Reexamining Relative Bar Performance As A Function Of Non-Linearity, Heteroscedasticity, And A New Independent Variable, Rory Bahadur, Kevin Ruth, Katie Tolliver Jones Mar 2022

Reexamining Relative Bar Performance As A Function Of Non-Linearity, Heteroscedasticity, And A New Independent Variable, Rory Bahadur, Kevin Ruth, Katie Tolliver Jones

New Mexico Law Review

One might believe that a law school's graduates doing better on the bar exam than their matriculating credentials predicted must be primarily attributable to the teaching ability and performance of the institution's faculty. Some scholarship makes such a claim. However, it is empirically untrue. Prestidigitation rather than legal pedagogy yields such superficial results. Law schools manipulating their matriculant pools via academic attrition and transfer is the sleight-of- hand that improves their graduates' bar performance rates. This article reveals the math behind the magic.

This article demonstrates that effective pedagogy may not be the only driver of a law school's students …

Review: The Dialogical Roots Of Deduction: Historical, Cognitive, And Philosophical Perspectives On Reasoning, Brian N. Larson

Faculty Scholarship

The balance of this review addresses matters in the book that should be of particular interest to readers in the legal rhetoric and communication community. First, it addresses some concepts central to Dutilh Novaes’ effort. Second, it surveys the book’s organization, identifying some key observations and conclusions that she supports with careful evidence and argumentation. Third, it addresses Dutilh Novaes’ attention to non-European and non-Western research and logical traditions. Finally, it considers some difficult and technical passages, noting those readers should work through because the payoff is worth it and others I believe readers in our field might skip.

Nonlawyers In The Legal Profession: Lessons From The Sunsetting Of Washington's Lllt Program, Lacy Ashworth

Arkansas Law Review

Today, the number of attorneys in the world fails to serve the number of people in need of legal assistance. Approximately sixty percent of law firm partners are baby boomers, meaning those in their mid fifties to early seventies, and twenty-five percent of all lawyers are sixty-five or older. These individuals will predictably retire. Meanwhile, law school costs more than ever. The average law student graduates $160,000 in debt only to enter into the legal profession with an average starting salary of $56,900 in the public sector and $91,200 in the private sector. It is no surprise law schools have …

Hierarchy, Race & Gender In Legal Scholarly Networks, Keerthana Nunna, W. Nicholson Price Ii, Jonathan Tietz

Law & Economics Working Papers

A potent myth of legal academic scholarship is that it is mostly meritocratic and that it is mostly solitary. Reality is more complicated. In this Article, we plumb the networks of knowledge co-production in legal academia by analyzing the star footnotes that appear at the beginning of most law review articles. Acknowledgements paint a rich picture of both the currency of scholarly credit and the relationships among scholars. Building on others’ prior work characterizing the potent impact of hierarchy, race, and gender in legal academia more generally, we examine the patterns of scholarly networks and probe the effects of those …

Introducing Students To Ethics And Professionalism Challenges In Virtual Communication, Katherine M. Koops, James E. Moliterno, Carol E. Morgan, Carol D. Newman

Scholarly Articles

As the practice of law, and the conduct of business generally, focuses increasingly on virtual communication, the ethics and professionalism challenges inherent in email, videoconference, text, and telephone communication continue to evolve. These challenges are particularly prevalent in transactional practice, which involves frequent communication with a variety of parties through a variety of communication channels. Exposing law students to these challenges through exercises and simulations contributes to the continued development of their professional identity as lawyers.

This article presents a variety of exercises that introduce students to client confidentiality, inadvertent disclosure, and other ethical issues that often arise in the …

Teaching Theranos, Priya Baskaran Jan 2022

Teaching Theranos, Priya Baskaran

Tennessee Law Review

The story of Theranos and disgraced CEO Elizabeth Holmes highlights numerous missed opportunities for effective intervention by corporate counsel. In particular, the lawyers at Theranos served as weak gate-keepers who were easily steamrolled by a power-drunk entrepreneur. The dominant business law pedagogy contributes to this problem by emphasizing litigation mitigation as the primary function of corporate lawyers. This framing improperly minimizes the role and influence of transactional attorneys to the detriment of all involved. Law Professors can change this narrative through much needed pedagogical innovation. Currently, any innovation in business law courses centers on the incorporation of drafting and other …

Educating Robot-Proof Attorneys, Tammy Oltz

Faculty Scholarship

Technology, particularly that powered by Artificial Intelligence (AI), is disrupting the legal profession. In the coming years, lawyers who do not understand technology will face both ethical and professional risks. This year, the duty of technological competence marks its tenth anniversary. While lawyers are still learning what the duty means and what it will mean in the future, one thing is certain: those who ignore it could find themselves at risk of being on the wrong side of an ethics violation.

However, even without that regulatory obligation, lawyers who continue to ignore the current technological revolution put themselves at risk …

Subversive Legal Education:Reformist Steps Towardabolitionist Visions, Christina John, Russell G. Pearce, Aundray Jermaine Archer, Sarah Medina Camiscoli, Aron Pines, Maryam Salmanova, Vira Tarnavska

Fordham Law Review

Exclusivity in legal education divides traditional scholars, students, and impacted communities most disproportionately harmed by the legal education system. While traditional legal scholars tend to embrace traditional legal education, organic jurists—those who are historically excluded from legal education and those who educate themselves and their communities about their legal rights and realities—often reject the inaccessibility of legal education and its power. This Essay joins a team of community legal writers to imagine a set of principles for subversive legal education. Together, we—formerly incarcerated pro se litigants, paralegals for intergenerational movement lawyering initiatives, first-generation law students and lawyers, persons with years …
