Mastering legal citation means understanding multiple citation systems. In addition to the Bluebook, fifty states produce fifty sets of laws, and each state decides how it wants its own materials to be cited. For case law, the Bluebook advises authors to use the West Reporter citations if available, but to add public domain citations if a state uses them. However, a state’s internal rules may require citation to the official state reports. All this creates a maze of rules that practitioners need to follow. Jenn Oliva, Professor of Law and Val Nolan Faculty Fellow, has been elected to the American Law Institute, the organization announced yesterday (Oct. 4).

She becomes the 18th member of the Indiana University Maurer School of Law faculty to earn the prestigious recognition.

“This is a tremendous honor for Professor Oliva and we are proud to have her on our faculty,” said Indiana Law Dean Christiana Ochoa, who holds an ex officio role with the ALI. “Since Jenn joined us in 2023 she’s quickly become an invaluable member of the Maurer community and we’re thrilled to see her recognized.”

The resulting devastation of World War II produced a need for rules of engagement and protection of innocent civilians. Nevertheless, an increasing number of armed conflicts are currently being fought in dense urban environments. As a result, the risk of collateral damage and harm to civilians has drastically increased, making it significantly more difficult to adhere to international humanitarian law (“IHL”) and the rules of war.

Ensuring civilians caught in the crossfire get the necessary humanitarian aid and coordinating with all stakeholders is incredibly complex. This process of protecting civilians in active war zones and generally upholding humanitarian law is …

Law Schools Should Substantially Increase Instruction In Mediation Representation, John Lande

American law schools generally focus 10% or less of their mediation curriculum on mediation representation. As shown in a survey of faculty teaching mediation and an analysis of course syllabi in this article, most of the instruction focuses on the role of a mediator.

This is a problem for several reasons. New graduates represent clients in mediation much more frequently than they mediate. Clients usually need professional advice to evaluate their cases and develop strategies, which mediators cannot provide. This is precisely the important service that attorneys can provide, but we teach students very little about what to do when …

The Maurer School of Law is mourning the passing of its graduate Robert H. McKinney, a visionary attorney, businessman, civic leader, and philanthropist, who died over the weekend at his home in Michigan. He was 98.

McKinney enrolled at the IU School of Law in Indianapolis after his World War II duties, but was recalled to active duty during the Korean War. McKinney transferred to IU’s law school in Bloomington, where he graduated in 1952.

He remained actively involved with both law schools—and the university—for more than 70 years. In 2011 the IU School of Law in Indianapolis was renamed …

The American Bar Association now requires law schools to provide "education to law students on bias, cross-cultural competency, and racism." But how can a law professor navigate these challenges in the current cultural climate fraught with polarizing divisiveness? In this present-day charged atmosphere, law students may be particularly sensitive to statements they perceive as offensive and may seek accountability for such remarks. Implicit bias and micro-aggressions can reveal biases that are unconscious and unintentional. How then can a law professor make students feel comfortable discussing these important and relevant topics in class?

We administered a survey to law students at three Canadian law schools in the Atlantic region at the end of the Fall 2020 term. The survey asked students to compare their learning of each of the Federation of Law Societies of Canada (FLSC)-mandated competencies, as well as several others taken from the Law Society of New Brunswick (LSNB) competency profile, in the Fall 2020 (online) term versus previous terms of study. The survey also solicited testimonies on students’ socialization into the legal community during their unexpected online law school experience. There has been a big push to revamp legal education. Many have argued that after years of doing things the same way, it is time to change. While there is validity for the need for reform, educators should embrace the one thing legal education has gotten right: anonymous or blind grading. This Essay makes the case that blind grading should not only remain in legal education, but every law school course should adopt it, including writing and clinical courses.
