The Story Of The Steel Seizure Case, Patricia L. Bellia

In 1952, during the Korean War, President Truman seized control of American steel mills to prevent a strike that threatened the war effort. This action, prompted by a labor dispute between steelworkers and operators, led to a landmark Supreme Court case, Youngstown Sheet & Tube Co. v. Sawyer. The Court ultimately ruled that the President lacked the authority to seize the steel mills without explicit congressional authorization, establishing limits on presidential power.

This is a brief contribution to an issue of The Federal Sentencing Reporter directed to criminal justice policy discussions relevant to the 2008 election season. The United States Department of Justice is a uniquely valuable domestic institution. After a period of stunning ascendancy at the end of the last century, the institution has faltered—perhaps as much from strategic neglect as from deliberate diversion of its mission in service of political and foreign policy objectives that most Americans have concluded were misguided. Agency Burrowing: Entrenching Policies And Personnel Before A New President Arrives, Nina A. Mendelson

This Article examines executive branch agency actions concluded just before a new President takes office, such as "midnight" rulemaking and late-term hiring and promotion, which Professor Mendelson collectively refers to as "agency burrowing." Congress, the media, and some commentators have portrayed such activities as unsavory power grabs that undermine the President-elect's ability to direct the functions of administrative agencies. Rather than dismissing agency burrowing out of hand, however, Professor Mendelson argues for a more nuanced approach. In some cases, burrowing can make positive contributions to the democratic responsiveness of agencies, agency accountability, and the "rule of law." A fuller analysis …
