Property, E. F. Roberts Jan 1981

Property, E. F. Roberts

In the past, property exemplified law as an ordered set of rules, each axiom fitting nicely into an almost immovable intellectual mosaic of immense size. This obsolete rule grid still serves a purpose. It has been pressed into service as a vehicle to test aspirants for admission to the bar, now that even the bar examiners in this Republic have succumbed to using multiple choice questions susceptible to machine scoring. The irony is that this bar examination law does not mirror the real law, the common-law model having been destroyed by the entropy that typifies this fragile society. Order has …

Alternative Models Of Ante-Mortem Probate And Procedural Due Process Limitations On Succession, Gregory S. Alexander, Albert M. Pearson Nov 1979

Alternative Models Of Ante-Mortem Probate And Procedural Due Process Limitations On Succession, Gregory S. Alexander, Albert M. Pearson

Cornell Law Faculty Publications

Ante-mortem probate stands as a significant recent development in the American law of wealth succession. It confronts a problem that seriously impairs our probate system, the depredatious will contest, and promises to help revitalize the probate process. Already enacted in several states and currently under active study by the Joint Editorial Board of the Uniform Probate Code and the National Conference of Commissioners on Uniform State Laws, ante-mortem probate is likely to be widely implemented in some form. But while legislators and academics alike support ante-mortem probate as a general idea, disagreement has emerged over the specific form it should …

The Conservatorship Model: A Modification, Gregory S. Alexander Nov 1978

The Conservatorship Model: A Modification, Gregory S. Alexander

Cornell Law Faculty Publications

Reform-minded probate lawyers have discussed the idea of ante-mortem probate for many years. Yet, owing to several seemingly unavoidable defects, it has never attracted widespread support and only recently has been implemented anywhere in the United States. In his article, Living Probate: The Conservatorship Model, Professor John Langbein has eliminated many of those defects and has made the idea much more feasible. In doing so, he has contributed to the development of simple, convenient, and efficient systems of probate. However, his proposal introduces new flaws that threaten the practical working of his procedural model.

Basically, Langbein proposes that living …

Blackstone warned us that the law of real property was “a fine artificial system, full of unseen connexions and nice dependencies; and he that breaks one link of the chain endangers dissolution of the whole.” Ours is an age during which entropy appears to have beset the entire society. Reflecting as it does the socioeconomic realities of the society, the system of real property law has not escaped the general drift, and it evidences marked symptoms of dissolution.

A survey can either restate the obvious or attempt to add a critical dimension to the law’s uncertain progress. The obvious can be gleaned merely by scanning the orange-covered paperback indices which go with the official advance sheets and in which cases are condensed in the best headnote hunter’s style. This exercise presupposes a reader possessed of an interest in something more than the obvious, and one who enjoys a critique of a few key cases, precisely for the challenge of making an independent judgment of whether New York property law has progressed during the past Survey year.

A Survey can be a wine list inventorying the entire stock in the house or a selective list of vintages worth spending some time to savour. The reader will be able in a thrice to make his or her own judgment about the policy of this house.

The author points up the decline of caveat emptor as a viable doctrine governing the sale of new homes and analyzes the emergence of implied warranty as a remedy for both structural deficiencies and personal injuries. He argues that the concept of implied warranty tends to obfuscate real distinctions between the builder-vendor’s responsibility for the material integrity of a new home and for personal injuries occasioned by defects therein, concluding that legislation is needed to reestablish a system of order in the law.
