Signal And Substance: Why Methodological Sophistication Fails To Guarantee Inference, Aamir Rashid, Rizwana Rasheed

Despite increasing analytical sophistication, empirical research in organization studies continues to suffer from fragile inference, uneven theoretical accumulation, and contested credibility. This paper seeks to explain why these problems persist by shifting attention from authors’ methodological choices to the evaluative dynamics of peer review. Adopting a conceptual and theory-analytic approach, the paper theorizes peer review as an inferential gatekeeping system. Drawing on research design, theory evaluation, and philosophy-of-science literatures, this study develops an analytical framework to examine how evaluative routines shape what constitutes empirical rigor during the review process. Billions of dollars are sitting in Donor Advised Funds, delaying support for charitable organizations seemingly at odds with the intent of U.S. charitable tax policy. With no requirement for annual distribution nor timelines for disbursement, Donor Advised Funds allow individual and institutional donors to postpone directing funds to charitable organizations - despite already claiming tax benefits. As a result, some DAFs distribute less than 5% of assets annually, while many of the institutions managing the DAFs continue collecting fees.

Two complementary policy interventions are recommended: (1) the issuance of a federal regulation requiring annual minimum distributions from all DAFs, and …

This paper argues that modern warfare operates through an ethical infrastructure that enables, rather than restrains, the use of violence. Contrary to the common assumption that moral frameworks such as Just War Theory function as safeguards against harm, the historical record shows that ethical language, humanitarian rhetoric, and democratic narratives serve as mechanisms to legitimize intervention, manufacture consent, and naturalize civilian suffering. Mexico's 2024 judicial reform, which made it the first country to elect all judges by popular vote, has generated widespread criticism for allegedly threatening judicial independence and democratic governance. This Article challenges the prevailing narrative by arguing that many of these concerns overstate the reform's practical effect. Through a comparative analysis of Mexico's new constitutional framework and judicial electoral systems in the United States, the Article demonstrates that the reform incorporates structural safeguards—including balanced nomination powers, nonpartisan elections, restrictions on campaign financing, and continued judicial training—that set it apart from comparable American models. This article investigates the capabilities of two AI shopping agents — Alexa for Shopping and Sparky, operated by Amazon and Walmart respectively — to identify country of origin for products on their respective platforms and flag potential “Made in USA” misrepresentations — where products with “Made in USA” in their title or listing have another country or “imported” listed as their country of origin. Asylum seekers are exposed to violence and traumatic events in their home countries at high rates, leading to mental health challenges such as posttraumatic stress disorder (PTSD). PTSD symptoms and comorbidities such as depression and alcohol misuse are associated with impacts to multiple domains of cognitive functioning among populations such as Veterans. However, the neurocognitive performance of Latinx asylum seekers who experience PTSD symptoms are under-documented in the current literature despite its meaningful impact on clinical care engagement and navigation of the legal process. This thesis examines a specific type of legal controversy surrounding the Trump administration’s dealings with the judicial branch. Central to the matter is the concept of universal injunctions: how a federal court can enjoin even non-parties to a case from behaving in certain ways.

The history of universal injunctions, from pre-Enlightenment England to modern America, is initially discussed. Then special attention is given to their use against President Donald Trump in particular, culminating in the Supreme Court curtailing them, and district court judges ignoring the high court’s ruling. This study examines whether cordons sanitaires, institutional exclusionary arrangements common in Western and Central Europe on the part of mainstream political actors aimed to prevent far-right political parties perceived as posing a threat to liberal democratic order from entering into governing coalitions or otherwise participating in mainstream political life, condition the relationship between immigration-related demographic change and support for far-right political parties. Research Summary: While changes in intellectual property rights (IPR) protection significantly shape firm innovation, the mechanisms driving firms' responses remain poorly understood. Leveraging the Second Amendment to China's Patent Law, which strengthens appropriability particularly for state-owned enterprises (SOEs), as a natural experiment, we show that stronger IPR has mixed effects on SOEs' innovation. While SOEs increase the rate of innovation subsequent to the Amendment, they shift the direction of innovation toward more familiar areas in which they face a lesser need to adjust existing routines. This directional change suggests a quality decline in SOEs' innovation that may be attributed to …

The far Right in America has become radical. In the process, it has outmaneuvered the progressives. In the first months of his second mandate, President Trump has mounted a revolution (or counterrevolution) against the liberal democratic state. Steve Bannon said he was Leninist and wanted to “smash the state.” President Trump has done just that. In this essay, I explore the far Right’s embrace of Lenin. บทความนี้ศึกษาวิวัฒนาการของความรับผิดทางอาญาของนิติบุคคลในประเทศฝรั่งเศสผ่านแนวคิด personnes morales ซึ่งบัญญัติไว้ในมาตรา 121-2 แห่งประมวลกฎหมายอาญาฝรั่งเศส โดยศึกษาแนวคิดนี้ภายใต้กรอบของความรับผิดของนิติบุคคลต่ออาชญากรรมร้ายแรง โดยเฉพาะอย่างยิ่งในบริบทของกฎหมายอาญาระหว่างประเทศ ซึ่งโดยหลักแล้วกำหนดความรับผิดแก่บุคคลธรรมดาเท่านั้น คำถามวิจัยหลักของการศึกษานี้คือ แนวคิด personnes morales ของฝรั่งเศสช่วยอุดช่องว่างของความรับผิดทางอาญาในกรณีที่นิติบุคคลได้เข้ามามีส่วนร่วมในการกระทำความผิดอาญาร้ายแรงตามธรรมนูญกรุงโรมได้หรือไม่ และแนวคิดนี้สามารถนำมาใช้กับความรับผิดทางอาญาระหว่างประเทศได้เพียงใด บทความได้วิเคราะห์คดีสำคัญ เช่น คดีอื้อฉาวทางเภสัชกรรม Mediator คดี Lafarge S.A. ในซีเรีย และคำพิพากษา Association Sportive ซึ่งตัดสินโดยศาลอาญาของฝรั่งเศส โดยที่ศาลได้วางหลักเกี่ยวกับเจตนาของนิติบุคคล (corporate mens rea) ผสมผสานกับความรับผิดโดยอาศัยการเป็นตัวแทนและความรับผิดโดยอิสระขององค์กร รวมถึงวิธีที่ศาลฝรั่งเศสบังคับใช้บทลงโทษกับนิติบุคคลได้อย่างมีประสิทธิภาพ นอกจากนี้ ยังมีการอ้างอิงเปรียบเทียบกับสหราชอาณาจักรและสวีเดนเพื่อแสดงให้เห็นแนวทางทางเลือกอื่น ๆ และเน้นย้ำว่าระบบฝรั่งเศสมีส่วนช่วยในการพัฒนาแนวคิดความรับผิดทางอาญาของนิติบุคคลอย่างไร ท้ายที่สุด บทความนี้ชี้ให้เห็นว่าหลักคำสอนของ personnes morales ไม่เพียงแต่เป็นกรอบแนวคิดเชิงปฏิบัติเท่านั้น แต่ยังเป็นแนวทางเชิงทฤษฎีที่สามารถแก้ไขปัญหาช่องว่างของความรับผิดในกฎหมายอาญาระหว่างประเทศได้และเสนอข้อคิดสำคัญสำหรับการปฏิรูปในอนาคตเพื่อเสริมสร้างความรับผิดชอบของภาคธุรกิจในระดับข้ามเขตอำนาจศาล

การบังคับใช้กฎหมายว่าด้วยหนี้ในทางปฏิบัติให้เสร็จสิ้นครบถ้วนตามกระบวนการแห่งกฎหมายวิธีพิจารณาความแพ่ง (Practical Enforcement Of The Law Of Obligations: Ensuring Complete Execution Under The Civil Procedure Law), Jutaporn Chaidejsuriya

บทความวิจัยนี้มุ่งศึกษาความสัมพันธ์ระหว่างหลักกฎหมายว่าด้วยหนี้ตามประมวลกฎหมายแพ่งและพาณิชย์ กับหลักเกณฑ์การเสนอคดีตามประมวลกฎหมายวิธีพิจารณาความแพ่ง อันเป็นกลไกสำคัญในการบังคับใช้สิทธิของเจ้าหนี้ในทางปฏิบัติ เนื่องจาก “หนี้” เป็นบุคคลสิทธิ เจ้าหนี้จึงไม่อาจบังคับชำระหนี้ได้ด้วยตนเอง แต่ต้องเสนอคดีต่อศาลเพื่อบังคับให้ชำระหนี้ การวิจัยนี้เป็นการวิจัยเชิงหลักกฎหมาย (Doctrinal Legal Research) โดยวิเคราะห์ประเด็นสำคัญเกี่ยวกับหนี้ 7 ประการ ได้แก่ การบอกกล่าวลูกหนี้กับอำนาจฟ้อง การบังคับชำระหนี้ การเรียกดอกเบี้ยกรณีลูกหนี้ผิดนัด การใช้สิทธิเรียกร้องของลูกหนี้ การโอนสิทธิเรียกร้อง การเพิกถอนการฉ้อฉล และอายุความบังคับจำนอง ทั้งนี้ ผู้วิจัยได้จำแนกบทบัญญัติว่าด้วยหนี้ออกเป็น 3 ประเภท ได้แก่ (1) บทบัญญัติที่มีเนื้อหาไม่ครอบคลุมเกี่ยวกับการเสนอคดี (2) บทบัญญัติที่กำหนดวิธีไว้แต่ไม่ครบถ้วนหรือมีปัญหาในการตีความ และ (3) บทบัญญัติที่ไม่สอดคล้องกับกฎหมายวิธีพิจารณาความแพ่ง แล้วนำมาวิเคราะห์เชื่อมโยงกับบทบัญญัติในประมวลกฎหมายวิธีพิจารณาความแพ่ง รวมถึงศึกษาจากตำราและแนวคำพิพากษาศาลฎีกา ผลการศึกษาพบว่า การบังคับใช้กฎหมายว่าด้วยหนี้ให้มีประสิทธิภาพ จำเป็นต้องตีความและบังคับใช้สอดคล้องกับกฎหมายวิธีพิจารณาความแพ่ง ซึ่งผลลัพธ์ของงานวิจัยนี้จะช่วยลดปัญหาทางปฏิบัติและเสริมสร้างความเข้าใจที่ถูกต้องแก่ผู้ศึกษากฎหมายและผู้ปฏิบัติงานในคดีแพ่ง

คำชี้ขาดที่เกิดจากกระบวนการอนุญาโตตุลาการระหว่างประเทศมักจะลงท้ายด้วยส่วนที่เป็นประกาศิต 2 ส่วน ส่วนแรกเป็นคำชี้ขาดที่ว่าด้วยจำนวนค่าเสียหาย ค่าสินไหมทดแทนที่ฝ่ายแพ้คดีจะต้องชำระหรือใช้คืนให้แก่ฝ่ายชนะคดีหรือปฏิบัติการชำระหนี้รูปแบบอื่นให้แก่ฝ่ายที่ชนะคดี รวมเรียกว่าเป็นคำชี้ขาดในเนื้อความแห่งคดี ส่วนที่สองเป็นคำชี้ขาดในเรื่องค่าใช้จ่ายซึ่งมักกำหนดจำนวนค่าใช้จ่ายในการอนุญาโตตุลาการที่ฝ่ายแพ้คดีต้องชำระหรือใช้คืนให้แก่ฝ่ายชนะคดี เรียกว่าคำชี้ขาดในส่วนค่าใช้จ่าย ค่าใช้จ่ายในการอนุญาโตตุลาการมีจำนวนสูงขึ้นอย่างสม่ำเสมอ แม้ว่าเทคโนโลยีจะได้รับการพัฒนาให้ก้าวหน้าอย่างต่อเนื่องและมีการนำเอาเทคโนโลยีมาใช้ในกระบวนการอนุญาโตตุลาการอย่างกว้างขวางก็ตาม คู่พิพาทฝ่ายที่แพ้คดีอนุญาโตตุลาการระหว่างประเทศนอกจากต้องแบกรับภาระค่าใช้จ่ายของตนแล้วยังจะถูกบังคับโดยคำชี้ขาดให้เข้ารับภาระหรือชดใช้ค่าใช้จ่ายของฝ่ายที่ชนะคดีด้วย ทั้งนี้เป็นไปตามหลักเกณฑ์ที่ว่า “Costs follow the event” หรือ “ผู้แพ้เป็นผู้รับผิดชอบค่าใช้จ่าย” ที่ถือปฏิบัติกันอยู่ในวงการอนุญาโตตุลาการระหว่างประเทศ หลักเกณฑ์นี้กำเนิดขึ้นในประเทศอังกฤษ ต่อมาถูกนำไปใช้กันอย่างแพร่หลายทั่วโลกทั้งในประเทศคอมมอนลอว์และประเทศซิวิลลอว์ คู่พิพาทที่หวั่นวิตกว่าจะต้องรับภาระค่าใช้จ่ายที่สูงลิ่วหากตนตกเป็นฝ่ายแพ้คดี สามารถนำเอาวิธีการยื่นคำเสนอปิดผนึกเพื่อประนอมข้อพิพาทมาใช้เป็นเครื่องมือจำกัดหรือลดค่าใช้จ่ายดังกล่าว หลักปฏิบัติในเรื่องการทำคำเสนอปิดผนึกเพื่อประนอมข้อพิพาทถือเป็นเรื่องใหม่สำหรับประเทศไทย ผู้เขียนมีความประสงค์ที่จะนำเสนอหลักกฎหมายและประเพณีปฏิบัติในเรื่องดังกล่าวที่แพร่หลายอยู่ในสถาบันอนุญาโตตุลาการหลักของโลกให้ผู้ประกอบธุรกิจและนักกฎหมายไทยได้รับทราบและนำไปใช้ให้เป็นประโยชน์หากต้องเข้าไปเกี่ยวพันกับการอนุญาโตตุลาการระหว่างประเทศ

บทความวิจัยนี้มุ่งศึกษาถึงแนวคิดและหลักความรับผิดเพื่อละเมิด โดยเฉพาะความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นอันเกิดจากข้อสันนิษฐานความรับผิดตามกฎหมายภายใต้แนวคิดที่ว่าบุคคลนั้นอาจมีส่วนผิดอยู่ด้วยในการที่เกิดความเสียหายแก่บุคคลอื่น หรือมีความบกพร่องในการควบคุมดูแลจึงเกิดความเสียหายขึ้น การศึกษาวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพ โดยเน้นการวิจัยเอกสารโดยศึกษาค้นคว้าจากหนังสือ งานวิจัย วิทยานิพนธ์ ตลอดจนบทบัญญัติกฎหมายที่เกี่ยวข้องกับความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นทั้งภาษาไทยและภาษาต่างประเทศ โดยนำข้อมูลต่าง ๆ มาศึกษาและวิเคราะห์เพื่อนำมาพัฒนากฎหมายความรับผิดเพื่อละเมิด จากการศึกษาพบว่ากฎหมายได้กำหนดความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นเอาไว้หลายกรณีโดยพิจารณาจากความสัมพันธ์ตามกฎหมาย ตามสัญญา ตามหน้าที่ในฐานะพิเศษ เช่น ความรับผิดของนายจ้างลูกจ้าง ความรับผิดของตัวการตัวแทน ความรับผิดของบิดามารดา ความรับผิดของครูบาอาจารย์ แต่ไม่พบกรณีความรับผิดของคู่สมรส ซึ่งคู่สมรสนั้นถือว่าเป็นบุคคลที่มีนิติสัมพันธ์ระหว่างกันตามกฎหมายอันก่อให้เกิดสิทธิ หน้าที่ และความรับผิด ด้วยเหตุนี้ จึงสมควรแก้ไขปรับปรุงกฎหมายโดยเฉพาะในเรื่องความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นของคู่สมรสเพื่อให้พัฒนาและสอดคล้องกับสภาพสังคม เพิ่มความระมัดระวังของบุคคลที่มีความสัมพันธ์เกี่ยวข้องในการดำเนินชีวิตทางสังคม ตลอดจนมุ่งเยียวยาและเพิ่มโอกาสให้ผู้ที่ได้รับความเสียหายได้รับการชดใช้ค่าสินไหมทดแทนอย่างเป็นธรรมอันเป็นไปตามเจตนารมณ์ของกฎหมายละเมิด

ภาษีทรัมป์กับองค์การการค้าโลก: ระบบการค้าเสรีแบบพหุภาคีล่มสลายแล้ว? (Trump Tariffs And The World Trade Organization: Has The Multilateral Free Trade System Collapsed?), Sakda Thanitcul

แม้ว่าองค์การการค้าโลกจะไม่สามารถทำอะไรกับภาษีทรัมป์ได้และปล่อยให้สหรัฐอเมริกาขึ้นอัตราภาษีกับประเทศคู่ค้า 59 ประเทศ ในรูปแบบการเจรจาแบบทวิภาคีก็ตาม แต่ระบบการค้าเสรีแบบพหุภาคีก็อาจยังไม่ถึงขั้นล่มสลาย เนื่องจากเหตุผลสองประการ ประการแรก คือ ประเทศคู่ค้า (ยกเว้นจีนและแคนาดา) ไม่ได้ขึ้นอัตราภาษีนำเข้าตอบโต้และสัดส่วนการค้าของสหรัฐอเมริกาในการค้าโลกคิดเป็นเพียงร้อยละ 11 เท่านั้น ประการที่สอง คือ ภาษีทรัมป์ที่มีพื้นฐานแนวคิดของลัทธิกีดกันทางการค้ามีความขัดแย้งอย่างมากกับแนวคิดพื้นฐานของเศรษฐศาสตร์กระแสหลักที่เชื่อในการค้าเสรีแบบพหุภาคี ทำให้เชื่อได้ว่าภาษีทรัมป์จะไม่ยั่งยืนตลอดไป อย่างไรก็ตาม มี “การแตกร้าว” ในระบบการค้าเสรีแบบพหุภาคีที่มีองค์การการค้าโลกเป็นผู้กำกับดูแลและบริหารกฎเกณฑ์ กล่าวคือ การไม่มีผู้ตัดสินในองค์กรอุทธรณ์ ส่งผลให้กลไกการระงับข้อพิพาทขององค์การการค้าโลกกลายเป็นอัมพาตและสหรัฐอเมริกาเป็นประเทศเดียวที่มีสถานะเหนือประเทศสมาชิกอื่น ๆ อีก 165 ประเทศ เนื่องจากเป็นสมาชิกประเทศเดียวในองค์การการค้าโลกที่สามารถกำหนดอัตราภาษีนำเข้าได้ตามอำเภอใจโดยอ้างเหตุผลด้านความมั่นคงของชาติ

The Cognitive Attentional Standards Platform (C.A.S.) was developed to assess attention related harms, cognitive safety, digital autonomy, and platform influence across digital systems (Clark, 2026). Algorithmic recommendation systems and interface designs shape attention by combining visually salient cues with uncertain reward timing and low friction interaction. These conditions can sustain anticipatory checking, extend time on task, and reduce natural disengagement points through patterns such as infinite scrolling and autoplay. This paper synthesizes research across neuroscience, human computer interaction, behavioral economics, and artificial intelligence to argue that attention capture is a predictable outcome of incentive driven design rather than an individual failure of self regulation. For more than a century, zoning has shaped the American landscape, often at the expense of wildlife and ecosystems. Rooted in legal doctrines that treated animals as property and nature as a raw material, zoning codes have fragmented habitats, erased migration corridors, and accelerated biodiversity loss. At the same time, federal protections are narrowing, leaving critical gaps in environmental governance. This Article argues that local governments possess both the authority and the obligation to respond. Fine print is everywhere. It governs how we bank, shop, work, travel, and even receive medical care. Yet most people never read it—and those who try often give up because they are overwhelmed by technical jargon, impenetrable legal clauses, and strategically hidden terms. Still, these documents are not neutral. Every choice of wording, structure, and design quietly shapes behavior: nudging people to click “I agree,” to remain enrolled, or to give up rights they never realized they had.

"This paper examines 16 adolescents’ narratives about the abuse they experienced during childhood. To date, most research examining child abuse (CA) survivorship and recovery has been conducted with adults who look back on their early experiences. Consequently, this study fills gaps in our knowledge by offering a youth-centered view of survivors’ efforts to cope with CA. The data come from a 12-year qualitative study of a group counseling program for high school students in Hawaiʻi. "Previous indicators of scholarly influence have been primarily quantitative, measuring a scholar’s influence through citation counts. This body of literature has overlooked the reflections of distinguished scholars, such as the recipients of the Sutherland Award, in the discipline as a form of scholarly influence. The current paper examines the Sutherland Address from 2001 to 2022. The key findings indicate that the majority of Sutherland Addresses reproduced existing sociological canons, while a minority of Sutherland Award winners explicitly rejected Sutherland’s sociological assumptions and their influence on criminology. "Does gender inequality impact the careers of female law enforcement officers in the Southeast Missouri region? Using a qualitative single instrumental case study, seven cis-gendered female law enforcement officers who were employed at local law enforcement agencies within the Southeast Missouri region were interviewed to investigate the central research question. Four themes emerged from the data that illustrated their experiences: sexual exploitation and harassment, a lack of work-life balance, the presence of gender stereotypes, and patriarchal hierarchy and male dominance in the workplace. "Qualitative researchers are expected, sometimes required, to publish their data open access (OA). This is for the sake of science, impact, and social justice. Yet, understandably, qualitative criminologists are worried about what this means for their workload and their ability to protect subjects’ confidentiality. To be solutions-oriented, we developed an open-source Python script for anonymizing qualitative data. It uses named-entity recognition and fuzzy-rule based merging to identify and replace personally identifiable information (PII) with unique pseudonyms.
