Over the last forty years, legal theory and policy advice have come to draw heavily from an ‘evolutionary’ jurisprudence that explains legal transformation by drawing inspiration from the theoretical successes of Darwinian natural selection. This project seeks to enrich and critique this tradition using an analytical perspective that emphasizes the material consequences of concepts and ideas. Existing theories of legal evolution depend on a positivist epistemology that strictly distinguishes the objects of social life — interests, institutions, systems — from knowledge about those objects. Damage awards for pain and suffering and punitive damages are notoriously unpredictable. Courts provide minimal, if any, guidance to jurors determining these awards, and apply similarly minimal standards in reviewing them. Lawmakers have enacted crude measures, such as damage caps, aimed at curbing award unpredictability, while ignoring less drastic alternatives that involve guiding jurors with information regarding damage awards in comparable cases (“comparable‐case guidance” or “prior‐award information”). The primary objections to the latter approach are based on the argument that, because prior‐award information uses information regarding awards in distinct cases, it introduces the possibility of biasing the award, or distorting …

The problems of American Indian poverty and reservation living conditions have inspired various explanations. One response advanced by some economists and commentators, which may be gaining traction within the Trump Administration, calls for the “privatization” of Indian lands. Proponents of this view contend that reservation poverty is rooted in the federal Indian trust arrangement, which preserves the tribal land base by limiting the marketability of lands within reservations. In order to maximize wealth on reservations, policymakers are advocating for measures that would promote the individuation and alienability of tribal lands, while diminishing federal and tribal oversight.

ปัจจุบันอุตสาหกรรมภาพยนตร์ถือเป็นอุตสาหกรรมขนาดใหญ่ที่สร้างรายได้และกระตุ้น เศรษฐกิจในระดับนานาชาติ ซึ่งประเทศไทยเองก็ได้รับผลกระทบจากขยายตัวอย่างต่อเนื่องของ อุตสาหกรรมภาพยนตร์เช่นกัน ดังนั้นการศึกษานี้ จึงมีวัตถุประสงค์เพื่อศึกษาด้านมาตรการส่งเสริม และสิทธิประโยชน์ของประเทศไทย ที่มอบให้กับภาพยนตร์ที่ได้รับอนุญาตให้เข้ามาถ่ายท าในประเทศ ไทยของกองถ่ายภาพยนตร์ต่างประเทศ ซึ่งส่งผลต่อการตัดสินใจเข้ามาลงทุนในระยะยาวของกองถ่าย ภาพยนตร์ต่างประเทศและนักลงทุน โดยเปรียบเทียบกับมาตรการส่งเสริมและสิทธิประโยชน์ของ ประเทศมาเลเซีย และประเทศสิงคโปร์ ในการศึกษาครั้งนี้ เป็นการรวบรวมข้อมูลและสรุปเกี่ยวกับ แนวทางปฏิบัติ ข้อก าหนด สิทธิที่ ได้รับ รวมทั้งประเด็นปัญหาที่ส าคัญ ได้แก่ ขั้นตอนที่ซับซ้อนและระยะเวลาที่ยาวนานในการติดต่อ ด าเนินการกับแต่ละหน่วยงาน นโยบายและมาตรการส่งเสริมที่มีในปัจจุบันไม่เพียงพอ นโยบายและ มาตรการส่งเสริมที่มีในปัจจุบันไม่ครอบคลุมอุตสาหกรรมภาพยนตร์และลิขสิทธิ์ในภาพยนตร์ที่ กระทบต่อการส่งเสริม ซึ่งปัญหาเหล่านี้ส่งผลต่อการตัดสินใจเข้ามาลงทุนถ่ายท าภาพยนตร์ ต่างประเทศเป็นอย่างมาก จากการศึกษาข้อมูลของประเทศมาเลเซียและประเทศสิงคโปร์ พบว่าทั้งสองประเทศมีมาตรการ ส่งเสริมฯ และสิทธิประโยชน์ที่มอบให้กับกองถ่ายภาพยนตร์ต่างประเทศและนักลงทุนหลายมาตรการ ซึ่งแต่ละมาตรการประสบความส าเร็จในการดึงดูดกองถ่ายภาพยนตร์ต่างประเทศและนักลงทุนเป็น อย่างมาก ดังนั้นประเทศไทยจึงน ามาตรการที่ประสบผลส าเร็จของทั้งสองประเทศ มาพัฒนาต่อยอด และปรับใช้เป็นแนวทางแก้ไขปัญหา ได้แก่ การปรับปรุงและจัดระเบียบโครงสร้างหน่วยงาน One Stop Service ให้มีประสิทธิภาพมากขึ้น การพิจารณาก าหนดมาตรการใหม่และเพิ่มเติมสิทธิ ประโยชน์ของมาตรการส่งเสริมฯ ที่มีอยู่ในปัจจุบัน การจัดตั้งกองทุนหรือให้การสนับสนุนเงินลงทุนใน การเข้ามาถ่ายท าภาพยนตร์และการพิจารณาลิขสิทธิ์ของภาพยนตร์ที่ส่งผลต่อการลงทุนถ่ายท าใน ประเทศไทย เพื่อเอื้อประโยชน์แก่กองถ่ายภาพยนตร์ต่างประเทศและนักลงทุน เป็นการดึงดูดการเข้า มาถ่ายท าภาพยนตร์ และป้องกันการเสียโอกาสที่กระทบต่อเศรษฐกิจของประเทศ นอกจากนี ้ควรเพิ่มความส าคัญด้านมาตรการส่งเสริมการถ่ายท าภาพยนตร์ต่างประเทศในประเทศไทย ทั ้งจาก หน่วยงานรัฐบาลและหน่วยงานเอกชน รัฐบาลควรให้ความสนับสนุนหน่วยงานเอกชนที่มีความเกี่ยวข้องกับการ เข้ามาถ่ายท าภาพยนตร์ของกองถ่ายภาพยนตร์ต่างประเทศและนักลงทุน และส่งเสริมการประชาสัมพันธ์ ภาพลักษณ์ของประเทศและข้อมูลที่ส าคัญแก่กองถ่ายภาพยนตร์ต่างประเทศ นักลงทุน และผู้ที่สนใจ เพื่อให้ ประเทศไทยเป็นประเทศแนวหน้าในการเป็นสถานที่ถ่ายท าและลงทุนด้านภาพยนตร์ซึ่งส่งผลต่อภาพลักษณ์ที่ดี และยังเป็นการกระตุ้นเศรษฐกิจของประเทศอีกด้วย

เอกัตศีกษาฉบับนี้มีวัตถุประสงค์เพื่อศึกษาหามาตรการทางกฎหมายที่เหมาะสมในการ ส่งเสริมเศรษฐกิจชุมชนในเขตเศรษฐกิจพิเศษของประเทศไทย ด้วยวิธีการศึกษาและวิจัยเชิงคุณภาพ โดยการรวบรวมข้อมูลเชิงเอกสารทั้งแบบปฐมภูมิและทุติยภูมิ เกี่ยวกับร่างพระราชบัญญัติเขต เศรษฐกิจพิเศษ พ.ศ. ... และประเด็นปัญหาเกี่ยวกับเศรษฐกิจชุมชน ความเป็นมา แนวคิด และ ตัวอย่างของเศรษฐกิจชุมชน มาตรการในการส่งเสริมเศรษฐกิจชุมชนในเขตเศรษฐกิจพิเศษของ สาธารณรัฐประชาชนจีน รวมทั้งปัญหาและผลกระทบของการไม่มีการส่งเสริมเศรษฐกิจชุมชนในเขต เศรษฐกิจพิเศษของไทย แล้วจึงได้น าข้อมูลที่ได้ศึกษามารวบรวม และวิเคราะห์ โดยการศึกษา มาตรการต่างๆ ในการส่งเสริมเศรษฐกิจชุมชนในเขตเศรษฐกิจพิเศษของสาธารณรัฐประชาชนจีน และน ามาตรการของสาธารณรัฐประชาชนจีนมาปรับใช้ให้เหมาะสมกับบริบทของประเทศไทย จากการศึกษาพบว่า “ร่างพระราชบัญญัติเขตเศรษฐกิจพิเศษ พ.ศ. ...” ที่รัฐบาลมีความ พยายามจะประกาศใช้ ถูกต่อต้านจากภาคประชาชนโดยเฉพาะคนในพื้นที่ สาเหตุมาจากการที่ ประชาชนในท้องถิ่นถูกริดรอนอำนาจและสิทธิในการจัดการทรัพยากรธรรมชาติและสิ่งแวดล้อม รวมถึงวิถีชีวิตความเป็นอยู่ของคนในชุมชน รวมถึงการที่ประชาชนไม่รู้สึกถึงการมีส่วนร่วมและการ เป็นเจ้าของ โดยมีประเด็นปัญหาที่สำคัญ 3 ประการคือ (1) ปัญหาจากการกำหนดนโยบายที่ไม่ได้ตั้ง ต้นจากชุมชน (2) ปัญหาจากการบริหารงานแบบรวมศูนย์อำนาจ ชุมชนไม่มีอำนาจการตัดสินใจ (3) ปัญหาจากการขาดการมีส่วนร่วมของประชาชนในพื้นที่ต่อการกำหนดนโยบายที่เป็นของตนเอง จากปัญหาที่กล่าวมานี้ทำให้กฎหมายเขตเศรษฐกิจพิเศษของประเทศไทยยังไม่ถูกประกาศใช้ โดยผลการศึกษาพบว่า สาธารณรัฐประชาชนจีนเป็นประเทศที่ประสบความสำเร็จในการ จัดตั้งเขตเศรษฐกิจพิเศษเป็นอย่างมาก โดยปัจจัยแห่งความสำเร็จ คือ (1) รัฐบาลมีนโยบายการ ดำเนินงานลักษณะจากล่างขึ้นบน (Top - Down) (2) มีรูปแบบการบริหารงานแบบกระจายอำนาจ (Decentalization) และ (3) มีนโยบายให้ชุมชนมีส่วนร่วมในการกำหนดนโยบายที่เป็นของตนเอง นอกจากนี้แล้ว ภายใต้กฎหมายเขตเศรษฐกิจพิเศษของสาธารณรัฐประชาชนจีนยังมีบทบัญญัติในการ คุ้มครองแรงงานในพื้นที่ รวมถึงมีมาตรการที่สามารถสร้างความเชื่อมโยงทางเศรษฐกิจระหว่าง เศรษฐกิจท้องถิ่นและเศรษฐกิจในประเทศได้เป็นอย่างดี จึงท าให้การส่งเสริมเศรษฐกิจชุมชนในเขต เศรษฐกิจพิเศษของสาธารณรัฐประชาชนจีนประสบความส าเร็จอย่างสวยงาม เมื่อเปรียบเทียบกับ ประเทศไทยแล้ว ผู้เขียนจึงได้เสนอแนวทางในการส่งเสริมเศรษฐกิจชุมชนในเขตเศรษฐกิจพิเศษของ ประเทศไทย โดยปรับเปลี่ยนมาตรการของรัฐ ดังนี้(1) กลไกในการกำหนดนโยบาย (2) กลไกในการ บริหารงาน (3) กลไกในการมีส่วนร่วมของชุมชน โดยรัฐบาลเป็นผู้ก ากับดูแล เพื่อช่วยลดการต่อต้าน จากภาคประชาชน และช่วยส่งเสริมให้เศรษฐกิจชุมชนในเขตเศรษฐกิจพิเศษประสบความส าเร็จ

Professor Sunstein (2017) discusses possible causes for and policy implications of the failure of nudges, with a special attention to defaults. Though he focuses on nudges that fail when they should succeed, Sunstein recognizes that some failures reveal that a nudge should not have been attempted to begin with. Canonical theories of law and economics predict that issuing firms in initial public offerings (IPOs) demand — and that competitive markets produce — a transaction structure that maximizes value to issuers. Yet, since 1980, corporate America has left approximately 19 cents of foregone proceeds on the table for every dollar it has raised in IPOs. การศึกษานี้มีจุดมุ่งหมายเพื่อศึกษาการแก้ไขปัญหาของประมวลรัษฎากรไทยในปัจจุบันที่ไม่มี ความยืดหยุ่นในหลักเกณฑ์ของการตัดจําหน่ายและการคํานวณค่าเสื่อมของสินทรัพย์ที่มีมูลค่าน้อย โดยศึกษาหลักเกณฑ์ในเรื่องดังกล่าวของกฎหมายของประเทศมาเลเซียและสิงคโปร์ ซึ่งมีการกําหนด ในกฎหมายอย่างชัดเจนและเป็นการช่วยลดภาระแก่ผู้ประกอบการในการปรับปรุงรายการเพื่อ คํานวณกําไรสุทธิในการเสียภาษีเงินได้นิติบุคคล อันสอดคล้องกับหลักการภาษีอากรที่ดีในเรื่อง ความ ยืดหยุ่นและหลักการบริหารที่ดี จากการศึกษาพบว่า ประมวลรัษฎากรไทยยึดถือในหลักกรรมสิทธิ์และหลักประโยชน์ใช้สอย เท่านั้น โดยยังไม่มีบทบัญญัติใดอนุโลมให้ปฏิบัติตามหลักการบัญชีที่รับรองทั่วไปในหลักความมี นัยสําคัญ จึงทําให้ยังมีประเด็นปัญหาที่สําคัญในการตัดจําหน่ายและคํานวณค่าเสื่อมราคาของ สินทรัพย์ที่มีมูลค่าน้อยอยู่ 3 ประการ คือ (1) ประมวลรัษฎากรไม่มีหลักเกณฑ์ข้อผ่อนปรนสําหรับ สินทรัพย์ที่มีมูลค่าน้อยเฉกเช่นเดียวกับหลักการบัญชีที่รับรองทั่วไป (2) แนวปฏิบัติของกรมสรรพากร ไม่สะท้อนความเป็นจริงของการมีอยู่ของทรัพย์สิน และ (3) ต้นทุนในการปรับปรุงรายการในการ คํานวณกําไรสุทธิเพื่อเสียภาษีตามเงื่อนไขการคํานวณกําไรสุทธิตามมาตรา 65 ตรี(รายจ่ายต้องห้าม) เกี่ยวกับรายจ่ายอันมีลักษณะเป็นการลงทุน อาจจะสูงเกินกว่าประโยชน์ที่จะได้รับจากการปฏิบัติให้ ถูกต้องตามประมวลรัษฎากร ซึ่งปัญหาทั้ง 3 ประการนี้ ถือเป็นการสร้างภาระเกินจําเป็นแก่ ผู้ประกอบการและยังไม่สอดคล้องกับหลักการภาษีอากรที่ดีอีกด้วย เมื่อเปรียบเทียบกับหลักการเกณฑ์การตัดจําหน่ายและการคํานวณค่าเสื่อมราคาของ สินทรัพย์ที่มีมูลค่าน้อยของประเทศมาเลเซียและสิงคโปร์ พบว่ากฎหมายของทั้ง 2 ประเทศมีการ กําหนดหลักเกณฑ์ในเรื่องดังกล่าวอย่างชัดเจน รวมทั้งมีตัวอย่างการคํานวณและใช้สิทธิอย่างละเอียด ซึ่งเป็นการช่วยอํานวยความสะดวกและเป็นทางเลือกให้แก่ผู้ประกอบการในการคํานวณและตัด จําหน่ายค่าเสื่อมราคาเป็นค่าใช้จ่ายทางภาษี ดังนั้น ประเทศไทยจึงควรนําแนวทางดังกล่าวมาปรับใช้ เพื่อเป็นการพัฒนาหลักเกณฑ์ในประมวลรัษฎากรไทยให้สอดคล้องกับหลักการภาษีอากรที่ดีและ อํานวยความสะดวกแก่ผู้ประกอบการ ผู้เขียนได้เสนอแนะแนวทางในการนําหลักเกณฑ์ของต่างประเทศมาปรับใช้ในประเทศไทย เพื่อแก้ปัญหาทั้ง 3 ประการที่กล่าวมาข้างต้น โดยผู้เขียนเห็นว่าวิธีการดังกล่าวมีความเหมาะสมและ ควรปรับปรุง สามารถประยุกต์ใช้กับประเทศไทยได้ ซึ่งจะทําให้เกิดความชัดเจนในประมวลรัษฎากร ไทย และเป็นการช่วยบรรเทาภาระภาษีแก่ผู้ประกอบการ อีกทั้งยังเป็นการส่งเสริมให้เกิดการลงทุนใน สินทรัพย์ใหม่ของกิจการ และช่วยให้กระแสเงินสดมีความคล่องตัวมากขึ้น

เอกัตศึกษานี้มีวัตถุประสงค์เพื่อศึกษามาตรการคุ้มครองผู้บริโภคในการใช้บริการธุรกิจรับส่ง พัสดุภัณฑ์โดยเอกชน เนื่องจากมาตรการคุ้มครองผู้บริโภคในการใช้บริการธุรกิจรับส่งพัสดุภัณฑ์ใน ปัจจุบันยังไม่มีกฎหมายใดเป็นการเฉพาะในการก ากับดูแลหรือควบคุมท าให้ผู้บริโภคเสียเปรียบและ ไม่ได้รับความเป็นธรรม จึงสมควรกำหนดแนวทางหรือบทบัญญัติของกฎหมายในการคุ้มครอง ผู้บริโภคในการใช้บริการธุรกิจรับส่งพัสดุภัณฑ์ การเปลี่ยนแปลงของพฤติกรรมผู้บริโภคจากในยุคดิจิทัล มีแนวโน้มการซื้อขายสินค้าและ บริการเปลี่ยนรูปแบบจากเดิมที่เป็นการซื้อขายแบบหน้าร้าน สู่ยุคการตลาดแบบออนไลน์ โดยการซื้อ สินค้าผ่าน แพลตฟอร์มออนไลน์ การขยายตัวของธุรกิจ e-Commerce ส่งผลให้ความต้องการ บริการ E-Logistics เพิ่มขึ้น มูลค่าการประกอบธุรกิจแบบการขายสินค้าหรือบริการไปยังผู้บริโภค โดยตรงมีมากขึ้น ส่งผลให้การจัดตั้งธุรกิจรับส่งพัสดุภัณฑ์มีการเติบโตเพิ่มขึ้นอย่างต่อเนื่อง แม้ว่าใน ปัจจุบัน ผู้ประกอบการแต่ละรายมีการแข่งขันกันในด้านราคาเพื่อดึงดูดผู้บริโภค ซึ่งอัตราค่าบริการ ขนส่งพัสดุโดยเฉลี่ยมีการปรับลดลงในแต่ละปี รวมถึงการแข่งขันกันด้านบริการและความรวดเร็วใน การจัดส่งพัสดุภัณฑ์ แต่ก็ยังปรากฏปัญหาของผู้บริโภคซึ่งมีการร้องทุกข์เกี่ยวกับการใช้บริการรับส่ง พัสดุภัณฑ์ต่อส านักงานคุ้มครองผู้บริโภคเพิ่มขึ้นในทุกปี และปัญหาอื่นๆขึ้นตามที่ปรากฏเป็นข่าวทาง สื่อต่างๆ จากผลการศึกษาพบว่าธุรกิจบริการรับส่งพัสดุภัณฑ์โดยเอกชนนั้น กฎหมายที่มีผลบังคับใช้ ในปัจจุบันไม่ได้ครอบคลุมถึงการกำกับดูแลกิจการซึ่งก าลังเติบโตขึ้นอย่างรวดเร็ว ผู้เขียนจึงศึกษา กฎหมายภายในประเทศเกี่ยวกับมาตรฐานการคุ้มครองผู้บริโภคเพื่อหาแนวทางที่เหมาะสม เพื่อกำหนดมาตรการทางกฎหมายที่เหมาะสมในการคุ้มครองผู้บริโภคในการใช้บริการรับส่ง พัสดุภัณฑ์โดยเอกชน ในลักษณะเป็นการป้องกันปัญหาและลดความเสี่ยงที่อาจถูกเอาเปรียบจาก ผู้ประกอบการ ผู้เขียนเสนอให้ การประกอบธุรกิจรับส่งพัสดุภัณฑ์โดยเอกชน อยู่ในการกำกับดูแลของ กระทรวงดิจิทัลเพื่อเศรษฐกิจและสังคมเป็นหน่วยงานหลัก และเสนอให้มีการแก้ไขเพิ่มเติม พระราชบัญญัติไปรษณีย์พ.ศ. 2477 ให้มีการก าหนดบทบัญญัติทางกฎหมายที่จะก ากับดูแลการ ดำเนินธุรกิจของผู้ประกอบการทั้งของรัฐเอกชนให้เป็นไปในแนวทางเดียวกัน

After Jeffrey Epstein committed suicide in jail, two judges allowed his accusers to speak in court. This article argues that the proceedings were inappropriate because the criminal case ends when the defendant dies. If the conviction and appeal are not final, there is no finding of guilt, and the defendant is still presumed innocent. Allowing accusers to speak at this time violates the principle of due process and threatens to undermine faith in judges and the criminal justice system in general. The optimal response to a financial crisis entails addressing two, often conflicting, demands: stopping the panic and starting the clock. When short-term depositors flee, banks can be forced to sell assets at fire-sale prices, causing credit to contract and real economic activity to decline. To reduce these adverse spillover effects, policymakers routinely intervene to stop systemic runs. สังคมผู้สูงอายุเป็นหนึ่งในปัญหาที่ทุกประเทศทั่วโลกก าลังประสบปัญหาและต้องเตรียมมาตรการ เพื่อรองรับสถานการณ์ที่จะเกิดขึ้นกับสังคมผู้สูงอายุในอนาคต ประเทศไทยก็เป็นประเทศหนึ่งที่มีอัตราการ เพิ่มขึ้นของผู้สูงอายุอย่างต่อเนื่อง คาดการณ์กันว่าอีกประมาณ 20 ปีผู้สูงอายุของประเทศไทยจะมีอัตราส่วน ประมาณ 40 ท าให้ธุรกิจให้บริการดูแลผู้สูงอายุมีการเติบโตอย่างต่อเนื่อง อย่างไรก็ตามจากการศึกษาวิจัย พบว่ามาตรการทางกฎหมายในการควบคุมดูแลสถานประกอบการที่ให้บริการดูแลผู้สูงอายุยังไม่มีมาตรการ ทางกฎหมายที่มีความชัดเจนเพื่อให้ธุรกิจบริการดูแลผู้สูงอายุมีมาตรฐานและมีความปลอดภัยต่อผู้สูงอายุ เมื่อพิจารณาบทบัญญัติตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2560 ได้ก าหนดมาตรการ ในการดูแลคุณภาพชีวิตของผู้สูงอายุไว้อย่างชัดเจน แต่เมื่อพิจารณาในการออกกฎหมาย หรือกฎระเบียบ ที่เกี่ยวข้องกับการควบคุมดูแลกิจการดูแลผู้สูงอายุของประเทศไทยยังพบว่าประเทศไทยยังต้องมีการบัญญัติ กฎหมายที่มีความเฉพาะเจาะจงในการควบคุมดูแลสถานประกอบการที่ให้บริการดูแลผู้สูงอายุดังนั้นงานวิจัย ฉบับนี้จึงเสนอให้มีการก าหนดนโยบายที่ชัดเจนในการควบคุมกิจการที่เกี่ยวข้องกับดูแลผู้สูงอายุทั้งในส่วน ของภาครัฐและภาคเอกชนโดยการก าหนดมาตรฐานกลางที่เกี่ยวข้องกับการดูแลผู้สูงอายุให้สถานประกอบการ ที่ประกอบธุรกิจต้องปฏิบัติตามและเป็นเงื่อนไขที่ส าคัญในการขออนุญาตประกอบธุรกิจรายการต่อใบอนุญาต โดยมุ่งเน้นที่การคุ้มครองสิทธิของผู้สูงอายุและการดูแลผู้สูงอายุให้มีความปลอดภัยและได้รับการดูแลในระดับ ที่มีมาตรฐานสากล รวมไปถึงการน ามาตรการที่ส่งเสริมธุรกิจการดูแลผู้สูงอายุให้ได้รับการรับรองและ สร้างความเชื่อมั่นส าหรับผู้ใช้บริการทั้งคนไทยและชาวต่างชาติเพื่อให้กิจการดูแลผู้สูงอายุในประเทศไทย มีประสิทธิภาพในการแบ่งเบาภาระกิจในการดูแลผู้สูงอายุและน ารายได้เข้าสู่ประเทศไทย เพื่อใช้ใน การแบ่งเบาภาระของรัฐในการดูแลผู้สูงอายุและพัฒนาระบบเศรษฐกิจไทยต่อไป

More than 25 years ago the multilateral development banks (MDBs) began establishing independent accountability mechanisms (IAMs), such as the World Bank’s Inspection Panel, to address concerns about MDB accountability to those communities and groups who were harmed by their decisions and actions. This essay argues that these mechanisms need updating. In the interests of promoting new and creative thinking about these mechanisms, it makes an ambitious two-part proposal designed to improve the efficacy of the IAMs, while also respecting the sovereignty of their member states and protecting an appropriate level of immunity for the MDBs. Consumers are more likely to keep a repayment promise they make themselves. When a scheduling conflict prevents a borrower from attending a mortgage closing, a power of attorney (POA) empowers a third party to promise that the borrower will repay the loan. On a matched sample of POA and non-POA loans, and comparing within borrower and within property, I link POAs to greater delinquency and foreclosure. Although POAs are uncorrelated with cash flow shocks, they reflect reduced promise keeping when borrowers undergo financial distress. This association vanishes for originator-servicers’ loans, which suggests that financial intermediation plays a role in consumer …

While there is general consensus that copyright’s term is of legal and economic significance, arguments both for and against a lengthy term are often impressionistic. Many argue that paying people for good behavior can crowd out beneficial motivations like altruism. But little is known about how financial incentives interact with harmful motivations like racial bias. Two randomized vignette studies test how financial incentives affect bias. The first experiment varies the race of a hypothetical patient in need of a kidney transplant (black or white), an incentive ($18,500 or none), and addition of a message appealing to altruism. Incentives encouraged donation but introduced a significant bias favoring white patients. Money may not corrupt. But should we worry if it corrodes? Legal scholars in a range of fields have expressed concern about “motivational crowding-out,” a process by which offering financial rewards for good behavior may undermine laudable social motivations, like professionalism or civic duty. Disquiet about the motivational impacts of incentives has now extended to health law, employment law, tax, torts, contracts, criminal law, property, and beyond. For decades, corporate law played a pivotal role in regulating corporations across the United States. Consequently, Delaware, the leading state of incorporation, and its courts came to occupy a central and influential position in corporate law and governance. This, however, is no longer the case: The compositional shift in equity markets from retail to institutional ownership has relocated regulatory power over corporations from courts to markets. Corporate law has, as a result, and as illustrated by the declined role of the Delaware courts, lost its pride of place and is now eclipsed by shareholder activism.
