Mormon Women's Sense Of Empowerment, Stace Hucks Christianson

This research focuses on the empowering experiences of LDS women within the patriarchal structure as organized by the LDS church. Women in the LDS church empower themselves by drawing both external and internal resources. The degree of flexibility that leaders and member of the LDS church adopt externally influences the degree of empowerment that LDS women. The more internal factors an LDS woman adopts the greater her internal sense of empowerment.

The Utility Of Desert, Paul H. Robinson, John M. Darley

The article takes up the debate between utility and desert as distributive principles for criminal liability and punishment and concludes that a utilitarian analysis that takes account of all costs and benefits will support the distribution of liability and punishment according to desert, or at least according to the principles of desert as perceived by the community. It reaches this conclusion after an examination of a variety of recent social science data. On the one hand, it finds the traditional utilitarian theories of deterrence, incapacitation, and rehabilitation to have little effect in many instances. It finds instead that the real …

Recent Supreme Court decisions and the impeachment of President Clinton has reinvigorated the debate over Congress’s authority to employ devices such as special counsels and independent agencies to restrict the President’s control over the administration of the law. The initial debate focused on whether the Constitution rejected the “executive by committee” employed by the Articles of the Confederation in favor of a “unitary executive,” in which all administrative authority is centralized in the President. More recently, the debate has begun to turn towards historical practices. Some scholars have suggested that independent agencies and special counsels have become such established features …

Exploring The Dark Matter Of Judicial Review: A Constitutional Census Of The 1990s, Seth F. Kreimer

Most debate about the power of judicial review proceeds as if courts primarily invoke the Constitution against the considered judgment of elected legislatures; most constitutional commentary focuses on confrontations between the United States Supreme Court and state or federal legislatures. In fact, the federal courts most often enforce constitutional norms against administrative agencies and street-level bureaucrats, and the norms are enforced not by the Supreme Court but by the federal trial courts. In this Article, Professor Kreimer surveys this "dark matter" of our constitutional universe.

This study investigated the relationship between acculturation and college attendance of Hispanic high school students. Acculturation is mainly associated with the degree to which one experiences cultural change toward the majority culture. It was theorized that acculturation would have a postive association with college attendance. Acculturation level, socioeconomic status and college attendance were the varibles utilized. The students filled out a questionnaire that was composed of 12 questions and five-self report questions. The Twelve qestions were taken from the Short Acculturation Scale, two questions regarding socioeconomic status were taken from the Hollingshead Scocioecomic Scale, with the remaining questions inquiring about …

The study assessed the factors contributing to expected ages of marriage in two student populations that are presumed to differ in academic achievement and goals. A primarily goal of this study was to describe the influence that adult attachment style has upon a person's expected age at marriage. A secondary goal was to explore other social and goal-oriented influences on timing of marriage in the two populations. There were no significant differences in attachment style for men and women. African-American students (mostly Freshmen) enrolled for the first year at a four-year university completed information about the racial composition of their high school, family income, living arrangements, and stressor prior to entering school. At two times during the first semester they completed measures of social support, network orientation and adaptation to college. Information about Grade Point Average (GPA) for the following term and attendance at the University one year later were also obtained. Racial composition of high school had some affect on social support at the university: Students from integrated and mainly Black high schools reported more social support satisfaction …

The present study investigated the effects of race and socioeconomic status on the acceptance of biracial individuals having one Black and one White parent. A sample of 153 Black and 114 White college students were divided into high- and low-socioeconomic status based on demographic information. Acceptance of biracial individuals was measured by 2 modified versions of the Social Distance Scale (SDS1 and SDS2) developed by Bogardus (1928), a shortened version of the Scale To Measure Attitudes Toward Defined Groups (AS) developed by Grice (1934), and a measure of Perceived Commonality (PC) developed by Feather (1980). This essay is the story of the author’s election as editor-in-chief of the Arkansas Law Review and of her tenure in that role. The story implicates a range of legal issues including hate speech, sexual harassment, sex discrimination, defamation, and intentional infliction of emotional distress. It is also the tale of the author’s feminist epiphany and of the law school’s failure to respond to the harassment. It was published in the 50th anniversary issue of the Arkansas Law Review.
