Realizing An Opportunity: Limiting The Power Of The Executive In The Iraqi Constitution, Cory Kopitzke

In the summer of 2015, Iraqi citizens took to the streets in protest. After going without essential services, such as electricity, in the sweltering heat and after enduring corruption that undermined Iraqi forces battling the Islamic State, these citizens called for meaningful changes in the management of the Iraqi government and for the fulfillment of “democratic aspirations” enshrined in the Iraqi Constitution. In response to these protests, Iraqi Prime Minister, Haider al-Abadi, proposed sweeping reform measures to combat the decisive divides in the current administration. These reforms called for drastic change—including the elimination of the vice-president and deputy prime minister …

Observing Chinese foreign policy means looking through a clouded lens. A foggy image can be made out, yet specific details are left undefined. The Chinese reaction to the 1990s First Gulf War is a case in point. The perspective is opaque, yet we can still gather an understanding of important changes in China’s policies. The author provides insights not only into China’s foreign and military policy but also on Chinese-Arab relations. In analyzing China’s reaction to the war, we can see it was indeed a transformative period for China’s strategy in the Arab world. China reacted to the Gulf War …

Foreign Terrorist Fighters In Syria: Challenges Of The “Sending” State, Marten Zwanenburg
International Law Studies
This article discusses domestic measures taken by the Netherlands to combat the phenomenon of foreign terrorist fighters, predominantly in the context of the Syrian conflict. It discusses criminal prosecution, asset freezes, deprivation of nationality and revocation of travel documents. The author concludes that in each of these fields, there is a close relationship between international law and national law.

Internal Displacement In Iraq: Internally Displaced Persons And Disputed Territory, Nancy Riordan

The protracted conflict in Iraq has led to one of the highest internal displacements of people worldwide. With data from the International Organization for Migration’s Displacement Tracking Matrix and other sources, geographic information system methods were applied to investigate the quantitative and spatial characteristics of Iraq’s internally displaced persons (IDPs). Based on this analysis, significant numbers of IDPs were found to be displaced among the disputed territories of northern Iraq. The findings of this analysis, when paired with additional research, poses serious complications not only for the security of Iraq’s IDPs but also for the country. The proliferation of militias …

Protecting Cultural Property In Non-International Armed Conflicts: Syria And Iraq, Louise Arimatsu, Mohbuba Choudhury

The deliberate destruction by ISIS of religious and cultural property in both Syria and Iraq sparked widespread international condemnation and was described by UNESCO’s Director-General as constituting war crimes. Regrettably, the damage to and destruction of such property has become an all too common feature of the conflicts that have engulfed both States. The authors examine the legal obligations that apply to the parties in non-international armed conflict and the consequences of non-compliance. In light of the scale of the human suffering engendered by the conflicts, the authors first ask why international law protects such property in armed conflict.

A Theorization On Equity: Tracing Causal Responsibility For Missing Iraqi Antiquities And Piercing Official Immunity, Robert Bejesky

Three weeks after the U.S.-led attack on Iraq, looters descended on the artifacts in the Iraq National Museum. Over ten thousand pieces were assumed destroyed or stolen, and the Coalition Provisional Authority estimated the losses at $12 billion. The gravity of the privation led the Security Council to include language in Resolution 1483 to restrict countries from trading in Iraq’s pillaged antiquities, and the U.S. Congress passed the Emergency Protection of Iraqi Cultural Antiquities Act of 2004 to enforce the measures. With the ascendance of the terrorist group known as the Islamic State of Iraq and Syria (ISIS), the international community has struggled to adapt to the new international security context. Among the challenges that are currently being confronted are questions relating to how states may effectively facilitate international cooperation to counter ISIS (especially among countries in the Middle East and North Africa). Within this context, guidance from the United Nations on international cooperation posits that “[t]he universal counter-terrorism conventions and protocols do not apply in situations of armed conflict” – a legal position that would serve to stymie important cooperative …

On Shaky Grounds: Reasons Behind The Failure To Adhere To The "Powell Doctrine" In The 2003 Iraq Invasion, Sasha Anderson

Why did we go to war with Iraq and what are we still doing there? This question is one of our most pressing foreign policy issues and continues to be hotly debated by politicians, journalists and citizens. The invasion of Iraq in 2003 was executed in a strikingly different fashion than the strategy used in an earlier conflict with Iraq, the Persian Gulf War of 1990-1991. Rather than follow a strategy consisting of clear goals, overwhelming force and a predetermined exit strategy, the US military blundered into Iraq in 2003 without a way to measure victory and without a plan …
