When States' Legislation And Constitutions Collide With Angry Locals: Shale Oil And Gas Development And Its Many Masters, Heidi Gorovitz Robertson
Law Faculty Articles and Essays
This Article explores the nationally common problem of tension and conflict among state oil and gas statutes, constitutional home rule, and local control by considering intersections and tensions among the Ohio Constitution’s home rule authority, the Ohio oil and gas law’s preemption provision, and the many regulatory efforts of Ohio’s local governments. It explores the scope of the Ohio Constitution’s home rule authority, in part, by evaluating courts’ statements on the validity of several types of local ordinances, as they confront home rule and a legislative attempt at preemption. Types of local ordinances evaluated include those that prohibit or ban …

Commerce Clause; Privileges And Immunities Clause; State Hiring; Discrimination Against Nonresidents; Hicklin V. Orbeck, Donna N. Kemp
Akron Law Review
"In Hicklin v. Orbeck, the United States Supreme Court unanimously held' that Alaska's statute entitled "Local Hire Under State Leases"' violates the Constitution due to its discriminatory effect on nonresidents. Basing its decision on the Privileges and Immunities Clause,' the Court found that there was insufficient justification for the extensive discrimination against nonresidents required by the Act because the unemployment problem to be alleviated by the legislation was not due to a great influx of nonresident jobseekers. Rather, the Court attributed the problem to the fact that a large percentage of the unemployed in Alaska lack sufficient education and job …

Managing Fractions: The Role Of Local Government In Regulating Unconventional Natural Gas Resources - Recommendations For New York, William Yukstas
Managing Fractions: The Role Of Local Government In Regulating Unconventional Natural Gas Resources - Recommendations For New York, William Yukstas
Cardozo Public Law, Policy & Ethics Journal
The note examines the regulatory challenges surrounding unconventional natural gas extraction, particularly hydraulic fracturing, focusing on the conflict between state and local authority. It argues that local governments should retain zoning power to regulate or ban drilling, as they bear the primary costs and have the capacity to address localized impacts. The analysis highlights the contrasting approaches of Pennsylvania and New York, with Pennsylvania initially attempting to preempt local zoning laws through Act 13, which was later deemed unconstitutional, while New York maintains a de facto moratorium and considers stricter regulations. The author advocates for empowering localities to negotiate Community …
Commonwealth Edison Co. V. State Of Montana: Constitutional Limitations On State Energy Resource Taxation, Nancy K. Stalcup
Commonwealth Edison Co. V. State Of Montana: Constitutional Limitations On State Energy Resource Taxation, Nancy K. Stalcup
Pepperdine Law Review
This note examines the case of Commonwealth Edison Co. v. State of Montana, where the United States Supreme Court analyzed and defined the permissible limitations of state energy resource taxation. While the Court adhered to the test of constitutional taxation established in Complete Auto Transit Inc. v. Brady, which strongly upheld a state's sovereign right to tax a local incident of interstate commerce, the Court failed to realize the practical ramifications of its ruling in the context o the nation's energy problems.
