Insurgent Until Proven Innocent: Land, Power, And The Right To Defend Rights, Kelsey Jost-Creegan

As the climate crisis intensifies, advocates worldwide have stood up to defend their communities, territories, and environment. In response, they have faced violent retaliation. This repression persists despite evolving international, regional, and national-level legal frameworks around the “right to defend rights” and the “right to protection.” This article begins by providing a comprehensive overview of this evolving legal landscape. Against this backdrop, the article examines the tactics and architectures of violence used to repress land and environmental defenders through the lens of counterinsurgency theory.
The article proposes a typology of counterinsurgent violence including: surveillance; stigmatization; criminalization; arbitrary detention; infiltration; cooptation; …

A recent burst of revisions in the bedrock regulations governing projects that may adversely affect wildlife represents a generational shift in policy. Streamlining federal decision -making drove much of this reform. Streamlining offers a path to address climate change without abandoning a longstanding commitment to wildlife conservation. The conservation community recognizes the need to build new infrastructure to reduce the rate of climate change through air emissions. Armed conflicts have a significant and detrimental effect on the climate system, with considerable implications for efforts to mitigate and adapt to climate change and the civilian population. Yet the environmental provisions under the law of armed conflict (LOAC), drafted some half a century ago, struggle to adequately address these concerns. This article assesses the capacity of LOAC to address conflict-driven climate damage and its cascading impacts by characterizing these harms as environmental damage and as injury to civilians. Ireland's approach to managing its coastlines focuses more on a short-term solution method rather than long-term, eco-friendly solutions. Their coastal defenses are created upon an immediate need without clear policies and sufficient research. As a result, beach ecosystems are frequently damaged, and the erosion is only reduced to a certain extent. To reduce erosion and protect both the environment and Irish culture, this study suggests that Ireland should implement national policies focused on regularly monitoring coastal erosion, researching nature-based solutions, and implementing them to address the problem. This study is a statistical analysis of climate trends within the Dallas-Fort Worth metroplex according to several time-scale models to understand how the climate for the locality has changed and to provide a basis for projections of what future climate might look like. Trends in mean temperature and precipitation for North Central Texas generally correlate with corresponding global trends linked to natural variability and anthropogenic-induced climate change. Temperature rises in this region annually by 0.08°C and by 0.22°C for a three-decade average. Seasonal increases in three-decadal averages of temperature for North Central Texas relative to the average of the reference …

Grounded in a case study in Barbuda in the Caribbean, this research examines sustainability from the perspective of what arts and heritage can contribute to community engagement and local and broader understandings about the environment. This article documents a growing body of literature recognizing the role of arts and culture, including local knowledge and traditional ecological knowledge (TEK), in climate change endeavors. Art and TEK present expansive world views. Contextual information situates research done on the island of Barbuda pre- and post-Hurricane Irma. The combined impacts of land use and climate change pose significant challenges to bumblebee populations in the Northeast United States (NEUS), a region characterized by dense urbanization, diverse landscapes, and exposure to climate extremes. As urban and suburban areas expand, the loss of agricultural lands and open spaces alters habitat availability for bumblebees, which rely on grasslands, meadows, and forest edges for nesting and foraging. Simultaneously, the NEUS is experiencing an increase in extreme climate events, including prolonged heatwaves, heavy precipitation, and shifts in temperature patterns. The lack of progress in addressing climate change has led to increased interest in solar radiation modification (SRM)—a collection of large-scale interventions that cool the planet by managing the amount of solar radiation that reaches the earth. SRM complicates climate change governance because, in addition to advancing collective action to reduce greenhouse gas emissions, governance needs to restrain unilateral SRM action while balancing diverging actor interests, ethical risks and scientific uncertainty. We survey international climate policy experts for their assessments of the potential for effective global governance of SRM and the likelihood of possible international responses to unilateral SRM scenarios. …

Karst aquifers represent some of the world’s most productive yet vulnerable groundwater systems, supplying freshwater to approximately 10% of the global population across 15% of Earth’s ice-free land surface. Their distinctive hydrological characteristics— including rapid recharge, preferential flow paths, and limited natural filtration— create unique vulnerabilities to both climate variability and contamination that pose significant challenges for sustainable water resource management. This dissertation presents a comprehensive multi-scale analysis of karst aquifer vulnerability through three interconnected studies that examine climate change impacts, microbial contamination dynamics, and contaminant transport processes across diverse geographic and hydrogeologic settings.

The southeastern United States is a critical biodiversity hotspot once covered in prairie grassland ecosystems and now facing significant threats due to urbanization, habitat destruction, over-exploitation, biological invasions, pollution, and climate change. This study analyzes the response of Alabama’s native prairie ecosystem to climate change. We used open top chambers (OTCs) to simulate climate change-induced warming. We assessed the response of ecosystem function and structure to higher temperatures (1-3oC). Pseudococcus longispinus (Targioni-Tozzetti) (Hemiptera: Pseudococcidae) is a widely-distributed pest that feeds on many economically important hosts, particularly tropical fruits and ornamentals. The potential distribution of this mealybug pest in South Korea remains a primary concern because of its high incidence of interceptions screened during inspection. Hence, this species prompted a modelling effort to assess its potential risk of introduction. Potential risk maps were developed for this pest with a CLIMEX model based on occurrence records under environmental data. In California (CA), the wildland-urban interface (WUI) faces escalating challenges due to surging population and real estate development. This study evaluates communities along CA's WUI that have witnessed substantial population growth from 2010 to 2021, utilizing demographic data and the 2020 WUI boundaries by the University of Wisconsin-Madison SILVIS Lab. Employing the Mann-Kendall test, we analyze yearly population trends for each census tract along the CA WUI and assess their significance. Is climate change a national security issue? Human security? Ecological security? This Article addresses the growing nexus between climate change and various conceptions of security with a particular emphasis on climate change's national security impacts. This Article argues that there is a growing connection between national security and climate change and a corresponding need to address the normative implications of "climatizing national security." This project will test to see if there is a percent increase in non-perennial streams sampled from 2003-2021. Using data provided by The Cleveland Metroparks, sampling events will be separated by date, flow regime classification, and rain data. Current literature supports the claim that many perennial streams, streams that flow year-round, will become non-perennial streams over time. This shift is predicted to be caused by a change in rain patterns. Both the interval between rain events and the intensity of rainfall per event are predicted to increase. Thacker Pass in Northern Nevada is a rich desert ecosystem with spiritual significance to local Indigenous peoples, and it is also the site for what will be, for now, the United States’ largest open-pit lithium mine. Since 1995, government representatives from around the world have gathered nearly every year for the United Nations Conference of the Parties (COP) to advance work on multilateral agreements and to provide a way forward in tackling the significant challenges of climate change. The last of these conferences took place on November 6–20, 2022, in Sharm el-Sheikh, Egypt.

As the climate crisis escalates, governments—and recently even those in the wealthier countries in the Global North—are struggling to manage the impacts we are experiencing around the world in frightening abundance, including record-setting temperatures, fires, floods, and glacial and ice melt. Behind closed doors, policymakers are concerned as they contemplate the increasing likelihood, even under the most ambitious emission reduction pathways, that the world will overshoot the goal agreed upon in the Paris Agreement to limit global average temperature rise to 1.5oC beyond pre-industrial levels.

The pathway toward implementing the changes necessary in the energy sector to keep global temperature rises from breaking through catastrophic barriers is narrow and tenuous and will require a range of zero- and low-carbon technologies to be dispatched at a speed and scale that is virtually unprecedented. Animals endemic to tropical mountains are known to be especially vulnerable to climate change. The Cordillera de Talamanca (Costa Rica and Panama) is a geographically isolated mountain chain and global biodiversity hotspot, home to more than 50 endemic bird species. We used eBird community science observations to predict the distributions of a suite of 48 of these endemic birds in 2006–2015, and in 2070, under four climate change scenarios. Species distributions were predicted using program Maxent, incorporating elevation, satellite derived habitat data, and WorldClim climate variables.
