Teaching "Is This Case Rightly Decided?", Steven Arrigg Koh Apr 2024

Teaching "Is This Case Rightly Decided?", Steven Arrigg Koh

Faculty Scholarship

“Is this case rightly decided?” From the first week of law school, every law student must grapple with this classroom question. This Essay argues that this vital question is problematically under-specified, creating imprecision in thinking about law. This Essay thus advocates that law professors should present students with a three-part framework: whether a case is rightly decided legally, morally, or sociologically.

Additionally, this Essay argues that disaggregating the question exposes deeper deficiencies in legal education. Many law professors do not provide students with serious grounding to engage in rigorous thinking about the relationship between law, morality, and justice, not to …

The Seminar Paper Topics Graveyard, Olivia Smith Schlinck Apr 2024

The Seminar Paper Topics Graveyard, Olivia Smith Schlinck

Library Staff Online Writings

I often teach one-off academic research instruction sessions for law students, for either those working on a journal or those in a writing seminar.

My approach to these sessions is relatively standard—demonstrate the sources and strategies for academic legal research—but tailored to the individual needs and overall topic of each course. One of my favorite ways to personalize a session is to demonstrate the research process using a topic that matches the class itself. A “fake paper,” if you will.

Unmasking Deepfakes: Navigating The Copyright Quagmire, Ben Gross

Cardozo Arts & Entertainment Law Journal (AELJ) Blog

In the ever-evolving landscape of digital technology, the emergence of deepfake technology has raised profound concerns, especially in the realm of copyright law. Deepfakes, sophisticated synthetic media created using artificial intelligence, can manipulate or replace existing content, often blurring the lines between reality and fiction.1 As these digital creations become more prevalent, questions surrounding their implications under copyright law have taken center stage.

Searching For Justice: Incorporating Critical Legal Research Into Clinic Seminar, Priya Baskaran Apr 2024

Searching For Justice: Incorporating Critical Legal Research Into Clinic Seminar, Priya Baskaran

Scholarly Articles in Law Reviews & Journals

This Article provides educators with a roadmap for incorporating Critical Legal Research into Clinical Pedagogy. Critical Legal Research is a social justice-oriented critical intervention that provides a theoretical framework and practical application. Critical Legal Research provides lawyers with tools to deconstruct but also reconstruct legal research and analysis modes to engender more just, client-focused outcomes that fall outside dominant legal narratives. The problematic advent of ChatGPT and the broader incorporation of Artificial Intelligence (AI) within the legal research regime has made the Critical Legal Research project more urgent than ever. Ultimately, introducing Critical Legal Research in the clinic seminar is …

The Art Of Discovery: Part 2, David Spratt

Scholarly Articles in Law Reviews & Journals

Form discovery is undeniably useful, particularly for seeing the types of questions or documents that are usually asked in a certain type of case. Unfortunately, many form interrogatories and document requests are outdated and do not follow effective writing strategies of clarity and precision. Many of the sample discovery requests are full of legalese, which often results in ambiguity. Grab your comb and razor, as we work together to “clean up” your discovery requests.

Foreword, Deborah W. Denno, Erica Valencia-Graham

Fordham Law Review

This Foreword overviews an unprecedented Symposium on these wide ranging topics titled The New AI: The Legal and Ethical Implications of ChatGPT and Other Emerging Technologies. Hosted by the Fordham Law Review and cosponsored by Fordham University School of Law’s Neuroscience and Law Center on November 3, 2023, the Symposium brought together attorneys, judges, professors, and scientists to explore the opportunities and risks presented by AI, especially GenAI like ChatGPT. The discussion raised complex questions concerning AI sentience and personal privacy, as well as the future of legal ethics, education, and employment. Although the AI industry uniformly predicts ever more …

The Legal Imitation Game: Generative Ai’S Incompatibility With Clinical Legal Education, Jake Karr, Jason Schultz

Fordham Law Review

In this Essay, we briefly describe key aspects of [generative artificial intelligence] that are particularly relevant to, and raise particular risks for, its potential use by lawyers and law students. We then identify three foundational goals of clinical legal education that provide useful frameworks for evaluating technological tools like GenAI: (1) practice readiness, (2) justice readiness, and (3) client-centered lawyering. First is “practice readiness,” which is about ensuring that students have the baseline abilities, knowledge, and skills to practice law upon graduation. Second is “justice readiness,” a concept proposed by Professor Jane Aiken, which is about teaching law students to …

Introducing Law Students To Transactional Practice: From Using Precedent To Closing The Deal, Ben Fernandez Apr 2024

Introducing Law Students To Transactional Practice: From Using Precedent To Closing The Deal, Ben Fernandez

UF Law Faculty Publications

My name is Ben Fernandez. I teach contract drafting at the University of Florida, Levin College of Law, and I'm going to talk about introducing students to transactional practice from using precedents to closing the deal. Basically, what I'm going to describe is things I do to supplement Tina Stark's Drafting Contracts: How and Why Lawyers Do What They Do. I'm going to give you a whole bunch of, I hope, useful, teaching ideas on how to do that.

Contract Drafting Classes Need To Devote More Consideration To The Law Applicable To "Boilerplate" Clauses, Ben Fernandez Apr 2024

Contract Drafting Classes Need To Devote More Consideration To The Law Applicable To "Boilerplate" Clauses, Ben Fernandez

UF Law Faculty Publications

The law applicable to “boilerplate” provisions is often given little attention in contract drafting classes because textbooks focus too much on the textbook author’s opinion of the best words to use for various contract provisions and how to format each clause (e.g., whether to use “shall” or “will” or “must” for a covenant or obligation, whether to write numbers numerically or in words (or both), whether to use “on or about” instead of “within” for a time period, whether to bold or underline definitions, or put them in quotes, etc.). Students need to learn to draft clearly and unambiguously; and …
