Law Reform In Canada: The Impact Of The Provincial Law Reform Agencies On Uniformity, Thomas W. Mapp

Dalhousie Law Journal

It is now generally acknowledged that during the course of the last decade the provincial law reform agencies' have emerged as a dominant force in the law reform movement in Canada. The author believes that an analysis of the reports published by these agencies, and the provincial legislation enacted in response to them discloses, however, that to a large extent the imporovements in provincial law that have been gained have come at the expense of uniformity of law among the provinces. The importance of the federal electoral process has traditionally been viewed by Congress as creating the need for heavy regulation to insure its strength and vitality. However, the contribution limitations provisions of the Federal Election Campaign Act of 1971 (FECA) has a detrimental effect to the individual voter, forcing candidates to overlook individual citizens in favor of organizations with large fundraising capabilities. FECA was initially enacted to compel candidates to appeal to more individual voters, mainly by limiting contributions from either individual citizens or corporations. Yet, the Act also permits a corporation or labor organization to create a separate segregated …

The Law School was established as a department of Richmond College in 1870. In 1890 the family of the late T. C . Williams, who had been a devoted and valued Trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to The T. C . Williams School of Law. At various times the School has received further generous gifts from members of the family of Mr. Williams. A substantial gift came through a bequest from Mr. T. C. A committee of experts within the Council of Europe is currently making preparations for a European convention on the protection of laboratory animals. The committee has been designated as the Comite Ad Hoc pour Ia Protection des Animaux (CAHPA). The Council of Europe, the sponsoring organization, is an institution whose chief goal is the peaceful cooperation of most European countries concerning cultural, economic, and social affairs; expressly excluded are matters of military concern. The term jurisdiction may be defined as the authority to affect legal interests -- to prescribe rules of law (legislative jurisdiction), to adjudicate legal questions (judicial jurisdiction) and to enforce judgments the judiciary made (enforcement jurisdiction). The definition, nature and scope of jurisdiction vary depending on the context in which it is to be applied. United States domestic law, for example, defines and applies notions of jurisdiction pursuant to the United States constitutional provisions relating to the separation of powers. Within the United States, jurisdiction is defined and applied in a variegated fashion depending on whether a legal problem is …

Mason Ladd's life in the law of evidence will never be stilled. The contributions are too thoughtful, too productive, too filled with impact for that ever to happen. In the galaxy of great figures that includes Wigmore, Clearly, Morgan, Maguire, Weinstein, McCormick, Louisell, and others, Dean Ladd's star shone brightly. The mix of insight, humor, and good will that he brought to teaching and scholarly writing is unmatched. Journal Articles

Vietnamese refugees face a series of hurdles in entering the United States. Questions of fear of persecution, time of persecution and illegal departure face the refugees generally. Those leaving Vietnam for economic reasons and those displaced within Vietnam face additional difficulties. However, careful application of United States immigration law should accommodate the Vietnamese refugees as well as the policies behind the laws.
