The fourteenth annual celebration in honor of William W. Cook, founder of the Lawyers Club of the University of Michigan and donor of the buildings on the Law Quadrangle, will be held on Friday, April 21, 1939. The honorable Charles P. Megan of the Chicago Bar, trustee of the Chicago and Northwestern Railroad by appointment of the Federal Court and formerly President of the Illinois State and Chicago Bar Associations and Chairman of the National Conference of Bar Examiners, will be the guest of honor. The events of the day will culminate in a dinner at the Lawyers Club at …
A Comparison Of Continental And American Legal Education, Stefan Riesenfeld
A Comparison Of Continental And American Legal Education, Stefan Riesenfeld
Michigan Law Review
Legal education in the United States has become more and more a part of university education and the activity of the American university law school is a matter which invites comparison with the law schools of foreign universities. This is true particularly because the system of university legal education has recently also become a "problem" in this country. In 1930 Abraham Flexner published his instructive, but possibly not altogether unbiased, book on universities in which he pictured American, English and German universities. The author gave all his attention to the teaching of science, however, and did not discuss law schools, …

Trusts-Restated And Rewritten, Harry W. Vanneman
Trusts-Restated And Rewritten, Harry W. Vanneman
Michigan Law Review
Two books were published during the past year which are of the greatest importance to those of the legal profession who are interested in the law of trusts. Professor Bogert's seven volumes appeared first, followed shortly by The Restatement of the Law of Trusts by the American Law Institute, of which Professor Scott, of the Harvard Law School, was the reporter. Professor Bogert, of the University of Chicago Law School, was a member of the Institute's Committee on Trusts. Since 1927, therefore, when the Institute began work on the Restatement of Trusts, Professor Bogert apparently has been working …
What Should The American Law Institute Do?, Hessel E. Yntema
What Should The American Law Institute Do?, Hessel E. Yntema
Michigan Law Review
It will generally be agreed, I believe, that the creation of the American Law Institute in 1923 was one of the most hopeful events in the recent legal history of this country. The plan for the Institute, as formulated in the impressive report which motivated its establishment, was well-conceived, broad-visioned, and based upon a comprehensive analysis of the chief defects in the legal system of the United States. This plan was significant in at least three important respects. In the first place, it defined an ambitious and, in some respects, a unique task for the Institute to accomplish; the report …

The Value Of Sociology To Law, Robert C. Angell
The Value Of Sociology To Law, Robert C. Angell
Michigan Law Review
There has been a good deal said about a sociological approach to law and, as time goes by, more and more attempts are being made to turn words into action. There is a definite trend toward the tise of the sociologist, his research methods, his findings, or his body of principles by those concerned with the law. It may not be amiss, therefore, for a sociologist to inquire what the possibilities of this trend really are. Though, in certain respects, he may be less well equipped for this task than the student of law, he at least has the advantage …
The Contribution Of Thomas M. Cooley To Bryce's "American Commonwealth", Everett S. Brown
The Contribution Of Thomas M. Cooley To Bryce's "American Commonwealth", Everett S. Brown
Michigan Law Review
In the preface to The American Commonwealth, James Bryce acknowledged his indebtedness to numerous friends who, in one way or other, aided him in the writing of his book. First on this list is the name of Thomas M. Cooley. An examination of the text and footnotes of The American Commonwealth shows that Bryce was well acquainted with Cooley's published works, especially his Constitutional Limitations and his General Principles of Constitutional Law, which he quoted frequently with approval and respect. Also one finds six references to letters from Judge Cooley or to observations made directly by him to Bryce. But …
Broadening Legal Education, Edgar Noble Durfee
Broadening Legal Education, Edgar Noble Durfee
Michigan Law Review
The adoption of the case-method was a wild venture into the unknown, and even now, after a half century of experience, its wisdom is not proved in any strict sense. I remind the reader of this in order that there may be between us a clear understanding that any discussion of legal education moves in the realm of opinion. And there are other difficulties. Legal education is an eminently practical business, a tangle of conflicting factors. Wisdom lies in compromise and patient shaping of details. I shall therefore concern myself not so much with formulation of principles as with details …
Legal Aid Clinics In Less Thickly Populated Communities, John S. Bradway
Legal Aid Clinics In Less Thickly Populated Communities, John S. Bradway
Michigan Law Review
Legal aid work, whether performed by independent societies, or by clinics connected with law schools, has ceased to be a novelty in large cities, especially in the northeastern and extreme western parts of the United States. When one comes to examine the progress of this charitable aspect of law practice in less thickly settled communities, a definite orientation is necessary. There is little literature dealing either with the need in rural sections and the smaller cities for definite organizations or the question as to whether there is enough clinical material to make possible a law school course in this field. …

In an interesting review of WALSH ON EQUITY, in 29 MICH. L. REV. I I 22 (June 1931 ), Professor Clarence D. Laylin appears to ascribe to me parenthood for some pleading concepts set forth in that excellent treatise ( of which I heartily approve; compare my review in 8 NEW YORK UNIVERSITY LAW QUARTERLY REVIEW 521, March, 1931). Although these ideas have been supported by able writers and courts for some time, I should not object to the honor but for the fact that Professor Laylin also seems to assume premises which in my opinion are most inimical to …

A Book Of Little Value, Ralph W. Aigler
Michigan Law Review
The former edition of this textbook appeared in 1922, before the Negotiable Instruments Law had been adopted by all of the states. The changes in the present edition are numerous. Part III of the two former editions has hen eliminated by placing the citations to the Negotiable Instruments Law in the footnotes. Many new sections have been added. The chapter on Guaranty and Suretyship has been eliminated. The introductory chapter is essentially new, and a chapter on Amount of Recovery has been added. The chapter on Conflict of Laws has been rewritten. The author has incorporated the proposed amendments to …
A German Work On Trade Marks And Unfair Competition In The United States, Hanna Katz
A German Work On Trade Marks And Unfair Competition In The United States, Hanna Katz
Michigan Law Review
The acquaintance of German lawyers with American trade-mark law and protection against unfair trading was based until now on the individual studies of persons especially interested in this subject. German textbooks and commentaries on industrial property rights treat international and foreign rules too, but they scarcely give a sufficient notion of how to create a valid trade-mark and protect the trader in his full enjoyment thereof in the U. S. A. Yet the necessity of having such knowledge is a rather broad one in Germany as in all other European countries selling trade-marked articles to their customers on the other …

A Letter To The Lawyers Club, William W. Cook
Michigan Law Review
The scope and purposes of the law schools will in my opinion rapidly expand. And the first expansion will be the inauguration of legal research. You have led the way. You have the first and so far the only research professorship. Professor Sunderland has blazed the trail and is hewing a road through the wilderness. And I think he is laying out the right route.
