Among the inherent powers of the Maine Supreme Judicial Court is the power to regulate the officers of its courts. As the court explained in Board of Overseers of the Bar v. In the past two decades, the gender composition of the legal profession in the United States has changed dramatically. While women comprised less than five percent of the nation's lawyers in 1970, the proportion of women lawyers had increased to more than 19% by the end of 1988, and roughly 40% of new lawyers each year are now women. However, the movement of women into the legal profession has not been easy. As a consequence, considerable commentary has been focused on the significant problems of sexual harassment, discrimination, and other forms of gender bias, and on such issues as the …

For an investor, litigation funding is too tempting to resist. Litigation funding promises that most elusive of investment returns: those uncorrelated with an investor’s other investment returns. Litigation funding also invests in a world that seems fraught with possible pricing inefficiencies. It seems plausible—even likely—that a team of smart lawyer-underwriters can identify high-value litigation investments to generate superior returns for litigation funding investors. But more than a decade of experience suggests the promise of litigation funding is a siren song. The promise draws investors into the water, but the payoffs may be meager and rare. For most of us, the Bar Exam conjures up memories of grueling prep courses, intensive studying, and a couple of long days of exhaustive tests. In a way, the exam is the final rite of passage from law student to law practitioner. The exam is intended to test minimal professional competency, evaluating an applicant's legal reasoning and ability to apply general legal principles to various fact patterns.

Consider the following scenario: three individuals—a magician, a baker, and a puppeteer—want to start a business that will run birthday parties for children. The magician will put up most of the money, the baker has extensive experience with children’s birthday parties, and the puppeteer, who has an MBA, will manage the business. They meet with a lawyer to help them form a company, including advising them on such issues as choice of entity and allocation of ownership and control. This article presents initial, descriptive findings from the first phase of a national study, with a planned longitudinal component, conducted in collaboration with the American Bar Association (“ABA”).1 With representation from all U.S. regions and states, as well as the District of Columbia, the study examined lawyers with diverse backgrounds, with a primary focus on lawyers who identify as having health conditions, impairments, and disabilities, and on lawyers who identify as lesbian, gay, bisexual, transgender, queer, or as having other sexual orientations and gender identities (“LGBTQ+” as an overarching term). Tesis ini membahas mengenai sengketa tanah waris yang tidak bisa dilakukan proses persertipikatan untuk pertama kalinya oleh sang ahli warisnya. Kasus ini diawali dengan penerbitan Sertipikat Hak Atas Tanah sebidang tanah dengan bukti girik yang dikeluarkan oleh Kepala Kantor Pertanahan Kabupaten Bangkalan, yaitu Sertipikat Hak Milik Nomor 00163 Desa/Kel. Petapan. Penerbitan sertipikat tersebut ternyata merugikan pihak ketiga yang hendak melakukan pendaftaran tanah untuk pertama kalinya atas tanah girik yang dia peroleh dari peristiwa pewarisan sehingga secara hukum, dia kehilangan haknya atas tanah waris tersebut. Oleh karena itu, Sertipikat Hak Milik tersebut seharusnya dibatalkan karena secara nyata merugikan pihak ahli waris. …

Penelitian ini membahas mengenai sengketa pertanahan di kota Medan, Sumatera Utara antara para ahli waris Sultan Deli X melawan Akhmad Wakidin, Ir. Edy serta Kepala Kantor Pertanahan Kota Medan terkait Grant Sultan yang telah di konversi menjadi Hak Memperusahai Tanah nomor Daftar No. 90/Dbl.KLD/”60 bertanggal 22 Djuli 1960 yang menimbulkan tumpang tindih bukti kepemilikan atas tanah.
