Law Society Regulation And The Lawyer-Academic, Andrew Flavelle Martin
Law Society Regulation And The Lawyer-Academic, Andrew Flavelle Martin
Dalhousie Law Journal
Can, and should, law societies regulate and discipline lawyers for their teaching and research? This article explores these largely overlooked but critically important questions in order to establish a foundation for further debate and discussion by lawyers, legislators, and law societies. It argues that professionalism precludes only low-value teaching and research—teaching and research with little pedagogical or epistemic value such that it is unlikely or unworthy to be protected by academic freedom—and that any chilling effect on lawyer-academics comes as much from uncertainty as from actual danger of regulatory consequences. The author concludes that law societies and other stakeholders should …

Mindful Lawyering: A Pilot Study On Mindfulness Training For Law Students, Clifford Rosky, R. Lynae Roberts, Adam W. Hanley, Eric L. Garland
Utah Law Faculty Scholarship
Many US law schools are now offering elective courses in mindfulness training to alleviate disproportionately high levels of anxiety, depression, stress, and disordered alcohol use among law students. To date, empirical evidence on the effectiveness of these courses has been lacking. The aim of this pilot study was to explore the feasibility and impact of a 13-week mindfulness course, "Mindful Lawyering," specifically tailored to law students. The primary hypothesis was that mindfulness training would be significantly correlated with improvements in well-being and mindfulness.

The Science Of Legal Synthesis, Jennifer M. Cooper
The Science Of Legal Synthesis, Jennifer M. Cooper
St. John's Law Review
(Excerpt)
This Article applies scientific research to improve and systematize legal synthesis, a vital element of reasoning that spans legal analysis, legal education, and law practice. Despite its critical role in legal analysis, synthesis is poorly understood, hard to perform, and even harder to describe. Synthesis embodies a hidden curriculum that legal educators expect students to learn “by osmosis.” This lack of transparency frustrates both professor and student, rendering the skill difficult to teach, assess, and master.
This Article provides reliable methodologies to better understand how legal synthesis really works and how to actually perform it. Part I provides a …
Ethical Quagmires For Government Lawyers: Lessons For Legal Education, Susan Saab Fortney
Ethical Quagmires For Government Lawyers: Lessons For Legal Education, Susan Saab Fortney
Faculty Scholarship
Each presidential administration faces its own challenges related to the ethics of government officials and lawyers. What distinguished the Trump presidency was the steady stream of news reports that related to controversies involving government lawyers. In examining various controversies, this Essay argues that the ethical standards applicable to government lawyers are often thorny and debatable. Fortney discusses how controversies involving alleged misconduct by government lawyers reveal the range and complexity of ethical dilemmas that government lawyers encounter. This Essay asserts that legal educators should do more to empower government lawyers to deal with such ethics issues. To highlight key ethics …

The Black-White Paradigm’S Continuing Erasure Of Latinas: See Women Law Deans Of Color, Laura M. Padilla
Faculty Scholarship
The Black-white paradigm persists with unintended consequences. For example, there have been only six Latina law deans to date with only four presently serving. This Article provides data about women law deans of color, the dearth of Latina law deans, and explanations for the data. It focuses on the enduring Black-white paradigm, as well as other external and internal forces. This Article suggests how to increase the number of Latina law deans and emphasizes why it matters.
Are Law Schools Cream-Skimming To Bolster Their Bar Exam Pass Rates?, Jason M. Scott, Josh Jackson
Are Law Schools Cream-Skimming To Bolster Their Bar Exam Pass Rates?, Jason M. Scott, Josh Jackson
AccessLex Institute Research
Law schools are held accountable on many fronts to achieve and maintain high bar passage rates. ABA Standard 316 is likely the strongest accountability measure. While the course of legal education itself, along with academic and bar success interventions, is a key driver of bar exam performance, Bahadur et al. suggests that other, obscure institutional practices can serve to inflate institutional bar passage performance. Such practices could include recruitment and admission of transfer students and academic attrition. We examine this hypothesis to assess the influence of both attrition and transfer on law schools’ bar passage rates.
The Foundational Skill Of Reflection In The Formation Of A Professional Identity, Neil W. Hamilton
The Foundational Skill Of Reflection In The Formation Of A Professional Identity, Neil W. Hamilton
St. Mary's Journal on Legal Malpractice & Ethics
There is a growing scholarly literature on the professional development and formation of law students into the core values, guiding principles, and well-being practices considered foundational to successful legal practice.* This growing scholarly literature can guide effective curriculum development to foster student growth toward later stages of development on these learning outcomes. This Article focuses on the skill of reflection as one of the most effective curricular strategies to foster each student’s growth toward later stages of these learning outcomes. This same curricular strategy will also be effective in engaging practicing lawyers to grow toward these same goals. Part II …

Law Firm Dynamics: Don’T Hate The Player, Hate The Game, Tom Kimbrough
SMU Law Review Forum
This paper concerns the business of law, a subject ignored by legal academia and sugarcoated by the organized bar. If law professors express little or no interest in this subject, their students most certainly do. Indeed, I have found that students are desperately hungry for information on the day-to-day realities of working in a law firm. Students are especially keen to learn about possible paths for career advancement within firms, across them, or across the organizations served by the firms.
Paths for career advancement do exist, but they are not easy to find or pursue. Law firms are hardly going …
Protecting The Guild Or Protecting The Public? Bar Exams And The Diploma Privilege, Milan Markovic
Protecting The Guild Or Protecting The Public? Bar Exams And The Diploma Privilege, Milan Markovic
Faculty Scholarship
The bar examination has long loomed over legal education. Although many states formerly admitted law school graduates into legal practice via the diploma privilege, Wisconsin is the only state that recognizes the privilege today. The bar examination is so central to the attorney admissions process that all but a handful of jurisdictions required it amidst a pandemic that turned bar exam administration into a life-or-death matter.
This Article analyzes the diploma privilege from a historical and empirical perspective. Whereas courts and regulators maintain that bar examinations screen out incompetent practitioners, the legal profession formerly placed little emphasis on bar examinations …

Online Legal Help-Seeking For Victims Of Intimate Partner Violence During The Covid-19 Pandemic, Christina S. Walker
Online Legal Help-Seeking For Victims Of Intimate Partner Violence During The Covid-19 Pandemic, Christina S. Walker
Dignity: A Journal of Analysis of Exploitation and Violence
Legal, court, and criminal justice professionals regularly navigate court procedures and processes through online portals. They know where to locate applicable court rules, such as a specific section on a court website or a departmental contact. However, these tasks can be extremely daunting for laypersons seeking court assistance, especially for victims of violence who have limited time away from the abuser. To determine how state judicial branches make information available about protective order procedures and general information to a layperson, especially to victims of intimate partner violence, this study assessed court websites of five states where intimate partner violence (IPV) …

Appointing And Training Judges In Egypt And Comparative Systems, Moataz Muhammad Al-Saghir Aidaros
Theses and Dissertations
The topic of the paper is very important, as it comes up at a time when the Egyptians have come to a point that reforming Egypt’s justice system is a hopeless case. This is due to the outdated and inefficient way of thinking and performing in the judiciary. Thus the goal of this paper is to make an intellectual contribution to a sustainable reform program of the Egyptian judiciary and namely the systems of judicial appointment and judicial training using their roles as agents of progress and development. This aspiring research argues that the Higher Council of Judicial Entities and …

Lawyers That (Say They) Listen: An Exploratory Study Into Law Firms With Listening Specific Branding, Kacey Henriques
Lawyers That (Say They) Listen: An Exploratory Study Into Law Firms With Listening Specific Branding, Kacey Henriques
Honors Theses
The following investigation attempts to explore the communication dynamics between law firms and their clients. As shown in this research, clients tend to make note of poor communication skills, specifically listening skills, when they interact with attorneys. In an attempt to appeal to clients who have had negative interactions in respect to listening, several law firms across the country are utilizing branding that stresses their strengths in listening (what I term listening specific branding). In the investigation to come, three law firms are analyzed that utilize this type of branding. Additionally, three law firms that specialize in similar areas of …
