Reimagining Legal Education: The Transformative Power Of Small-Group Instruction, Michael I. Meyerson

Legal education is failing its students. Those entering their first year of law school have greater anxiety and less developed reading and writing skills than ever before. The traditional large Socratic class, which was never the most effective teaching method, has become increasingly counterproductive.

This Article contends that small-group instruction provides the opportunity for superior teaching, especially for first-year law students. Recent scholarship in active learning, educational psychology, and students’ mental health demonstrates the limitations of the traditional large Socratic class experience. There has been a big push to revamp legal education. Many have argued that after years of doing things the same way, it is time to change. While there is validity for the need for reform, educators should embrace the one thing legal education has gotten right: anonymous or blind grading. This Essay makes the case that blind grading should not only remain in legal education, but every law school course should adopt it, including writing and clinical courses. In 2021, more than 90% of law students took out a loan to enable them to pay their costs, and the typical law school graduate owed $165,000 in loans. The crucial point of this report, however, is that significant proportions of law school graduates are destined to be disappointed if they pursue a career in law believing they will earn lots of money. In 2020, toward the end of the spring semester, the COVID-19 pandemic disrupted life across the globe. Institutions, including law schools, felt the widespread effects of this public health crisis. Law schools were forced to move entire curriculums online in record time and consider how they were going to administer final exams. There is no precedent or manual for how to do this successfully.
