Performance Risk, Form Contracts And Ucita, Leo L. Clarke
Performance Risk, Form Contracts And Ucita, Leo L. Clarke
Michigan Telecommunications & Technology Law Review
No scholarly commentator has suggested that the form contract rules provide a satisfactory answer to the commercial problem of performance risk. So, one might think that the dawn of the "information economy" would be a propitious time to implement a new doctrinal approach. Apparently not: the National Conference of Commissioners on Uniform State Laws (the "Conference") has promulgated a comprehensive commercial statute that fails to remedy or even modify the law of form contracts in purely commercial transactions. The Uniform Computer Information Transactions Act ("UCITA")--drafted to provide the background law for many of the most significant transactions in the information …

Are Contemporary Community Standards No Longer Contemporary, Roman A. Kostenko
Are Contemporary Community Standards No Longer Contemporary, Roman A. Kostenko
Cleveland State Law Review
This note concurs with the decision reached by the Third Circuit. The federal obscenity law, which incorporated the contemporary community standards test is unconstitutional as applied to expression on the internet because it has chilling effect on the exercise of freedom of speech as guaranteed by the First Amendment to the Constitution of the United States. Because freedom of speech would be restrained by any incorporation of community standards in federal regulation of the internet, the legislature should refrain from adopting a standard that would apply in all internet situations. Rather, with respect to obscenity, the internet should be left …
The Constitutional Legitimacy Of The Civil Provisions Of The Federal Wiretap Act - A Suggestion To The Supreme Court In The Case Of Bartnicki V. Vopper, Jess Gamiere
Cleveland State Law Review
Title III of the Federal Wiretap Act, as amended, remains the "primary law guarding the privacy of personal communication [among private citizens] in the United States." This piece of legislation will serve as the focal point of this Note. This Note will first discuss the history and context of the statute under which two cases have arisen. It will then survey various Supreme Court cases addressing the tension between the First Amendment and the right to privacy so as to provide the reader with a better understanding of the conflict between these two constitutional rights. Then it will outline and …
A New Approach To Statutory Interpretation In Washington, Philip A. Talmadge
A New Approach To Statutory Interpretation In Washington, Philip A. Talmadge
Seattle University Law Review
In this article, I will first explore Washington's existing law, both statutory and judicial, on statutory interpretation. I will then evaluate the mechanisms for construing statutes derived from common law and legislative sources. Finally, I will recommend a new paradigm for statutory construction so that legislative intent may be more accurately conveyed to the courts, abandoning many of the time-encrusted canons in favor of principles of interpretation adhering more specifically to the legislature's actual statutory language.
The Uniform State Law Process: Will The Uma And Ruaa Be Adopted By The States?, James J. Brudney
The Uniform State Law Process: Will The Uma And Ruaa Be Adopted By The States?, James J. Brudney
Faculty Scholarship
Most practicing attorneys and legal academics first become aware of uniform statutes when studying the Uniform Commercial Code (UCC) in law school. Yet the UCC's widespread acceptance and periodic renewal are not the legacy that generally attends uniform law ventures This overview of the uniform statutory process offers some perspective for proponents of the recently approved Uniform Mediation Act (UMA) and Revised Uniform Arbitration Act (RUAA) as they attempt to secure enactment in multiple state legislatures.

Government Liability When Cyclists Hit The Road: Same Roads, Same Rights, Different Rules, Emily Hammond
Government Liability When Cyclists Hit The Road: Same Roads, Same Rights, Different Rules, Emily Hammond
Georgia Law Review
Most jurisdictions recognize that negligent construction and maintenance of streets exposes government entities to liability. Thus, motorists, pedestrians, and motorcyclists who are injured due to road defects are usually not barred from bringing suit. Yet when the courts grapple with similar injuries to bicyclists, the results are best described as a tangled wreck. Modern cycling jurisprudence sends unwary riders careening through inconsistent judicial opinions, questionable statutory interpretations, and unsettled policies. This Note examines the legal treatment of cases in which cyclists are injured by road hazards, covering sovereign immunity, the public duty doctrine, nuisance, tort immunity acts, vehicle codes, and …
The Tension Between The Need And Exploitation Of Migrant Workers: Using Msawpa's Legislative Intent To Find A Balanced Remedy, Mark J. Russo
The Tension Between The Need And Exploitation Of Migrant Workers: Using Msawpa's Legislative Intent To Find A Balanced Remedy, Mark J. Russo
Michigan Journal of Race and Law
This Comment concludes that the recent Maine federal district cases represent an irreconcilable spike in a national and international trend to afford more protection to a vulnerable class whose resources are the object of urgent demand. However, the search for a proper remedial weight in the balance between migrant worker protection and the provision of competitive farm labor is not a new problem.
