Understanding The Nuances: Diversity Among Asian American Pacific Islanders, Vinay Harpalani May 2021

Understanding The Nuances: Diversity Among Asian American Pacific Islanders, Vinay Harpalani

Faculty Scholarship

Asian American Pacific Islander (AAPI) Heritage Month recognizes the collective contributions of all AAPIs, but it is also an opportunity to move beyond the collective and highlight the nuanced differences between various AAPI groups. Lumping together all of these groups, without appreciation for their unique histories, experiences, and challenges, can obscure important differences, which in turn reinforces stereotypes. For example, although the “model minority” stereotype depicts AAPIs as high academic achievers from relatively privileged socioeconomic backgrounds, this is only accurate for a subset of the AAPI population. Higher education institutions in particular should highlight the vast diversity among AAPIs, as …

Radical Imagination: Fostering Community In Legal Education, Adrienne Baker May 2021

Radical Imagination: Fostering Community In Legal Education, Adrienne Baker

Student Scholarship

Study after study alerts us to concerns about law student wellbeing. Statistics are staggering, and law students are more likely to become anxious, depressed, and turn to substance abuse. Self-care is framed as an antidote, but the individual responsibility is still placed on the student. Rather, the issue is better resolved upstream.

Law schools must transgress and transform; they must reimagine their function. This article reflects on law school pedagogy and simple ways to build community in the classroom as well as school-wide administrative suggestions to promote law student wellbeing.

The Soft-Shoe And Shuffle Of Law School Hiring Committee Practices, Carliss N. Chatman, Najarian R. Peters May 2021

The Soft-Shoe And Shuffle Of Law School Hiring Committee Practices, Carliss N. Chatman, Najarian R. Peters

Scholarly Articles

It is in the spirit of Ida B. Wells that we seek to turn the light upon the systemic racism of hiring practices. We believe these practices are indicators of the systemic failures on campuses and in workplaces that prevent them from being antiracist. We seek to use this Essay as a “tool for exposing, analyzing, and challenging the majoritarian stories of racial privilege.”

Our specifc intention is to recognize the largely performative nature of claiming to be committed to an idea while substantively and concretely ensuring the opposite. This Essay is written with specific experiences, patterns, and practices in …

First Amendment Knowledge And Competence In United States Residents, Cynthia J. Najdowski, Kimberly M. Bernstein May 2021

First Amendment Knowledge And Competence In United States Residents, Cynthia J. Najdowski, Kimberly M. Bernstein

Psychology Faculty Scholarship

Lacking adequate knowledge about one's rights could inhibit the likelihood of exercising one's rights or lead one to unwittingly violate laws that place legitimate limits on these rights. Thus, the present research examines First Amendment knowledge as well as competence to apply this knowledge in relevant circumstances. Results revealed that one-quarter of participants failed a test of objective knowledge on First Amendment rights. Furthermore, participants' belief in their ability varied depending on their level of knowledge, in line with the Dunning–Kruger effect. Participants also failed to transfer their limited objective knowledge to “real-world” situations, exhibiting impaired First Amendment competence. These …

Out Of Sight, Out Of Mind: Analyzing Inhumane Practices In Mississippi’S Correctional Institutions Due To Overcrowding, Understaffing, And Diminished Funding, Ariel A. Williams May 2021

Out Of Sight, Out Of Mind: Analyzing Inhumane Practices In Mississippi’S Correctional Institutions Due To Overcrowding, Understaffing, And Diminished Funding, Ariel A. Williams

Honors Theses

The purpose of this research is to examine the political, social, and economic factors which have led to inhumane conditions in Mississippi’s correctional facilities. Several methods were employed, including a comparison of the historical and current methods of funding, staffing, and rehabilitating prisoners based on literature reviews. State-sponsored reports from various departments and the legislature were analyzed to provide insight into budgetary restrictions and political will to allocate funds. Statistical surveys and data were reviewed to determine how overcrowding and understaffing negatively affect administrative capacity and prisoners’ mental and physical well-being. Ultimately, it may be concluded that Mississippi has high …

Critiquing Instrumentalism In High Education: Lessons From Teaching As A Meditative Inquiry, Ashwani Kumar, Nayha Acharya May 2021

Critiquing Instrumentalism In High Education: Lessons From Teaching As A Meditative Inquiry, Ashwani Kumar, Nayha Acharya

Articles, Book Chapters, & Popular Press

In this conceptual and self-reflective essay, the authors begin from the premise that the contemporary higher educational institutions in Canada and many other parts of the world have increasingly tended to focus on instrumental teaching, rooted in neoliberal and capitalist ideals of societal progress through economic development. The result is that higher education centralizes making students career ready, rather than the holistic development of the student. Critical of this, Ashwani Kumar (professor of Education) and Nayha Acharya (professor of Law), undertake a collaborative effort to discuss how Kumar’s theoretical and practical concept of teaching as meditative inquiry can be an …

Dean's Desk: Graduation, Student Excellence And Trailblazing Alumni, Austen L. Parrish

Austen Parrish (2014-2022)

On Saturday, May 8, the Maurer School of Law will celebrate the Class of 2021 in its annual graduation ceremony. The day before, students will have walked across the stage in their regalia and participated in a hooding ceremony as part of a formal, in-person university commencement. The pandemic is forcing us to hold the school’s individual celebration on Zoom, but many of our traditions continue. Family and friends will attend, we’ll hear from student and faculty speakers, each graduate will be honored individually, and we’ve even chosen a talented student to sing the Alma Mater.

Looking back on a …
