This essay discusses several issues at the intersection of law and brain science. If focuses principally on ways in which an improved understanding of how evolutionary processes affect brain function and human behavior may improve law's ability to regulate behavior. It explores sample uses of such "evolutionary analysis in law" and also raises questions about how that analysis might be improved in the future. Among the discussed uses are: 1) clarifying cost-benefit analyses; 2) providing theoretical foundation and potential predictive power; 3) assessing comparative effectiveness of legal strategies; and 4) revealing deep patterns in legal architecture. Background: In dimorphic seabirds, the larger sex tends to provision more than the smaller sex. In contrast, monogamy and biparental care are often associated with equal effort between the sexes. However, the few studies that have tested sex-specific effort in monomorphic seabirds have primarily examined the details of foraging at sea. Hypotheses: Parental effort is also sex-biased in a monomorphic seabird mating system for one of two reasons: (1) If females enter the period of parental care less able to invest in care due to the cost of egg production, male-biased effort may be necessary to avoid reproductive failure. Complex life cycles (CLCs) contain larval and adult phases that are morphologically and ecologically distinct. Simple life cycles (SLCs) have evolved from CLCs repeatedly in a wide variety of lineages but the processes that may underlie the transition have rarely been identified or investigated experimentally. We examined the influence of larval growth rate on the facultative expression of alternative life cycles (metamorphosis or maturation as gill-bearing adults [= paedomorphosis]) in the salamander Ambystoma talpoideum. We manipulated growth rates by altering the amount of food individuals received throughout larval development. The expression of alternative life cycles in A. talpoideum is influenced …

Reproductive isolation and speciation in herbivorous insects may be accomplished via shifts between host-plant resources: either plant species or plant organs. The intimate association between gall-inducing insects and their host plants makes them particularly useful models in the study of speciation. North American goldenrods (Asteraceae: Solidago and Euthamia) support a rich fauna of gall-inducing insects. Although several of these insects have been the subject of studies focusing on speciation and tritrophic interactions, others remain unstudied and undescribed. Herbivorous insects often have close associations with specific host plants, and their preferences for mating and ovipositing on a specific host-plant species can reproductively isolate populations, facilitating ecological speciation. Volatile emissions from host plants can play a major role in assisting herbivores to locate their natal host plants and thus facilitate assortative mating and host-specific oviposition. 2. The present study investigated the role of host-plant volatiles in host fidelity and oviposition preference of the gall-boring, inquiline beetle, Mordellistena convicta, using Y-tube olfactometers. We used a DNA barcoding marker (mitochondrial cox1) to investigate the controversial natural occurrence of Euscorpius sicanus (C.L. Koch) in North Africa. We tested this hypothesis by comparing a sample collected from a mountain in Tunisia to disjunct populations in Sardinia, Malta, and Greece. Using these samples, and a few additional Euscorpius spp. from southern Europe as outgroups, we reconstructed the maternal phylogeny. We then used a molecular clock to place the phylogeny in a temporal context. Spatial analyses of plant-distribution patterns can provide inferences about intra- and interspecific biotic interactions. Yet, such analyses are rare for clonal plants because effective tools (i.e., molecular markers) needed to map naturally occurring clonal individuals have only become available recently. Clonal plants are unique in that a single genotype has a potential to spatially place new individuals (i.e., ramets) in response to intra- and interspecific biotic interactions. Laboratory and greenhouse studies suggest that some clonal plants can avoid intra-genet, inter-genet, and inter-specific competition via rootplacement patterns. Primate teeth adapt to the physical properties of foods in a variety of ways including changes in occlusal morphology, enamel thickness, and overall size. We conducted a comparative study of extant primates to examine whether their teeth also adapt to foods through variation in the mechanical properties of the enamel. Nanoindentation techniques were used to map profiles of elastic modulus and hardness across tooth sections from the enamel-dentin junction to the outer enamel surface in a broad sample of primates including apes, Old World monkeys, New World monkeys, and lemurs. The lack of effective tools has hampered our ability to assess the size, growth and ages of clonal plants. With Serenoa repens (saw palmetto) as a model, we introduce a novel analytical frame work that integrates DNA fingerprinting and mathematical modelling to simulate growth and estimate ages of clonal plants. We also demonstrate the application of such life-history information of clonal plants to provide insight into management plans. Serenoa is an ecologically important foundation species in many Southeastern United States ecosystems; yet, many land managers consider Serenoa a troublesome invasive plant. Conceptions of adaptation have varied in the history of genetic Darwinism depending on whether what is taken to be focal is the process of adaptation, adapted states of populations, or discrete adaptations in individual organisms. I argue that Theodosius Dobzhansky’s view of adaptation as a dynamical process contrasts with so-called “adaptationist” views of natural selection figured as “design-without-a-designer” of relatively discrete, enumerable adaptations. Correlated with these respectively process and product oriented approaches to adaptive natural selection are divergent pictures of organisms themselves as developmental wholes or as “bundles” of adaptations. While even process versions of genetical Darwinism are insufficiently sensitive …

Avian bornaviruses (ABV), identified in 2008, infect captive parrots and macaws worldwide. The natural reservoirs of these viruses are unknown. Reverse transcription-PCR (RT-PCR) was used to screen oropha- ryngeal/cloacal swab and brain samples from wild Canada geese (Branta canadensis) for ABV. Approximately 2.9% of swab samples were positive for bornavirus sequences. Fifty-two percent of brain samples from 2 urban flocks also tested positive, and brain isolates were cultured in duck embryo fibroblasts. Phylogenetic analyses placed goose isolates in an independent cluster, and more notably, important regulatory sequences present in Borna disease virus but lacking in psittacine ABVs were present in …

Skeletal elements are usually able to withstand several times their usual load before they yield, and this ratio is known as the bone’s safety factor. Limited studies on amphibians and non-avian reptiles have shown that they have much higher limb bone safety factors than birds and mammals. Salamanders are often used as representatives of the basal tetrapod body plan in functional studies, but little is known about the loads experienced by their limb bones during locomotion. Although salamanders’ slow walking speeds might lead to low locomotor forces and limb bone stresses similar to those of non-avian reptiles, their highly sprawled posture combined with relatively small limb bones could produce elevated limb bone stresses closer to those of avian and mammalian species. A central question in behavioral ecology has been why animals live in groups. Previous theories about the evolution of sociality focused on the potential benefits of decreased risk of predation, increased foraging or feeding efficiency, and mutual aid in defending resources and/or rearing offspring. This paper argues that access to mutualistic endosymbiotic microbes is an underappreciated benefit of group living and sets out to reinvigorate Troyer’s hypothesis that the need to obtain cellulolytic microbes from conspecifics influenced the evolution of social behavior in herbivores and to extend it to nonherbivores. Sexually transmitted diseases (STDs) in animals are caused by pathogens that are transmitted during copulation. Birds have played an important role in the development of STD-centered theories of mating behavior. However, it is not known whether STDs exist in wild bird populations. While the avian cloaca with its dual functions of gamete transfer and excretion seemingly predisposes birds for the evolution of STDs, the life history patterns of most birds (i.e., seasonal breeders with relatively brief annual periods of sexual activity) suggest otherwise. While storms can have obvious ecological impacts on plants, plants’ potential to respond evolutionarily to selection for increased resistance to storm damage has received little study. We took advantage of a thunderstorm with strong wind and hail to examine genetic variation for resistance to stem breakage in the herbaceous perennial Solidago altissima. The storm broke the apex of nearly 10% of 1883 marked ramets in a common-garden plot containing 26 genets of S. altissima. Plant genets varied 20-fold in resistance to breakage. Stem height was strongly correlated with resistance to breakage, with taller stems being significantly more susceptible. A stem’s …

We examined annual total digestible nutrient (TDN) production by fruits of eight species (Quercus chapmanii, Q. geminata, Q. inopina, Q. laevis, Q. myrtifolia, Carya floridana, Sabal etonia, Serenoa repens) that account for the major proportion of TDN production by fruits and seeds in Florida’s xeric upland associations (southern ridge sandhill, sand pine scrub, scrubby flatwoods). Mean annual fruit TDN of all species combined over a 27-year span in sandhill and scrub and 24 years in scrubby flatwoods was highest (45.4 kg/ha) in sandhill, intermediate in scrubby flatwoods (28.8 kg/ha), and lowest in scrub (14.2 kg/ha). Herbivores are among the most pervasive selective forces acting on plants, and the number of plant chemicals that presumably evolved for defense against herbivory is immense. In contrast, biologists are only beginning to appreciate the important roles that architectural traits can play in antiherbivore defense. One putative architectural-resistance trait is the nodding stem apex of some goldenrods (Solidago ; Asteraceae). Individuals of S. altissima genets that undergo temporary nodding in the late spring (i.e., “candy-cane ramets) have been shown to be more resistant than individuals of erect-stemmed genets to certain apex-attacking” herbivores.
