Cases On Principal And Agent, Selected From Decisions Of English And American Courts, Edwin C. Goddard
Cases On Principal And Agent, Selected From Decisions Of English And American Courts, Edwin C. Goddard
Books
It is a striking proof of the fact that Agency is a modern subject in the law that Blackstone, in his Commentaries on the Laws of England, does not mention the subject by name, and barely makes a four-line reference to one sort of agent in his classification of servants. The old ca~es do, of course, sometimes deal with pure agency questions, but the agent is usually referred to as a servant or a factor, and the questions in issue are generally settled upon some principle of the law of Master and Servant. Agency is essentially a business- relation; hence …

Some Recent Developments In The Department Of Law, Henry M. Bates
Articles
The present continues to be a period of rapid and interesting development in legal education. The criticisms to which the law and its administration by courts and lawyers have been subjected during the last few years very naturally and properly has led to a careful reconsideration of existing methods of legal instruction in the hope that they might perhaps be improved. The truth is that scientific legal education, comparatively speaking, is still in its infancy both in England and in the United States. Instruction in law of the dogmatic and supposedly purely practical kind has long been carried on efficiently …
Teaching Of Practice And Procedure In Law Schools, Edson R. Sunderland
Teaching Of Practice And Procedure In Law Schools, Edson R. Sunderland
Michigan Law Review
Criticism of the law, the courts, and the legal profession is one of the popular customs of the day. So constantly and so insistently are we told of the shortcomings of the Bench and Bar that it is hard to hold one's footing against the sweep of the current. One might well suppose from all the clamor that the ancient respectability of the law had suddenly been discovered to be a monstrous pretense, a fraud on the innocence and trustfulness of the people, a cloak for injustice and a mask for oppression.

Practice Court Rules, University Of Michigan Law School
Miscellaneous Law School History & Publications
The purpose of the Practice Court is to afford to students of this department practical instruction in pleading both at law and in equity, under the common law system and the "reformed" or "code" procedure, and actual experience in the commencement and trial of cases through all their stages.
This booklet outlines the Practice Court Rules for 1913.
Cases On Procedure, Annotated. Code Pleading, Edson R. Sunderland
Cases On Procedure, Annotated. Code Pleading, Edson R. Sunderland
Books
“In the present volume on Code Pleading, the editor has aimed to present the subject, in all of its more important features, as a complete working system of pleading. The code has frequently been treated as the mere ‘antithesis’ of common law pleading, and this has resulted in throwing the subject completely out of balance by unreasonably extending the discussion of those elements which are ‘characteristic’ of the code, while unduly restricting or entirely ignoring those principles which the code shares with the common law….
“The student should be able to obtain a clear conception of the system as a …

We are living in a period of extraordinary unrest. The spirit of criticism is prevalent, and no belief or creed, no institution is exempt from this questioning spirit of the time. Among social institutions perhaps none is being more relentlessly subjected to attack than the law as administered in our courts and practiced by our lawyers. It is true that much of the criticism leveled at legal institutions is unreasonable and is based upon ignorance or prejudice, but there remains a residuum of complaint which is well founded. In the very nature of things law and its administration always have …

The Teaching Of Practice And Procedure In Law Schools, Edson R. Sunderland
Articles
Procedure is merely the means of co-ordinating effort, of harmonizing differences, of offering every one equality of opportunity in offense and defense before the law. Without it there would be confusion, favoritism, and injustice. If the subject were viewed in this fundamental way, and were studied conscientiously as an incident and aid to the development and determination of the merits of controversies, the criticisms now so fiercely directed against it would largely disappear. In its use it is indispensable, in its abuse only does it cause trouble. A professional conscience to curb that abuse, and professional learning and skill to …

In one respect the law is the most perplexing subject with which a man can deal. It shifts and changes so rapidly that only a nimble and diligent student can keep abreast of it. One is likely to wake up any morning and find that the legislature has repealed a good part of what he knows, and he is in constant danger of having his most carefully formed opinions completely upset by a new decision of the Supreme Court. These violent changes are not due to any new discoveries, such as constantly enliven the scientific world, but merely to the …

The Four Year Course In The Department Of Law, Henry M. Bates
Articles
The present year has witnessed the final step in the establishment of the new entrance requirement to the Law Department which was undertaken by the Faculty and Regents several years ago. This, in effect, provides that every student in the Law Department from now on shall have had at least one year in the Literary Department, or its equivalent elsewhere, and places the course of the Law Department practically upon the four year basis of the other schools in the University.

The Late Ashley Pond, Michigan Law Review
Michigan Law Review
On January 12th last, Ashley Pond died at his home in Detroit in his eighty-third year. By his death the University has lost one of its oldest and most distinguished alumni. Mr. Pond was graduated from the Literary Department in 1854. After studying law for a little over two years, he was admitted to the Detroit Bar. At that Bar he continued to practice for about half a century, and when he died was its senior member. Mr. Pond's career is an example to every lawyer and an encouragement to every young man of humble origin and narrow means. When …

No more striking proof of perfect confidence and high regard could be afforded than the unanimous sense of relief with which the news of the appointment of Harry Burns Hutchins as permanent President of the University was welcomed by his colleagues of all Departments, with whom he had for so many years been closely associated. Verily, he is not one without honor in his own country.

The important changes in the administrative force of the University this year have been of especial significance to the Law Department. It is a matter for congratulation that a r.ew Dean has been chosen from the present Faculty, thus assuring the continuation of the successful policy of the past without essential break.
