The Metamorphosis Of Legal Education Symposium On Legal Education, Peter L. Strauss Jan 1985

The Metamorphosis Of Legal Education Symposium On Legal Education, Peter L. Strauss

Faculty Scholarship

Professor Brook's remarks this morning provide a context for my own. I mean to say a word or two for the classical era. One of the characteristics of legal education over the past half century or so, one that we ought not give up, has been its passion for order in a chaotic world. Striking as it is to say that "a passion for order ill suits a chaotic world," the world has ever been chaotic – and that passion, our principal defense. The question is, with what principles of order do we exercise that passion, to subdue unruly fact. …

Lawyering In First-Year Property, Joseph P. Tomain Jan 1983

Lawyering In First-Year Property, Joseph P. Tomain

Faculty Articles and Other Publications

This essay discusses the use of a role-playing exercise in a large (70-100 students), first-year Property II course. The central focus of the course is land use. The author uses a Board of Adjustment hypothetical, with students in the roles of lawyer, client, expert, and member of the Board of Adjustment. I first used the problem to encourage fact analysis. Even second-semester first-year students too easily ignore facts and focus on the "rules of law" seemingly to the exclusion of all else. After using this method, however, it became apparent that many more learning opportunities present themselves. In addition to …

Professional Competence And Social Responsibility: Fulfilling The Vanderbilt Vision, Sandra D. O'Connor Jan 1983

Professional Competence And Social Responsibility: Fulfilling The Vanderbilt Vision, Sandra D. O'Connor

Vanderbilt Law Review

In our laudable attempt to train law students to "think like lawyers" by teaching them legal method, we must not lose sight of the fact that questions of professional responsibility cannot properly be resolved with the same legal framework of analysis. Rather,we must see that as professionals with almost exclusive access to our system of justice, we have moral responsibilities totally outside the scope of the legal rules, and not amenable to analysis in terms of legal method. It is time to return to consideration of the moral and spiritual foundations of our legal system. It is time to train …

A Practical Legal Education, William E. Conklin Mar 1982

A Practical Legal Education, William E. Conklin

Dalhousie Law Journal

One of the central issues in regard to legal education during the past half century has been whether law faculties ought to have a theoretical or practical character. The debate has been an intense one. It has taken on many forms and grown from many diverse circumstances. Law societies periodically resurrect the issue. Professional law faculties interminably debate it. Positions are taken, factions are formed, and the unresolved outcome of the debate has left curriculum and initial assumptions relatively unchatged." This essay questions one of the most important assumptions of that debate - namely, that a practical legal education is …

The Social Costs Of Incompetence: An Educator's View, A. Wayne Mackay Mar 1982

The Social Costs Of Incompetence: An Educator's View, A. Wayne Mackay

Dalhousie Law Journal

After I had cut off my hands and grown new ones, something my former hands had longed for came and asked to be rocked. After my plucked out eyes had withered and new ones grown, something my former eyes had wept for came asking to be pitied. 2 The above quotation has been applied to lawyers and in particular the process of legal education. It is a distressing thought for anyone who cares about the law and considers it a worthy profession. Must people sever hands that can rock and pluck out eyes that can pity in order to become …

Legal And Medical Education Compared: Is It Time For A Flexner Report On Legal Education, Robert M. Hardaway Jan 1981

Legal And Medical Education Compared: Is It Time For A Flexner Report On Legal Education, Robert M. Hardaway

Sturm College of Law: Faculty Scholarship

The purpose of this Article is to explore the common elements of legal and medical education and to compare the reform movements in each profession, with a view toward finding an explanation for the widely differing conditions that exist today in the education of each profession. For example, why is it that medical education can provide facilities and training costing up to ten times that provided law students? Why do medical schools receive outside financial support paying up to 95% of the costs of medical education while law schools are supported primarily by tuition and fees? Why do medical students …

Elisabeth Haub School of Law Faculty Publications
