This paper provides an overview of U.S. law and policy concerning energy efficiency and conservation. The United States appears torn between two narratives - one expressing the abundant demonstrated opportunities provided by energy savings and the other based on a fear of deprivation from using less energy. Rather than choosing between the two, U.S. law and policy splits the difference - embracing efficiency and conservation more or less halfheartedly. Energy efficiency and conservation policy thus has a Groundhog Day aspect, in which the same or similar arguments are made year after year, decade after decade, and often (it appears) to …

Assessment of climate change impacts on hydrology at watershed scale incorporates (a) downscaling of global scale climatic variables into local scale hydrologic variables and (b) assessment of future hydrologic extremes. Atmosphere-Ocean Global Climate Models (AOGCM) are designed to simulate time series of future climate responses accounting for human induced green house gas emissions. We investigated how ozone pollution and climate change/variability have interactively affected net primary productivity (NPP) and net carbon exchange (NCE) across China's forest ecosystem in the past half century. Using the dynamic land ecosystem model (DLEM) in conjunction with 10-km-resolution gridded historical data sets (tropospheric O3 concentrations, climate variability/change, and other environmental factors such as land-cover/land-use change (LCLUC), increasing CO2 and nitrogen deposition), we conducted nine simulation experiments to: (1) investigate the temporo-spatial patterns of NPP and NCE in China's forest ecosystems from 1961–2005; and (2) quantify the effects of tropospheric O3 pollution alone or in combination with climate variability …

Predicting effects of climate change on species persistence often assumes that those species are responding to abiotic effects alone. However, biotic interactions between community members may affect species’ ability to respond to abiotic changes. Latent Gaussian models of resource availability using precipitation and NDVI and accounting for spatial autocorrelation and rodent group-level uncertainty in the process are developed to detect differences in seasons, groups, and the experimental removal of one group. Precipitation and NDVI have overall positive effects on rodent energy use as expected, but meaningful differences were detected. Ecological relationships of krill and whales have not been explored in the Western Antarctic Peninsula (WAP), and have only rarely been studied elsewhere in the Southern Ocean. In the austral autumn we observed an extremely high density (5.1 whales per km2) of humpback whales (Megaptera novaeangliae) feeding on a super-aggregation of Antarctic krill (Euphausia superba) in Wilhelmina Bay. The krill biomass was approximately 2 million tons, distributed over an area of 100 km2 at densities of up to 2000 individuals m−3; reports of such ‘super-aggregations’ of krill have been absent in …

Phenological events of plants and animals are sensitive to climatic processes. Migration is a life-history event exhibited by most large herbivores living in seasonal environments, and is thought to occur in response to dynamics of forage and weather. Decisions regarding when to migrate, however, may be affected by differences in life-history characteristics of individuals. Long-term and intensive study of a population of mule deer (Odocoileus hemionus) in the Sierra Nevada, California, USA, allowed us to document patterns of migration during 11 years that encompassed a wide array of environmental conditions. Much concern has been raised regarding how and to what extent climate change and intensive human activities have altered water use efficiency (WUE, amount of carbon uptake per unit of water use) in monsoon Asia. By using a process-based ecosystem model [dynamic land ecosystem model (DLEM)], we examined effects of climate change, land use/cover change, and land management practices (i.e. irrigation and nitrogen fertilization) on WUE in terrestrial ecosystems of monsoon Asia during 1948–2000. Our simulations indicated that due to climate variability/change, WUE in the entire area decreased by 3·6% during the study period, with the largest decrease of 6·8% …

Any post-Kyoto climate change treaty regime must seek to fully engage the use of carbon sinks to complement emissions reduction measures in order to comply with the treaty's mandates. The Kyoto Protocol did not include avoided deforestation as a mechanism for earning emission reduction credits. However, reducing emissions from deforestation and degradation (REDD) quickly gained popularity as a viable climate change compliance strategy in the period immediately preceding the negotiations at the Fifteenth Conference of the Parties (COP 15) in Copenhagen in 2009. Climate change will affect tidal wetlands with higher rates of sea-level rise and higher concentrations of salt in brackish and freshwater tidal systems, in addition to causing increases in atmospheric CO2 concentration, warmer temperatures, and shifts in precipitation. In the San Francisco Bay–Delta, the areas most likely to be affected—brackish and freshwater tidal wetlands—are also the sites with the majority of endemic plant species and the greater biodiversity and productivity. This increase has not been linear, as there have been periods when temperatures were stable for short periods before rising once again. This article makes the innovative and timely case for a climate change imperative: a green board. Urgency is evident, with the arrival of "a fast-emerging new burden on board members to oversee their company's posture on climate change and to begin monitoring an area that, until now, has drawn scant attention in the boardroom."21 One major impetus for the proposal advocated in this Article is that there is apparently a dearth of green boards in corporate America.22 In contrast, European and Canadian companies appear to be at the vanguard of utilizing green boards.23

Analysis of monthly coastal upwelling intensities revealed two seasonal and biologically relevant upwelling ‘modes’ in the California Current Ecosystem (CCE). The first mode reflected upwelling during the summer months and was characterized by low-frequency (multidecadal) processes, including significant (Po0.01) linear trends at some latitudes. In contrast, the second mode reflected wintertime upwelling and was defined by higher-frequency variability associated with the North Pacific High and El Niño Southern Oscillation events. Meteorological observations from 1894 through 2010 suggest that 17 historically large snow events occurred in the mountains of Colorado within Denver's water supply region. Of these 16 events, 14 can be identified in precipitation sensitive tree ring records as positive climatic pointer years. If these storms were to occur today, they would have the potential to fill reservoirs in Denver Water's supply system, even after years of sustained drought. These "drought busters" have the potential to refill Dillon Reservoir by increasing average yearly inflow up to 146% of the previous year's inflow. The global scale and unpredictable nature of climate change impacts on cultural heritage poses a challenge for conservation management. This article explores the potential of indicators as an aid for decision makers in the heritage sector. The author proposes a new indicator tool for addressing long-term stone recession impacts that may be related to climate change. The indicator is being installed at two World Heritage sites in Ireland but no results are available. The prototype was developed during doctoral research at the Technological University of Dublin.

This study addressed public perceptions and awareness about global warming in India through a survey of 851 subjects in the city of Hyderabad in the year 2007. A stratified sample of nine segments of society showed that, although people consider global warming a serious problem, they do not clearly understand its causes, impacts, and solutions. The data analyses using paired T-tests indicated differences in levels of awareness about global warming, across age and education. ANOVA and regression analysis suggested that levels of awareness among respondents varied according to their occupation. The degree of seriousness with which subjects viewed global warming …

The Kolyma River basin in northeastern Siberia, the sixth largest river basin draining to the Arctic Ocean, contains vast reserves of carbon in Pleistocene-aged permafrost soils. Permafrost degradation, as a result of climate change, may cause shifts in riverine biogeochemistry as this old source of organic matter is exposed. Satellite remote sensing offers an opportunity to complement and extrapolate field sampling of dissolved organic matter in this expansive and remote region. The goal of this study was to assess how diverse oceanographic conditions and prey communities affect the foraging behavior of little auks Alle alle. The Greenland Sea is characterized by 3 distinct water masses: (1) the East Greenland Current (EGC), which carries Arctic waters southward; (2) the Sørkapp Current (SC), which originates in the Arctic Ocean but flows north along the west coast of Spitsbergen; and (3) the West Spitsbergen Current (WSC), which carries warm Atlantic-derived water north. The Manatee River Watershed (Manatee County, FL) has experienced heavy anthropogenic development over the last 100 years and was relatively pristine previous to this development. The population growth within the watershed has surpassed the national trends and has doubled in the last 30 years. The heavy anthropogenic development has led to depletion in natural resources, nutrient loading, coastal erosion, and increased pollution. This study constructs records of sedimentological processes to compare the pre-development records to the past 100 years of anthropogenic development. This article describes and evaluates the effectiveness of the Consumer Assistance to Recycle and Save Act of 2009, also known as the “Cash for Clunkers” legislation. Under this law, Congress authorized persons trading in older and less fuel-efficient motor vehicles for newer and more fuel-efficient vehicles to receive a voucher worth up to $4,500 toward the purchase of the new vehicle. Energy Efficiency And Conservation: New Legal Tools And Opportunities, John Dernbach, Robert Mckinstry, Darin Lowder

Many new and ambitious energy efficiency and conservation laws are being enacted at all levels of government—and with greater financial incentives than provided previously. These innovations are intended to overcome or minimize market barriers such as principal-agent problems, information and transaction costs, high internal discount rates, and up-front capital needs that discourage cost-saving investments. Innovations such as public-private partnerships also require significant legal input and creativity for the client to reap the often remarkably large energy and cost savings. This article reviews a range of these tools, especially financial legal mechanisms, that could help significantly reduce U.S. energy consumption.
