Suspension And Delegation, Amy Coney Barrett Jan 2014

Suspension And Delegation, Amy Coney Barrett

Journal Articles

A suspension of the writ of habeas corpus empowers the President to indefinitely detain those suspected of endangering the public safety. In other words, it works a temporary suspension of civil liberties. Given the gravity of this power, the Suspension Clause narrowly limits the circumstances in which it may be exercised: the writ may be suspended only in cases of "rebellion or invasion" and when "the public Safety may require it. " Congress alone can suspend the writ; the Executive cannot declare himself authorized to detain in violation of civil rights. Despite the traditional emphasis on the importance of exclusive …

Code Is Law, But Law Is Increasingly Determining The Ethics Of Code: A Comment, Jonathon Penney Jan 2014

Code Is Law, But Law Is Increasingly Determining The Ethics Of Code: A Comment, Jonathon Penney

Articles, Book Chapters, & Popular Press

“Code is Law”, the aphorism Larry Lessig popularized, spoke to the importance of computer code as a central regulating force in the Internet age. That remains true, but today, overreaching laws are also increasingly subjugating important social and ethics questions raised by code to the domain of law. Those laws — like the CFAA and DMCA — need to be curtailed or their zealous enforcement reigned; they deter not only legitimate research but also important related social and ethics questions. But researchers must act too: to re-assert control over the social, legal, and ethical direction of their fields. Otherwise, law …

Valuing Foreign Lives, Arden Rowell, Lesley Wexler Jan 2014

Valuing Foreign Lives, Arden Rowell, Lesley Wexler

Georgia Law Review

Should government actors allocate scarce domestic resources to protect the lives of foreign persons? This Article argues that foreign life valuation poses distinctive psychological, philosophical, social, political, and economic challenges, and analyzes current U.S. practices of foreign life valuation in light of these challenges. After identifying multiple possible methods of foreign life valuation, we suggest that the best default valuation method would allocate domestic resources according to domestic willingness to pay to protect foreign lives.

Collaboration: Promises And Pitfalls, Dana M. Malkus Jan 2014

Collaboration: Promises And Pitfalls, Dana M. Malkus

All Faculty Scholarship

Simply put, collaboration refers to two or more organizations coming together to accomplish a specific goal. It is helpful to think of collaboration as a spectrum: Collaborations range from informal arrangements (e.g., a committee, a task force, a joint initiative, information sharing, joint purchasing arrangements, co-locating arrangements, or program coordination) to more formal arrangements (e.g., the creation of a new entity).

Common reasons for collaborations include

  • greater access to certain funding or grant streams;
  • access to the expertise of the collaborating organization;
  • an ability to increase the human resources that can be devoted to an event or cause;
  • access to …

Preserving Baseball's Integrity Through Proper Drug Testing: Time For The Major League Baseball Players Association To Let Go Of Its Collective Bargaining Reins, Wolfgang S. Weber Jan 2014

Preserving Baseball's Integrity Through Proper Drug Testing: Time For The Major League Baseball Players Association To Let Go Of Its Collective Bargaining Reins, Wolfgang S. Weber

University of Colorado Law Review

For the first time in seventeen years, voters did not select a single baseball player to be inducted into the 2013 Baseball Hall of Fame. In response to this news, Hall of Famer Mike Schmidt regrettably stated, "[E]veryone was guilty. Either you used Performance Enhancing Drugs or you did nothing to stop their use. . . . This generation got rich. Seems there was a price to pay." In 2013 alone, Major League Baseball (MLB) issued fourteen suspensions for Performance Enhancing Drug (PED) abuse. The regularity of these suspensions reveals players' willingness to continuously attempt to exploit flaws in the …

Sunshine, Stakeholders, And Executive Pay: A Regression-Discontinuity Approach, Brian D. Galle, David I. Walker Dec 2013

Sunshine, Stakeholders, And Executive Pay: A Regression-Discontinuity Approach, Brian D. Galle, David I. Walker

Faculty Scholarship

We evaluate the effect of highly salient disclosure of private college and university president compensation on subsequent donations using a quasi-experimental research design. Using a differences-in-discontinuities approach to compare institutions that are highlighted in the Chronicle of Higher Education’s annual "top 10" list of most highly-compensated presidents against similar others, we find that appearing on a top 10 list is associated with reduced average donations of approximately 4.5 million dollars in the first full fiscal year following disclosure, despite greater fundraising efforts at "top 10" schools. We also find some evidence that top 10 appearances slow the growth of compensation, …

Minor edits. “The goal of this Toolkit is to provide jails of all sizes, political divisions, and geographic locations with a step-by-step guide for preventing, detecting, and eliminating sexual abuse of inmates in their custody – and for responding effectively to abuse when it occurs. Prison rape includes all forms of inmate sexual abuse within a correctional facility, including state and federal prisons, county and municipal jails, police lock-ups, holding facilities, inmate transportation vehicles, juvenile detention facilities, and community corrections facilities. Protecting arrestees, detainees, and inmates from sexual violence is part of a jail’s core mission. This toolkit will help …
