Digital Lawyering: Advocacy In The Age Of Ai, Patrick Barry

Law & Economics Working Papers

All lawyers are now digital lawyers. From Zoom hearings, to e-discovery, to AI-enhanced research and writing, the practice of law increasingly requires the skillful navigation of a wide range of technological tools. It’s no longer enough to be book smart and street smart. More and more, you also have to be byte-smart.

To help future lawyers navigate this transition, I recently created a course at both the University of Michigan Law School and the University of Chicago Law School called “Digital Lawyering: Advocacy in the Age of AI.” The course takes a skill-building approach to artificial intelligence. Which tools are …

Arbitration In Professional Sports: Is It Time To Move On?, Alessandra Makris

Cardozo Journal of Conflict Resolution (CJCR) Blog

Arbitration clauses are extremely common in the contracts of athletes all over the world. However, with the recent focus on eliminating mandatory arbitration clauses in employment contracts, the question of whether professional sports leagues will start doing the same remains. In the world of professional sports, arbitration clauses can often be found within a Collective Bargaining Agreement (“CBA”) between a players’ association and an owners’ group. Five major professional sports have arbitration clauses in their CBAs: Major League Baseball (“MLB”), National Basketball Association (“NBA”), National Football League (“NFL”), Major League Soccer (“MLS”) and National Hockey League (“NHL”). Typically, the clauses …

Crypto And Arbitration: The Perfect Pair, Jared Bond

Cardozo Journal of Conflict Resolution (CJCR) Blog

While Cryptocurrency was once seen as the forefront of unique new investment opportunities, early 2022, known as the “Crypto Winter” saw a steep decline in cryptocurrency prices.[1] The fall of cryptocurrency led to an increase in crypto arbitration, with some cases just starting to reach the court system.[2] Due to the international nature of cryptocurrency and the unique challenges disputes present, many crypto businesses include arbitration clauses in their contracts.[3] While not yet clear how many of these issues will ultimately be resolved, there are clear benefits for crypto companies using arbitration as their chosen dispute resolution process, and certain …

Sequel: Negotiation Strategies Sag-Aftra And Amptp Should Employ To Prevent Future Strikes, Molly Baraban

Cardozo Journal of Conflict Resolution (CJCR) Blog

The Screen Actors Guild-American Federation of Television and Radio (“SAG-AFTRA”) strike finally ended on November 9th, after months of contentious dealings between the two groups centering on concerns over the future of acting and the ability to compensate talent fairly. While we can now all finally celebrate the anticipated return of our favorite shows like Euphoria, House of the Dragon, and Stranger Things, we should also take a moment to critically analyze why SAG-AFTRA and the Alliance of Motion Picture and Television Producers (“AMPTP”) have historically continued to have conflict and how these groups can learn to negotiate better to …

James Kimmons worked at a Charter Communications call center. He suffered cataracts in both eyes, which made it difficult to drive in the dark. Kimmons requested a modification to his work schedule, seeking permission to work earlier hours so he could commute home in the daylight. Notably, the work-schedule accommodation Kimmons sought is one that many other Americans may need, as 22.8% of all working age adults are considered accommodation-sensitive and 47% to 58% “of those who would actually benefit from a workplace accommodation do not receive one.” His employer granted his request for a short period of time but …

A Band-Aid Solution: New York's Proposal To Address The Maternal Health Crisis, Emily Glazier

Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog

A pregnancy-related death is a death “that occur[s] within one year of pregnancy.” In the United States, approximately 700 women die each year as a result of pregnancy or pregnancy-related complications. Notably, pregnancy-related mortality rates are significantly higher for Black and American Indian and Alaska Native (AIAN) women. Even in the face of high income levels, Black women in America face a disproportionately higher risk of pregnancy-related death. In New York, such disparities are even more prominent: Black women are “over four times more likely to die from childbirth-related complications.” In New York City, Black women are “nine times more …

In 2018, Natassia Smick and her husband filed their income tax return showing earnings of about $33,000. They expected a refund, $2,000 of which is attributed to the Earned Income Tax Credit. The Earned Income Tax Credit (EITC) is a tax credit “for working people with low and moderate incomes. It boosts the incomes of workers paid low wages while offsetting federal payroll and income taxes.” The EITC aims to reduce poverty, and in 2018, the credit “lifted about 5.6 million people above the poverty line.” Smick, like many other families, relied on her tax refund to help pay her …

The 2024 Cardozo Colloquium On Global And Constitutional Theory, Benjamin N. Cardozo School Of Law

2024 Event Invitations

The US Supreme Court is currently experiencing a significant decrease in public approval, as are several courts in many other parts of the world, such as the Israel Supreme Court and top courts in various Eastern European countries. At the same time, in certain other parts of the world, such as Western Europe, constitutional courts persist as well integrated and are widely perceived as trustworthy guarantors of workable checks and balances. The Colloquium will explore what accounts for these differences and whether the various crises concerning judicial review arise from similar or different types of circumstances. To what extent are …
