรงวิถีชีวิตในพื้นที่ป่า เป็นต้น แม้ว่าจะมีข้อจำกัดที่ทำให้ศาลไม่สามารถออกคำบังคับให้ผู้ฟ้องคดีเข้าไปดำรงวิถีชีวิตอยู่ในพื้นที่ป่าได้ก็ตาม หากแต่ผู้ฟ้องคดีฟ้องขอค่าสินไหมทดแทนจากการที่ต้องสูญเสียสิทธิในการกำหนดเจตจำนงของตนเอง และ/หรือ สิทธิในการเข้าถึงและใช้ประโยชน์จากทรัพยากรธรรมชาติและสิ่งแวดล้อมมาด้วย ศาลปกครองย่อมสามารถกำหนดให้ฝ่ายปกครองชดใช้ค่าสินไหมทดแทนให้แก่ผู้ฟ้องคดีจากการที่ต้องสูญเสียสิทธิดังกล่าวในการดำรงวิถีชีวิตตามจารีตประเพณี ตามบรรทัดฐานคำวินิจฉัยของศาลต่างประเทศได้
