This dissertation in four essays critically examines the emergence of international criminal courts: their international political underpinnings, context, and the impact of their political production in relation to liberal legalism, liberal political theory, and history. The essays conceive of international criminal legal bodies both as political projects at their inception and as institutions that deny their own political provenance. The work is primarily one of political theory at the intersection of history, international relations, international criminal law, and the politics of memory. This paper examines the intersection between human rights and security assistance in Mauritania. In American security assistance broadly, and within the Trans-Sahara Counterterrorism Partnership specifically, there has been an over-securitization of “whole of government” counterterrorism policy. While the United States recognizes the need to address the social, economic, and political roots of extremism, it has failed to do so in practice. If the United States continues to support Mauritania with conventional security assistance but does not tackle the root causes of extremism, it will ultimately fail in fighting terrorism in the Sahel. The purpose of this research paper is to examine how international humanitarian law (IHL) and international human rights law (IHRL) are applied to the Guantánamo Bay detention center. This paper was completed through the research of international treaties, court cases, and secondary sources that thoroughly discussed issues pertaining to Guantánamo and international law.

The UN General Assembly adopted the Convention to End All Discrimination against Women (CEDAW) in 1979 and it is currently the 2nd most ratified human rights convention after the Convention on the Rights of the Child. International Norm Echoing In Rebel Groups: The Cases Of The Kosovo Liberation Army And The Liberation Tigers Of Tamil Eelam, Jennifer A. Mueller

This research demonstrates that rebel groups use international norms in their discourse and echo patterns in the discourse of states and that they do so to promote their own legitimacy at key turning points in their conflicts. Which international norms rebel groups use most frequently is partially determined by the congruence of those norms with their local norms and beliefs and the degree to which a group's internal structure has become more hierarchical and specialized. Historically and philosophically, press freedom has closely been linked to the fight against tyranny and the advancement of human rights. But coverage of press freedom as a distinct human right is surprisingly absent from scholarship and the human rights agenda. This dissertation fills this gap in the academic literature by examining why press freedom has not become part of the established international human rights debate, despite its centrality to democratic theory.

A Tangled Hope: America, China, and Human Rights at the End of the Cold War, 1976-2000, discusses the evolution of both the international and American understanding of human rights. Beginning with a discussion of the philosophical and cultural frameworks concerning "rights" that developed in Europe and the Americas throughout the 18th and 19th centuries, this work moves into the post-World War II climate that shaped Jimmy Carter and his unique understanding of human rights and America's role in the Cold War world. Human trafficking is an international problem that plagues every country in the world. Although no reliable concrete data exist on the extent of human trafficking internationally, it is estimated that thousands of women are trafficked into the European Union every year. According to research conducted by the European Roma Rights Centre in 2010, a disproportionately high percentage of these victims are of Roma ethnicity. Research from service providers, law enforcement and international organizations estimates that Roma comprise between 50 to 80 percent of human trafficking victims in Bulgaria with similar levels across Central and Eastern Europe. This dissertation traces the emergence of the global human rights movement, investigates the role of popular culture as a vehicle for mobilization, and critically examines why the movement has failed to adequately politicize its supporters in the process. Beginning in the mid-1970s, a broad shift began to take place in which ordinary people were routinely confronted with human suffering, as conflict and crisis assumed a role as ritualized news events. The public response to these phenomena demonstrated a capacity for solidarity and engagement based on cosmopolitan premises. Women tend to suffer a disproportionate amount of sexual and reproductive violence during periods of conflict, though they generally participate at a lower rate than men in transitional justice processes. Because participation is discussed in procedural justice literature as being crucial to securing feelings of justice and dignity within victims of violence, the lack of women’s participation in transitional process indicates that justice outcomes could suffer without equitable participation of women.
