Shifting Public Perception: Climate Change Means Living With Fire And Smoke, Robert Froembling

Seattle Journal of Technology, Environmental, & Innovation Law

The urgency to prepare for the climate crisis has never been greater. We are currently living in the sixth mass extinction and the effects are only going to accelerate. We will inherit more wildfires, larger wildfires, and more frequent wildfires.

This piece is not meant to stoke fear in its readers or be depressing, but to shift public perception on what our future holds by evaluating the laws and science presented to us. This piece will look at regional and federal regulations and assess the increased rate of forest fires and the grave public health concerns from stagnant smoke specifically …

Law Faculty Scholarship

A worldwide pandemic is forcing schools to close their doors. Yet the need to teach students remains. How can faculty – especially those who are not trained in technology-mediated teaching – maintain educational continuity? This Essay provides some suggestions and relatively quick and easy strategies for distance education in this time of coronavirus. While it is written from the perspective of teaching law school, it can be applied to teaching other humanities such as philosophy, literature, religion, political theory, and other subjects that do not easily lend themselves to charts, graphs, figures, and diagrams. This Essay includes an introductory technology …

Is The Establishment Clause Asymmetrical?, Sam Foer May 2020

Is The Establishment Clause Asymmetrical?, Sam Foer

Senior Honors Projects

Through numerous Establishment Clause cases, the Supreme Court has concluded that when public educators promote or denigrate religious views in the K-12 classroom, they violate the First Amendment. The Court has found that the protection of ‘freedom of conscience’ is embedded in the purpose of the Establishment Clause, which applies most strictly to the public school setting. This is because the sphere of conscience is most vulnerable to invasion in developing minds, and children are in a captive environment at school - they cannot escape from State instruction. Thus, states, school systems, and teachers who impose their religious beliefs onto …

SMU Law Review Forum

The COVID-19 pandemic and resulting shutdowns are affecting every aspect of society. The legal profession and the justice system have been profoundly disrupted at precisely the time when there is an unprecedented need for legal services to deal with a host of legal issues generated by the pandemic, including disaster relief, health law, insurance, labor law, criminal justice, domestic violence, and civil rights. The need for lawyers to address these issues is great but the prospect of licensing new lawyers is challenging due to the serious health consequences of administering the bar examination during the pandemic.

State Supreme Courts are …

Contract Lore As Heuristic Starting Points, Colin P. Marks May 2020

Contract Lore As Heuristic Starting Points, Colin P. Marks

Faculty Works

This article examines the concept of “contract lore,” a term used to describe commonly repeated propositions about contract law that may not accurately reflect how courts actually decide cases. Prior scholarship has suggested that the persistence of such statements reflects aspirational thinking among contract scholars and practitioners, maintained through a form of cognitive dissonance. This article challenges that explanation and instead argues that many examples of contract lore are better understood as heuristic starting points used in legal analysis. Rather than functioning as definitive statements of law, these propositions provide an initial framework from which students, lawyers, and judges begin …

Dean's Desk: Amid Covid-19 Shutdown, Iu Maurer Displays Resilience, Austen L. Parrish

Austen Parrish (2014-2022)

The spring semester is coming to a close in Bloomington, but in ways none of us expected. The COVID-19 pandemic required us to shift to teaching remotely in a matter of days, and all on-campus events — including commencement — have been canceled or postponed. Fortunately, when classes resumed remotely March 30, our students, faculty and staff more than rose to the occasion and pulled together, and the transition has been smoother than expected.

Our community’s resilience and positive attitude through the pandemic have led me to reflect more broadly on the wonderful support — financial and otherwise — we …

Maine Corporation Law & Practice, Gregory S. Fryer Apr 2020

Maine Corporation Law & Practice, Gregory S. Fryer

Maine Law Review

The scarcity of case law in Maine on corporate law issues of the day is a fact of life for corporate law practitioners in this State. While courts in more populous states fill library shelves with an ever-growing mix of corporate law decisions, we in Maine often can only wonder which way our own courts would turn if presented with those same issues. Faced with a limited amount of local case law, corporate lawyers here might rarely venture beyond well-hewn traditions were it not for two-and now three-fortunate developments. First and foremost is the Maine Business Corporation Act. The Act …

Trial Handbook For Maine Lawyers, Joel C. Martin Apr 2020

Trial Handbook For Maine Lawyers, Joel C. Martin

Maine Law Review

Lawyers Cooperative Publishing has issued trial handbooks for practitioners in some twenty-three states. One now appears for Maine lawyers, under the supervision of Bob Stolt of the Maine Bar. Trial Handbook for Maine Lawyers is a single-volume compendium of Maine precedent and practice as they relate to trials. Excluding the discovery matters that precede the trial and the appeal that may follow it, the book focuses on the actual conduct of the trial, from jury selection to verdict and judgment. In between, it covers the necessary matters: opening statements, the order and burden of proof, examination of witnesses, evidence, damages, …

Join With Me, Won't You? Civic Engagement, Covid-19, And The Millennial Generation Of Law Professors, Joseph A. Schremmer Apr 2020

Join With Me, Won't You? Civic Engagement, Covid-19, And The Millennial Generation Of Law Professors, Joseph A. Schremmer

Faculty Scholarship

My goals in this essay are to place legal education’s COVID-19 crisis into this broader context and illuminate the unique opportunity that millennial law professors have to create the conditions for more robust community participation within and outside of our law schools. Part I summarizes the decline of civic engagement and social capital in preceding decades and its consequences for law, public discourse, and quality of life. Part II outlines how this deficit of social capital exacerbates the challenges facing law schools and professors in delivering legal education and constructing community during the coronavirus pandemic. Part III explores the unique …

An Introduction To The Collection [Get In Good Trouble: A Collection Of Essays By Millennial Law Scholars], Verónica C. Gonzales

Get in Good Trouble: A Collection of Essays by Millennial Law Scholars Introduction by Verónica C. Gonzales-Zamora with essays by Kinda Abdus-Saboor, Ernestine Chaco, Marcus Gadson, Verónica Gonzales-Zamora, Camilo Romero, Lysette Romero Córdova, Morenike Saula, Joseph Schremmer, and Hon. Roshanna Toya. Afterword by Marcus Gadson. In response to the global pandemic, legal education in the United States shifted almost immediately to new tools and methods of delivery. Unsure of the lasting impact of these shifts, law faculty and law students around the country remain in limbo preparing for different scenarios when instruction resumes. Millennial law professors and scholars, with decades …

"Mommy Track" On Steroids: How The Pandemic Is Further Derailing "Moms Of Law", Lysette Romero Córdova

Faculty Scholarship

As students or professors with children to raise, we inherently experience law school differently from our male and childless peers—and not in a good way. Even before the pandemic hit, the Moms of Law were at a disadvantage because we must divide our time and attention between the demands of law school and parenting. Thus, while the pandemic has created challenges for everyone involved in legal education, the inequitable impact on those raising young children has brought new meaning to the term “mommy track.” Part I of this essay describes the mommy track experience and how the inequity that it …
