Vote Dilution And The Census Undercount: A State-By-State Remedy, Christopher M. Taylor Feb 1996

Vote Dilution And The Census Undercount: A State-By-State Remedy, Christopher M. Taylor

Michigan Law Review

This Note argues that groups seeking to correct underrepresentation caused by the differential undercount do not have standing to sue the Secretary of Commerce but that they can sue their state governments in an effort to force them to use the best population data available in the construction of congressional districts. Part I details the deeply rooted character of the differential undercount, describes statistical means that could have been employed to adjust the 1990 census, and demonstrates that the adjusted count surpasses the official census as an accurate representation of the true population. Part II examines recent litigation that has …

The Future Of Francophone Africa Without The Aid And Influence Of Its Former Colonial Power, France, Ryan Mcgovern Jan 1996

The Future Of Francophone Africa Without The Aid And Influence Of Its Former Colonial Power, France, Ryan Mcgovern

Honors Theses, 1963-2015

French colonialism dramatically changed sub-Sahara Africa in the region now called Francophone Africa. In 1960 the French granted the francophone countries independence but French influence did not end. France's neo- colonial influence caused many problems for the newly independent countries including economic dependence, unwanted boundaries and the establishment of an elite class. The Africans themselves have been struggling with mismanagement, corruption and political and economic instability. Recent breaks in Franco-African relations has caused the French to take a step back from its high level of influence in Africa. In order for francophone Africa to prosper without the aid and influence …

Damned For Using Daycare: Appellate Brief Of Jennifer Ireland In Ireland V. Smith, Julie Kunce Field Jan 1996

Damned For Using Daycare: Appellate Brief Of Jennifer Ireland In Ireland V. Smith, Julie Kunce Field

Michigan Journal of Gender & Law

At issue is custody of three-and-a-half-year-old Maranda (date of birth: April 22, 1991). The trial court found that Maranda had an established custodial environment with her mother, Jennifer Ireland, but then nominally ordered custody changed to Steven Smith. The court's order changing custody was based on a determination that day care is an inappropriate choice for care of a preschool child, and that no one effectively can be a single parent and a student at the same time. Those findings have no factual basis in the record, no legal basis under Michigan law, and no logical or even common sense …

The Denial Of A State Constitutional Right To Bail In Juvenile Proceedings: The Need For Reassessment In Washington State, Kathleen A. Baldi Jan 1996

The Denial Of A State Constitutional Right To Bail In Juvenile Proceedings: The Need For Reassessment In Washington State, Kathleen A. Baldi

Seattle University Law Review

Article I, section 20 of the Washington Constitution states that "[a]ll persons charged with crimes shall be bailable by sufficient sureties, except for capital offenses when the proof is evident, or the presumption great." Despite seemingly unequivocal language that this constitutional provision is applicable to "all persons," the Washington Supreme Court, in Estes v. Hopp, declared that juveniles do not have a constitutional right to bail. The Estes court engaged in little constitutional analysis, but instead, reasoned that juvenile proceedings are civil in nature and that article 1, section 20 applies only in criminal proceedings. Central to the Estes …

Washington State Constitutional Limitations On Gifting Of Funds To Private Enterprise: A Need For Reform, David D. Martin Jan 1996

Washington State Constitutional Limitations On Gifting Of Funds To Private Enterprise: A Need For Reform, David D. Martin

Seattle University Law Review

This Comment argues that the donative intent analysis shields government proprietary transactions from proper review by seeking only prima facie evidence of consideration. This Comment is divided into four parts. First, it traces the historical emergence of the current standard of constitutional analysis under Article VIII, sections 5 and 7. Second, the Comment discusses the court's constitutional analysis and its relation to the historical intent of the framers, and proposes a new standard of review. Third, the proposed and current standards are applied to two instances of modern public financial assistance to private enterprise: legislative financing of a thoroughbred racetrack, and …
