The modern street is not a simple roadway, but a complicated three-story structure in the use of which the general public, the city government, the abutting property owner and the licensed corporation are interested. Not often are streets so limited in capacity as the one in Frankfort, Kentucky, which was so narrow that the passage of a railroad train would have all but filled it, a condition which led the court to enjoin the construction of a track, though duly authorized. Rep. 457, the court holds (Siebecker and Timlin, JJ., dissenting) that one, having conveyed real property subject to a condition subsequent, has no right of action to recover possession on breach of the condition until he has taken "advantage of condition broken and so notified the defendant, either by demand of possession or some other act equivalent to a re-entry for condition broken."

In considering this question two primary considerations are presented at the outset, (I) what is meant by a quitclaim deed, and (2) what constitutes a bona fide purchaser. The quitclaim, as used in the law of conveyancing in the United States, is ordinarily treated as analogous to the old English deed of release, but the latter could operate only when the vendee was already the owner of an estate in the land, while the former is recognized as an original conveyance.
