International Water Law For The 21st Century: The Contribution Of The U.N. Convention, Stephen C. Mccaffrey

In May, 1997, the United Nations General Assembly adopted the Convention on the Law of the Non- Navigational Uses of International Watercourses, a treaty that largely codifies the general principles of international water law. While not entirely free from controversy, the Convention has already been influential and will doubtless continue to be well into the 21st century. This paper provides an overview of the Convention, comments on some of its salient provisions, and considers its future influence.

This article seeks to stimulate the nascent discussion on legal questions presented by access to, and use of, deep-sea hydrothermal vent sites and resources and to help guide ocean policy analysts in their efforts to formulate and implement appropriate conservation and management measures adapted to the unique multiple-use conflicts posed by the vent phenomena. The inquiry is timely and important for the vent communities, some of which are already showing signs of the human footprint—a footprint that may in the not too distant future include the tracks of submarine bulldozers as they set about the job of seabed mining.

The UN Convention on the Law of the Sea balances the interests of states in ways that are more refined than the classic summa divisio between the free high seas and territorial waters. The result for aviation is the preservation of freedom of overflight for civil and military aircraft seaward of the territorial sea in the exclusive economic zone as on the high seas beyond, and the right of such aircraft to transit archipelagic waters as well as straits comprised of territorial seas and internal waters. In this Article, Mr. Feeley, provides an introduction to the Taiwanese environmental regulatory scheme emerging from Taiwan's unique circumstances (economic influence and ecological crises) and the potential economic impact that may result. The author reviews the development of the centuries-old colony into an independent and powerful state. He then provides an overview of the specific environmental laws, regulations and policies already in place and previews those being developed. In this Article, Messrs. Silva and Dunn demonstrate that the intended Free Trade Agreement (FTA) between the United States and Mexico is a natural and necessary step in the two countries' economic relations. Their approach is to trace the steps which have led to the FTA and to analyze the evolution and progression of Mexican economic, legal, and political polices which have reached a point permitting and necessitating a trade pact. This thesis examines the management of marine living resources in international law. The thesis considers the development of the two principal approaches to fisheries management. The first approach is based upon maximising the yield of particular stocks, and is reflected in the content of the 1982 United Nations Convention on the Law of the Sea. It has evolved out of fisheries management theory developed since the 1950s, and focuses upon extracting the maximum harvest of a particular stock while still permitting that stock's biological regeneration.
