Breaking The Ice: China And Lawfare In The Arctic, Sophia Toner

This thesis examines China's engagement with international legal frameworks in the Arctic through a lawfare lens, using a structured analytical framework to assess whether Chinese activities constitute lawfare. Focusing on two key cases—China's involvement in submarine cable infrastructure and its navigation of the Northern Sea Route—the research applies Andrea Beck's three-part definition of lawfare: "(1) the misuse of the law in order to, (2) achieve a military objective, and (3) undermine the legal framework." The analysis reveals that China's Arctic engagement does not fully constitute lawfare according to this definition. Rather than misusing legal frameworks, China operates within existing structures …

The International Maritime Organization (IMO) plays a pivotal and essential role in international maritime governance, providing a forum for nation states to develop and agree to international standards for maritime safety and security and the protection of the marine environment. IMO is widely perceived to be one of the most successful universal international organizations (IOS), because of the high technical quality of the conventions and other legal instruments it develops, and the near-universal acceptance of most of those instruments. Seabed mining is governed by the United Nations Convention on the Law of the Sea, the Agreement relating to the Implementation of Part XI of the United Nations Convention on the Law of the Sea of 10 December 1982, the Mining Code, domestic laws of member states, and international law. The central tenets of seabed mining law are to develop the industry in accordance with the Common Heritage of Mankind, provide equitable sharing of financial and economic benefits derived from seabed mining activities, and protect and preserve the marine environment. This dissertation discusses the mobility politics of container shipping and argues that technological development, political-economic order, and social infrastructure co-produce one another. Containerization, the use of standardized containers to carry cargo across modes of transportation that is said to have revolutionized and globalized international trade since the late 1950s, has served to expand and extend the power of international coalitions of states and corporations to control the movements of commodities (shipments) and labor (seafarers). The advent and development of containerization was driven by a sociotechnical imaginary and international social contract of seamless shipping and cargo flows. In practice, this liberal, …

The 1982 United Nations Convention on the Law of the Sea (LOSC) seeks to reconcile competing interests in marine scientific research (MSR) within areas under national jurisdiction through the consent regime. Amidst the heightened focus on the limited capacity of Small Island Developing States (SIDS) to undertake the necessary MSR to maintain their livelihoods, it has been suggested that the consent regime for MSR could offer support in enhancing the scientific and technological capabilities of SIDS. The impacts of climate change have compelled humanity to produce innovative ways of counteracting this phenomenon. Marine geoengineering technologies are regarded as an avenue to forestall climate change. However, these technologies pose a danger to the environment and threaten the survival of living organisms and humanity. The deployment of these technologies could exacerbate the adverse impacts that climate change has on the environment. This thesis examines how multimodal transport can play a role in achieving the objectives of the African Continental Free Trade Area (AfCFTA). The thesis argues that multimodal transport is cheaper compared with unimodal transportation. While there are a number of issues affecting the operationalisation of multimodal transport in Africa, this study considers, at its core, the legal regimes and other fragmented institutional and governance frameworks of multimodal transport in West Africa. The fragmentation of the legal framework governing multimodal transport leads to uncertainty and unforeseeability of the liability of parties involved in multimodal transport, consequently leading to increased legal costs. …

Keeping out invasive species may, upon first review, seem like a trivial environmental cry from ecologists and deep environmentalists; a belated wish to return to an undeveloped world where nature was pristine. However invasive species create problems that impact all of us and can have far more severe consequences than changing a stunning landscape. These problems are heightened in islands like Hawaii, where the fragile ecosystems have developed over centuries of evolution and adaptation. The United Kingdom Insurance Act 2015 entered into force on 12 August 2016. It introduced major changes to some provisions of the Marine Insurance Act 1906 which has been the principal model for establishing marine insurance law and practice not only in common law jurisdictions, but also in some civil law countries. The main areas of change are the duty of fair presentation, warranties, insurer’s remedies for fraudulent claims and damages for the late payment of claims.
