Product Liability Reform Proposals In Washington--A Public Policy Analysis, Howard E. Bundy Jan 1980

Product Liability Reform Proposals In Washington--A Public Policy Analysis, Howard E. Bundy

Seattle University Law Review

The current interest in statutory reform of product liability law presents a unique opportunity for the Washington Legislature to make some principled decisions in furtherance of the policies behind product liability law. The legislature, in deciding the future direction of product liability law in Washington, must look beyond polarized interests to policy considerations for guidance.

Restrictions On Electric Utility Advertising, Michigan Law Review Jan 1980

Restrictions On Electric Utility Advertising, Michigan Law Review

Michigan Law Review

This Note reconsiders the constitutionality of New York's restriction on advertising by electric utilities. Section I explains how and why the Supreme Court's current analysis of the first amendment distinguishes commercial speech from other forms of speech. Section II looks at what protection is due commercial speech and weighs the competing interests in the specific context of utility advertising. The Note concludes that states may restrict utility advertising to encourage energy conservation.

Constitutional Limits On State Regulatory And Protectionist Policies, Peter M. Gerhart Jan 1980

Constitutional Limits On State Regulatory And Protectionist Policies, Peter M. Gerhart

Faculty Publications

My theme throughout is this: Although the Supreme Court's sometimes timid review of state regulatory legislation may be explained by its continued allergic reaction to economic due process review, that timidity is often unwarranted because the Constitution does embody several principles that protect the free market from some forms of state intervention.

On Reconciling Finances And Democracy In New York City, Jerome R. Bidinger Jan 1980

On Reconciling Finances And Democracy In New York City, Jerome R. Bidinger

Fordham Urban Law Journal

This article is a book review of "The Streets Were Paved With Gold" authored by Ken Auletta. The book covers New York City's financial difficulties in the 70's and warns that the crisis still exists. While the review is generally positive, it does note the book's failure to analyze some of the deeper reasons behind the financial crisis. The article also calls for further decentralization of the political process and the establishment of new forms of citizen participation in decision making which would lead to a more viable economy.

Automatic Fuel Adjustment Clauses: Time For A Hearing, Marshall A. Leaffer Jan 1980

Automatic Fuel Adjustment Clauses: Time For A Hearing, Marshall A. Leaffer

Articles by Maurer Faculty

Through automatic fuel adjustment clauses, utilities in most states are permitted automatically to pass through to customers any increase in fuel costs, thereby circumventing a general rate hearing before a public utilities commission where the validity of any such rate increase could be publicly examined In this Article the author discusses the benefits and detriments of the automatic fuel adjustment clause, using the clause that existed in Ohio until quite recently as an example. He concludes that such a rate increase without a hearing can no longer be justified on the basis of uncontrollable fuel costs. Instead he advocates adoption …
