Writing About Aj Pop B'Atz': Bruce Grindal And The Transformation Of Ethnographic Writing, Sarah Ashley Kistler
Writing About Aj Pop B'Atz': Bruce Grindal And The Transformation Of Ethnographic Writing, Sarah Ashley Kistler
Faculty Publications
The works of Bruce Grindal teach us many things about anthropology’s humanistic tradition. With examples such as Redneck Girl and “Postmodernism as Seen by the Boys at Downhome Auto Repair,” Bruce Grindal demonstrated how we can creatively engage our ethnographic writing to reflect lived experiences. In this article, I examine Bruce’s influence on my ethnographic writing and collaborative research in the Maya community of San Juan Chamelco, Guatemala. Since 2006, I have worked collectively with a group of Chamelqueños to investigate the story of their local hero, Aj Pop B’atz’. In the sixteenth century, Aj Pop B’atz’ welcomed Spanish invaders …

Don't Ask, Don't Tell: Coming Out In An Alcoholic Family, Lisa M. Tillmann Ph.D.
Faculty Publications
This piece invites readers inside emotional and relational dynamics of coming
out as gay in an alcoholic family system. Taking an interpretive approach to
research, focused on how participants make sense of and make meaning
from their lived experience, “Don’t Ask, Don’t Tell” offers a longitudinal and
narrative ethnographic account of family secrecy and disclosure.

What follows is a fictional account. Our “characters” bear our real names; the other eight are composites of students we have taught and from whom we have learned; activists with whom we have worked; and staff, faculty, and administrators we have trained in venues such as Safe Zone. We portray our ally (Lisa)-lesbian (Kathryn) relationship this way for two reasons: one, we had not secured permission from real students, colleagues, or community members to represent their lives and experiences, and two, we seek a way to show our partnership, both personal and professional since 2000, in action. To each of …

The author, a heterosexual woman, and Gordon Bernstein, a gay man, have been friends and research collaborators since 1995. In 2004, the author accompanied Gordon on a trip to his hometown of Philadelphia to conduct fieldwork and interview family members. This project ethnographically explored personal and relational opportunities and challenges associated with coming out in a family system defined by avoidant communication, hegemonic masculinity, and terminal illness.

The Last Mile Of The Way: Soul Music And The Civil Rights Movement, Christopher Smith
AUCTUS: The Journal of Undergraduate Research and Creative Scholarship
In the summer of 1960, a group of Soul performers was scheduled to perform at a segregated dance in Little Rock, Arkansas. Jesse Belvin, Jackie Wil-son and Arthur Prysock were to play two shows that evening—one for a black audience and a second show for a white audience. These segregated shows were essentially the norm in the majority of the country. However, that night, Jackie Wilson decided he was not going to perform the second show for a white audi-ence and encouraged the others to follow suit. They were all subsequently run out of town at gun point and somewhere …
The Common Sense Of Contract Formation, Tess Wilkinson-Ryan, David A. Hoffman
The Common Sense Of Contract Formation, Tess Wilkinson-Ryan, David A. Hoffman

What parties know and think they know about contract law affects their obligations under the law and their intuitive obligations toward one another. Drawing on a series of new experimental questionnaire studies, this Article makes two contributions.First, it lays out what information and beliefs ordinary individuals have about how to form contracts with one another. We find that the colloquial understanding of contract law is almost entirely focused on formalization rather than actual assent, though the modern doctrine of contract formation takes the opposite stance. The second Part of the Article tries to get at whether this misunderstanding matters. Is …

Intersectionality And Title Vii: A Brief (Pre-)History, Serena Mayeri

Title VII was twenty-five years old when Kimberlé Crenshaw published her path-breaking article introducing “intersectionality” to critical legal scholarship. By the time the Civil Rights Act of 1964 reached its thirtieth birthday, the intersectionality critique had come of age, generating a sophisticated subfield and producing many articles that remain classics in the field of anti-discrimination law and beyond. Employment discrimination law was not the only target of intersectionality critics, but Title VII’s failure to capture and ameliorate the particular experiences of women of color loomed large in this early legal literature. Courts proved especially reluctant to recognize multi-dimensional discrimination against …
Progressive Legal Thought, Herbert J. Hovenkamp
Progressive Legal Thought, Herbert J. Hovenkamp
All Faculty Scholarship
A widely accepted model of American legal history is that "classical" legal thought, which dominated much of the nineteenth century, was displaced by "progressive" legal thought, which survived through the New Deal and in some form to this day. Within its domain, this was a revolution nearly on a par with Copernicus or Newton. This paradigm has been adopted by both progressive liberals who defend this revolution and by classical liberals who lament it.
Classical legal thought is generally identified with efforts to systematize legal rules along lines that had become familiar in the natural sciences. This methodology involved not …
A Mechanism For Sensorimotor Translation In Singing: The Multi-Modal Imagery Association (Mmia) Model, Peter Q. Pfordresher, Andrea R. Halpern, Emma B. Greenspon
A Mechanism For Sensorimotor Translation In Singing: The Multi-Modal Imagery Association (Mmia) Model, Peter Q. Pfordresher, Andrea R. Halpern, Emma B. Greenspon
Faculty Journal Articles
WE PROPOSE A NEW FRAMEWORK TO UNDERSTAND singing accuracy, based on multi-modal imagery associations: the MMIA model. This model is based on recent data suggesting a link between auditory imagery and singing accuracy, evidence for a link between imagery and the functioning of internal models for sensorimotor associations, and the use of imagery in singing pedagogy. By this account, imagery involves automatic associations between different modalities, which in the present context comprise associations between pitch height and the regulation of vocal fold tension. Importantly, these associations are based on probabilistic relationships that may vary with respect to their precision and …

The Speed Of Our Mental Soundtracks: Tracking The Tempo Of Involuntary Musical Imagery In Everyday Life, Kelly Jakubowski, Nicolas Farrugia, Andrea R. Halpern, Sathish K. Sankarpandi, Lauren Stewart
Faculty Journal Articles
The study of spontaneous and everyday cognitions is an area of rapidly growing interest. One of the most ubiquitous forms of spontaneous cognition is involuntary musical imagery (INMI), the involuntarily retrieved and repetitive mental replay of music. The present study introduced a novel method for capturing temporal features of INMI within a naturalistic setting. This method allowed for the investigation of two questions of interest to INMI researchers in a more objective way than previously possible, concerning (1) the precision of memory representations within INMI and (2) the interactions between INMI and concurrent affective state. Over the course of 4 …

Absolute Pitch In Naturalistic Singing: A Commentary On Olthof Et Al., Andrea R. Halpern
Faculty Journal Articles
The parent article looks at pitch stability in an archive of folksongs recorded over several decades. Some evidence for pitch stability was found. Here, I consider some additional aspects of the archive that could be examined, offer some extensions to relevant laboratory studies, and consider some inherent strengths and limitations of the naturalistic, archival approach.

Neuroimaging has contributed greatly to our understanding of the sensory, motor, and cognitive systems involved in musical processing. Cortical loops connecting auditory with parietal, premotor, and prefrontal cortices are important for encoding pitch and temporal relationships from which music is built and for generating musical expectancies. These circuits are also important for holding information in working memory and for interfacing perceptual and motor representations. Musical imagery recruits auditory areas together with frontal and supplementary motor regions. Musical emotion emerges from the interaction of these systems with the reward circuit. All of these systems are modifiable functionally and structurally following training.

On Not 'Having It Both Ways' And Still Losing: Reflections On Fifty Years Of Pregnancy Litigation Under Title Vii, Deborah L. Brake
Articles
This article, published in the B.U. Law Review Symposium issue, “The Civil Rights Act of 1964 at 50: Past, Present and Future,” reflects on the past fifty years of conflict and struggle over how to treat pregnancy discrimination under Title VII. Pregnancy has played a pivotal role in debates among feminist legal scholars and women’s rights advocates about the limitations of both the equal treatment and special treatment anti-discrimination frameworks. The article’s title references the much-discussed Wendy W. Williams cautionary note that if we cannot have it “both ways” we need to decide which way we want to have it …
