The COVID-19 pandemic has exposed preexisting weaknesses in many areas of life and the law. In April 2021, the ABA published a study entitled Practicing Law in the Pandemic and Moving Forward: Results and Best Practices From a Nationwide Survey of The Legal Profession. The results of this study confirmed what many women and people of color already knew – standard approaches to the workplace do not serve goals of diversity and inclusion, especially during times of great stress and financial uncertainty.

In this study, we examine the extent to which academic and student engagement factors explain law school grades and first-time bar exam performance. Applying fixed effects linear and logit modeling, our analysis leverages law student transcript data and responses to the Law School Survey of Student Engagement (LSSSE) among students from a diverse group of 20 law schools to estimate academic performance and odds of bar passage. Most notably, we find that GPA improvement during law school is associated with greater odds of passing the bar exam, particularly among students who struggle the most during the first semester. Membership on the Texas Law Review created opportunities for me, taught me a lot about editorial processes, and served as a reminder that I was a law outsider. The last of these is the focus for this essay, not because it is the most important or because it stands alone (it doesn’t), but because I believe there are other rooms in which to reminisce fondly about law review. Here, I want to speak more honestly about my experience because that experience, as an outsider, has influenced me most as a scholar, teacher, and advocate.

Protecting Sentient Artificial Intelligence: A Survey Of Lay Intuitions On Standing, Personhood, And General Legal Protection, Eric H. Martinez, Christoph Winter

To what extent, if any, should the law protect sentient artificial intelligence (that is, AI that can feel pleasure or pain)? Here we surveyed United States adults (n = 1,061) on their views regarding granting 1) general legal protection, 2) legal personhood, and 3) standing to bring forth a lawsuit, with respect to sentient AI and eight other groups: humans in the jurisdiction, humans outside the jurisdiction, corporations, unions, non-human animals, the environment, humans living in the near future, and humans living in the far future. This article explores the role that a generalist externship seminar can play in teaching law students about the legal profession - lawyers, the institutions in which they practice, and the markets for their services. After reviewing the evolution of the externship course and externship seminar in the legal curriculum, the article turns to a discussion of the absence of opportunities at most law schools for students to study and learn about the legal profession. It contends that the absence of serious attention to the profession in the curricula of most law schools does a disservice to law students, who need …

This Article examines the issue of menstruation and the administration of the bar exam. Although such problems are not new, over the summer and fall of 2020, test takers and commentators took to social media to critique state board of law examiners’ (“BOLE”) policies regarding menstruation. These problems persist. Menstruators worry that if they unexpectedly bleed during the exam, they may not have access to appropriately sized and constructed menstrual products or may be prohibited from accessing the bathroom. Personal products that are permitted often must be carried in a clear, plastic bag. Some express privacy concerns that the see-through …
