Notes On The Difficulty Of Studying The Corporation, Marina Welker Mar 2016

Notes On The Difficulty Of Studying The Corporation, Marina Welker

Seattle University Law Review

In the award-winning documentary The Corporation, public intellectuals and activists characterize corporations as “externalizing machines,” “doom machines,” “persons with no moral conscience,” and “monsters trying to devour as much profit as possible at anyone’s expense.” In other footage, people on the street personify corporations: “General Electric: a kind old man with lots of stories;” “Nike: young, energetic;” “Microsoft: aggressive;” “McDonald’s: young, outgoing, enthusiastic;” “Monsanto: immaculately dressed;” “Disney: goofy;” “The Body Shop: deceptive.” The documentary, like screenwriter and legal scholar Joel Bakan’s book The Corporation: The Pathological Pursuit of Profit and Power, imparts dissonant messages about corporations. On the one hand, …

One Model Of Collaborative Learning For Medical And Law Students At The University Of Baltimore And Johns Hopkins University, Gregory Dolin, Natalie Ram Mar 2016

One Model Of Collaborative Learning For Medical And Law Students At The University Of Baltimore And Johns Hopkins University, Gregory Dolin, Natalie Ram

All Faculty Scholarship

Medicine, like law, is sometimes referred to as a “conservative” profession, as both can change slowly, stifling innovation. While the art of medicine has produced important advances, there is at least one part of medicine that has not changed much in more than 100 years. Nearly all American medical schools have followed much the same educational model since Abraham Flexner published his famous report on the state of American medical education in 1910. The educational model promoted by that report emphasizes teaching students the science of medicine, but it is not well equipped for teaching students about the practicalities of …

Life After Law School: A Pilot Study Examining Long-Term Outcomes Associated With Graduating Law School And The Value Of Legal Education, Accesslex Institute, Gallup Mar 2016

Life After Law School: A Pilot Study Examining Long-Term Outcomes Associated With Graduating Law School And The Value Of Legal Education, Accesslex Institute, Gallup

Commissioned Research

Many policymakers and leaders have been paying close attention in recent years to the near-term job placement and earnings of law school graduates, which they often declare are representative of the “value” of a law degree. Such a focus on the economic payoff of a law degree is understandable because legal education has become a more costly and leveraged endeavor. While such metrics have merit, they do not provide a holistic view of graduates’ lives or the broader benefits that legal education provides.

Practicing Practical Wisdom, Deborah J. Cantrell, Kenneth Sharpe Mar 2016

Practicing Practical Wisdom, Deborah J. Cantrell, Kenneth Sharpe

Mercer Law Review

Here is what we believe and what we set out to test: Wisdom is not an innate character trait; no one automatically is wise; and wisdom is learned and acquired. More importantly, one can learn and acquire wisdom intentionally and skillfully-one can practice it. And, if the practice is structured in particular ways, the practice will improve one's capacities to act with wisdom. For lawyers, and even more so for law students, that should be heartening. For legal educators, the ability to improve one's capacity to act with wisdom should be a call to action.

We set out to discern …

Monroe Freedman's Influence On Legal Education, Peter A. Joy Mar 2016

Monroe Freedman's Influence On Legal Education, Peter A. Joy

Hofstra Law Review

Monroe Freedman’s influence on legal education was profound by any measure. He was much more than a gifted scholar and teacher, though he was all of those, as well as an accomplished lawyer. He was also the antithesis of a law professor disconnected from the practice of law who produces scholarship that has little to no relationship to the practice of law. Instead, Monroe Freedman’s scholarship was singularly focused on the difficult ethical issues lawyers face in the practice of law, and he was fully engaged with the practicing bar. Much of his scholarship was on the leading edge of …

The Distractions Of Technology, Kimberly Mattioli Mar 2016

The Distractions Of Technology, Kimberly Mattioli

Articles by Maurer Faculty

Since the moment I became a librarian, I have had a problem with technology. It’s not that I can’t keep up with the developments or that I can’t figure out ways to incorporate technology into my work. My problem is much simpler in a way—I find technology too distracting. With my desktop, my phone, and my iPad sitting in my office, how could I not be drawn to the glowing screens and the limitless websites before me? The Internet is never-ending, and so too, it seems, is my ability to be distracted by it. With a little dedication, however, I …

Oral Histories, Presentations, and Videos

Virgil Darnell Hawkins was an African-American trailblazer. Through and by way of his unrelenting effort to become a Florida lawyer, the Jim Crow laws, that once kept Florida's African Americans from attending the white public universities and colleges, were eventually abolished. This paved the way for the end of discrimination in Florida's schools of higher learning and opened the way for African Americans to attend state universities and colleges.

This program and presentation honor Mr. Virgil Darnell Hawkins.
