From the mid-1960's, Virginia Republicans, in tune with President Richard Nixon's active "Southern strategy," revived party fortunes in the state by capitalizing on the ongoing degeneration of Virginia Senator Harry F. Byrd, Sr.'s powerful conservative Democratic organization and the factionalization of the state Democratic Party. Republican Abner Linwood Holton, Jr., solidly carried the 1969 gubernatorial election. In the 1970 senatorial election Independent Harry Flood Byrd, Jr., defeated Republican Ray Lucian Garland and Democrat George Rawlings. Senator Byrd, Jr., had enjoyed Nixon's "benevolent neutrality," but never did join the Republican Party as the president had hoped; in office he voted with …

In 1994. the Tennessee General Assembly mandated a new early voting system that allowed voters to cast a ballot in a two-week period prior to any election. Unlike absentee balloting, which requires registrants to justify why they cannot participate on election day, early voting is available to any registered voter who chooses to do so.

By enacting early voting in Tennessee, the state legislature hoped to achieve increased turnout and easier access for citizens unable to vote at a regular polling site on election day. The purpose of this chapter is to ascertain whether the program was able to increase …

In this chapter, we examine the party identifications and ideological orientations of Tennesseans from 1989 through 1996, as revealed through survey research. We also look at Tennesseans' positions on several issues of public policy that have been salient in state politics during this period. Our intent is to isolate any trends in the partisan and ideological character of the state while examining citizens' positions on key issues.

To understand the forces shaping current Tennessee politics, we discuss two fundamental concepts of Tennessee's electoral system: voting turnout and partisanship. These two concepts are easily illustrated by two questions. First, how many people participate in elections in the state? Second, whom do Tennesseans elect to represent them? While we use a historical perspective to inform the analysis, we are generally more interested in the forces shaping politics in Tennessee today.

Although Maine's information infrastructure is several years ahead of the nation in development, Maine ranks only 41st out of 50 states in its "Digital Democracy," that is, its use of new telecommunications and information technologies to permit greater citizen access to laws, legislators and the state's legislative processes. State Rep. Joseph Carleton outlines changes underway in the Maine Legislature that will result in greater digital democracy throughout the state. Through advances such as e-mail, the Internet, and other digital forms of communication, Carleton envisions new ways of doing business both for legislators and citizens. For nearly fifty years, mainstream Cold War historians have credited George Kennan with ushering in a new age in foreign policy. Kennan did, after all, send a "Long Telegram" from Moscow on February 22, 1946 that crystallized for the US government a policy of "containing" the Soviet regime. Kennan, a State Department official and expert on Soviet affairs, submitted to Secretary of State James Byrnes an 8,000 word telegram depicting a communist government bent on upholding the expansionist tradition of the Russian czars. Jurisdiction matters. Outside of the set of jurisdictional constraints, the judiciary is at sea; it poses a threat to the separation of powers and risks becoming a dangerous and domineering branch. Jurisdictional limitations serve a particularly important function when the judiciary is dealing with issues of international law. Since much of international law concerns foreign relations, the province of the executive and, in part, the legislature, the danger that the judiciary will act in a policy-making role or will frustrate the functions of the political branches is especially great. This Article reexamines the doctrine of public use under the Takings Clause and its ability to impede takings for private use through an application of public choice theory. It argues that the judicial validation of interest-group capture of the condemnation power through a relaxed public use standard in Takings Clause review can be explained by interest group politics and public choice theory and by institutional tendencies inherent in the independent judiciary. Legislators can sell the eminent domain power to special interests for almost any use, promising durability in the deal given the low probability that the judiciary will invalidate it …

This short article presents a valuable statistical research tool for those involved in analysis of U.S. Supreme Court opinions. Researchers are made available the data regarding the number of pages that the Supreme Court has written each term and provides an easier basis for identifying this page count with the term announced, which is not otherwise immediately evident from the volume number of the U.S. Reports.
