Counterinsurgency is the dominant aspect of US operations in Afghanistan, and since ISAF—the NATO-led security and assistance force—has assumed growing security responsibility throughout the country, it is also a mission for the Europeans.1 The frame in which military operations are conducted is irregular warfare, a form of conflict which differs from conventional operations in two main aspects. First, it is warfare among and within the people. Second, it is warfare in which insurgents avoid a direct military confrontation, using instead unconventional methods and terrorist tactics.

On March 11th, 2000, two children who were playing in the neighborhoods of Mitrovica, Kosovo, got hurt by an “unexploded ordnance”. One of them died in the explosion, the other was severely injured. An inquire clarified that the ordnance was a “bomblet”, a part of a cluster bomb dropped during the 1999 NATO air campaign against the Federal Republic of Yugoslavia.

This dissertation studies the interaction between international institutions and nation states. More specifically, it examines how the membership conditionality of the North Atlantic Treaty Organization (NATO) and the European Union (EU) was adopted by candidate states. It uses the Czech and Slovak accessions to NATO and the EU to argue that, in order to understand the external phenomenon of conditionality, we need to study its effects within states. Critical to this process is national leadership. National leaders determine whether and how conditionality is implemented. Furthermore, this dissertation asserts that successful compliance with NATO and EU conditionality is decisively determined by …

In 2006, NATO is operating well out of area and conducting missions beyond the collective defense limits of its founding Treaty. NATO increasingly supports humanitarian relief operations, while also engaged in Afghanistan, the Mediterranean, and African crisis spots.

These changes provide the reason to examine the thesis: only if NATO is able to effectively transform will it be able to continue in its role as the primary European security institution. The 1999 U.S.-led, NATO-assisted air strike against Yugoslavia has been extolled by some as leading to the creation of a new rule of international law permitting nations to undertake forceful humanitarian intervention where the Security Council cannot act. This view posits the United States as a benevolent hegemon militarily intervening in certain circumstances in defense of such universal values as the protection of human rights. This article challenges that view. NATO's Kosovo intervention does not represent a benign hegemony introducing a new rule of international law.
