Ethics Accountability: The Next Era For Lawyers And Judges, Renee Knake Jefferson
Ethics Accountability: The Next Era For Lawyers And Judges, Renee Knake Jefferson
Cardozo Law Review
Five decades ago, United States Supreme Court Chief Justice Earl Warren delivered remarks that sound like they were written in the early 2020s: [O]ur profession has recently suffered greatly because a score of lawyers has been convicted or indicted for felonious conduct in the performance of their official duties in the highest reaches of our national government. . . . Their alleged criminal offenses pertain to serious violations of our system of justice and to the performance of basic functions of government. The inner sanctum of the White House has been tarnished, and the end of the debacle is not …

t was a banner year for the Law School’s moot court competitors, as one team brought home a championship trophy, multiple teams made deep runs in national tournaments, and several students earned impressive individual honors.
“For our external competitions against other schools, we had to have tryouts this year because we had a record number of applicants,” said Professor Lane McFadden, who teaches Legal Writing and Research and Appellate Advocacy and supervises the Law School’s appellate moot court programs. “The rising 2Ls are now excited because the students who are only a year or two ahead of them have done …

Increasingly, jurisdictions around the world are exploring and implementing proactive, management-based regulation (PMBR) as an alternative to traditional regulatory approaches that discipline attorneys after misconduct occurs. This essay examines the proof and potential of PMBR to empower lawyers and enhance public protection, while transforming the relationship between regulators and practicing lawyers. The essay is based on the Distinguished Lecture the author delivered at the Joseph G. Miller and William C. Becker Center for Professional Responsibility at the University of Akron School of Law.

This thesis analyzes the legal provisions governing the mandatory existence of a document of consent from the spouses, made underhand before the signing of the deed of establishment of Commanditaire Vennootschap (hereinafter "CV"), and the legal consequences if the deed of establishment of CV is signed without the consent of the spouses. This research method uses a doctrinal approach through a literature study and is analyzed qualitatively. Article 36 paragraph (1) stipulates that "everything related to joint property that will be carried out legal action against it requires the consent of both parties." The legal agreements undertaken by a CV …

The research was compiled using doctrinal research methods. The implementation of nominee practices in an authentic deed is made by making a series of agreements whose contents indirectly transfer ownership from the nominee whose name is listed on the certificate of ownership, to the beneficiary, which in this case …

As land plays an important role in everyday life, it is necessary to pay attention to rights and protection regarding its implementation. The Basic Agrarian Law itself has derivatives, one of which discusses Land Redistribution as regulated in Presidential Regulation Number 88 of 2017 concerning Settlement of Land Tenure in Forest Areas. However, after the ratification of Presidential Regulation Number 62 of 2023 concerning the Acceleration of Implementation of Agrarian Reform, Presidential Regulation Number 88 of 2017 and Presidential Regulation Number 86 of 2018 concerning Agrarian Reform are revoked and replaced with Presidential Regulation Number 62 of 2023 concerning Accelerating …

Unfulfilled payment of shares are on of the problems that might arise when a limited company’s shares are transferred through a transaction that are not carried according to the shares transfer procedure in UUPT. The issues raised in this thesis pertain to the legal construction contained in the act of sale of shares that can protect the seller's interests in the event that the buyer fails to make payment and the notary's liability in the event that the buyer fails to make payment in the sale of shares, through the discussion of the case in Decision Number 105/PDT.G/2021/PN JKT.SEL. The Rural Rescue: Tackling Arkansas’S Legal Deserts Through Proven Statutory Reform, Kathryn Totty
Arkansas Law Review
In some rural counties of Arkansas, a single attorney is responsible for serving thousands of residents, depriving many Arkansans of even basic legal representation. Imagine facing eviction, fighting for custody of your child, contesting a divorce, or navigating the complexities of probate with no attorney for miles. This stark reality exemplifies the growing “legal deserts” problem facing rural Arkansas, where access to justice has become a luxury rather than a right. To combat the growing shortage of legal professionals in rural areas, states seek new solutions—some proving more successful than others. Several states have implemented rural attorney incentive programs, typically …
Licensure As Pathway, Not Barrier, Brian Gallini
Licensure As Pathway, Not Barrier, Brian Gallini
Arkansas Law Review
The legal profession knows it has an access to justice crisis. One side lacks a lawyer in approximately three-quarters of the twenty million civil cases filed across state courts every year. Against that concerning backdrop is how we license attorneys. The most common method is the written bar exam. But that exam bears little resemblance to the practice of law, produces racially disparate results, and is shockingly expensive for law graduates to prepare for and take. Its opaque scoring practices alongside its rare administration—offered just twice per year—strengthens the idea that the modern bar exam operates more as a barrier …

Multiple heightening crises reveal the deficiencies and contradictions of legal education, in particular the values it imparts. Perpetuating myths about U.S. democracy and rule of law, the enduring formalist, liberal legalist cast of law school is increasingly at odds with students’ lived experiences. As liberal democracy and the rule of law falter, no longer is relying on the “hidden curriculum” or the historically nebulous and mythical narratives of the law and our legal system sufficient to prepare tomorrow’s lawyers for the challenges faced by our profession. Instead, with a boost from ABA Standard 303, this article draws on the tradition …

Competition In The Global Law Market: Offshore Development Of The Statutory "Rule In Hastings-Bass", Andrew P. Morriss

This Article examines the competitive dynamics in the global law market through the lens of the statutory evolution of the Rule in Hastings-Bass across various International Financial Centers (IFCs). Following the UK Supreme Court's 2013 decision in Pitt v Holt and Futter v Futter, which significantly restricted the judiciary's ability to void trustee decisions under the Rule, seven IFCs (Jersey, Bermuda, The Bahamas, the Dubai International Financial Center, the Cayman Islands, and the British Virgin Islands) enacted statutes to preserve and clarify the Rule within their jurisdictions. These legislative actions highlight the strategic adaptations by IFCs to enhance their legal …

Curative Identity Formation Themes To Counteract Law School’S Hidden Curriculum, Aric K. Short

Especially given the sensitive and malleable life stage that many of our students are in, law schools should take meaningful steps to blunt and counteract the negative effects of the hidden curriculum, including in ways suggested in other articles in this symposium. One direct way to present countervailing messaging is through a required 1L course on professional identity formation (PIF). As described in this article, there are a number of benefits of explicitly addressing PIF topics early in law school, and doing so not only more effectively prepares our students to become practicing attorneys, it also responds directly to some …

In this Essay, we explore the possibilities for putting AI technology in the hands of clients themselves, considering the advantages and disadvantages. Thinking about the specific context of immigration law, we could envision apps that help individuals to prepare for interviews for affirmative asylum, visas, or naturalization; to educate them about their rights in ways that are more specific, timely, and convenient than current know-your-rights formats; or, in a more attorney-adjacent interaction, using an app to conduct the initial intake interview and organize that information, making the usual time-consuming intake process more efficient and effective. We are not envisioning apps …

The Pressure Points Of Professional Identity For Judges In The Modern Era, Charles G. Geyh
The Pressure Points Of Professional Identity For Judges In The Modern Era, Charles G. Geyh
Articles by Maurer Faculty
The duties core to the professional identity of a judge are encapsulated in an ethical directive at the literal forefront of the Model Code of Judicial Conduct, some variation of which all state and federal judiciaries have adopted. Rule 1.2 provides that “[a] judge shall act at all times in a manner that promotes public confidence in the independence, integrity, and impartiality of the judiciary[.]” This directive implicates three challenges, or pressure points, relevant to a judge’s identity: 1) insofar as judges begin their legal careers as practicing lawyers, when they ascend the bench their professional identities must transition from …
