Under provisions of the Federal Coal Mine Safety Act a coal mine is classified as gassy within the meaning of the act, and certain precautionary measures are thereby required, when the U. S. Bureau of Mines finds that the mine atmosphere fails to meet tests set forth in the act or when the mine is found to be a "gassy or gaseous mine pursuant to and in accordance with the laws of the State in which it is located." By its sweeping decision invalidating the Bituminous Coal Conservation Act of 1935, the Supreme Court precluded any future use of the commerce clause by Congress as a basis for federal regulation of labor conditions in local industry, whether on the theory that production is interstate commerce or that labor conditions directly affect interstate commerce.

The distribution of our natural resources creating among our several states an economic inter-dependence of varied degrees, and the growing appreciation of the danger of approaching exhaustion in various fields, has very naturally prompted the legislatures of some of the states to enact statutes which have been broadly designated as "conservation acts," though some of them could be described more accurately as "domestic preference acts".
