Since the passage of the Veterans Readjustment Act of 1952, private accrediting agencies have held the purse strings to all federal student aid. Today, six regional accrediting agencies and ten national accrediting agencies act as the gatekeepers of these federal monies. No college or university can access federal funds without receiving the imprimatur of one of these recognized accrediting agencies. Proponents of the current system of accreditation argue that the framework presently in place ultimately benefits both students and the public at large by fulfilling quality assurance and information signaling functions. Mental health treatment in state prisons is revealed to be highly variable, under-funded, and systematically inadequate. Existing literature exposes this injustice but fails to provide a comprehensive proposal for reform. This paper attempts to fill that gap, outlining a cost-effective, evidence-based treatment proposal, directly addressing the deficits in care revealed through analysis of our current system. In addition, this paper provides historical overviews of the prison system and mental health treatment, utilizing theoretical perspectives to contextualize this proposal in the present state of affairs. The July 2017 arrival of Taiwanese tech-giant Foxconn and the

establishment of the Wisconn Valley Science and Technology Park in Wisconsin

reflects a larger trend in the United States to reinvent the nation’s

manufacturing economy with high-tech production. High-tech employers have

substantial interests in retaining employees in order to protect their valuable

proprietary information and market share. Non-compete agreements, also

known as restrictive covenants or covenants not to compete, are often the legal

Since the turn of the century, investment treaty arbitration (ITA) tribunals have begun citing past decisions with increasing frequency. They do so despite the absence of any formal doctrine of stare decisis and the presence of structural obstacles to the use of precedent in this context. The puzzle of why the cycle of poverty persists and upward class mobility is so difficult for the poor has long captivated scholars and the public alike. Yet with all of the attention that has been paid to poverty, the crucial role of the law, particularly state and local law, in perpetuating poverty is largely ignored. This Article offers a new theory of poverty, one that introduces the concept of legal immobility. There is widespread belief that the Patent Office issues too many bad patents that impose significant harms on society. At first glance, the solution to the patent quality crisis seems straightforward: give patent examiners more time to review applications so they grant patents only to those inventions that deserve them. What are business entities for? What are security interests for? The prevailing answer in legal scholarship is that both bodies of law exist to partition assets for the benefit of designated creditors. But if both bodies of law partition assets, then what distinguishes them? In fact, these bodies of law appear to be converging as increasing flexibility irons out any differences. Since the end of the American Civil War, scholars have debated the efficacy of various models of community economic development, or CED. Historically, this debate has tracked one of two approaches: place-based models of CED, seeking to stimulate community development through market-driven economic growth programs, and people-based models of CED, focused on the removal of structural barriers to social and economic mobility that prevent human flourishing. More recently, scholars and policymakers have turned to a third model from the impact investing community—the social impact bond, or SIB. เนื่องจากสังคมปัจจุบันมีการยอมรับในเพศทางเลือกมากขึ้นจากในอดีต จึงทำให้ปัจจุบันมีการใช้ชีวิตในลักษณะคู่ชีวิตเพศเดียวกันมากขึ้นและมีแนวโน้มเพิ่มขึ้น โดยมีการใช้ชีวิตร่วมกันในรูปแบบชีวิตคู่ทั้งที่แสดงออกและไม่แสดงออก ตลอดจนการสร้างครอบครัวให้ปรากฏชัดในสังคม อันเป็นการเปลี่ยนแปลงสภาพทางสังคมและกรอบแนวความคิดเรื่องการยอมรับความหลากหลายทางเพศ จึงทำให้มีการเปลี่ยนแปลงบริบททางสังคมในเรื่องการใช้ชีวิตของกลุ่มเพศเดียวกันและเพศทางเลือกมากขึ้น โดยปรัชญาของนิติศาสตร์เองมีเพื่อตอบสนองปัญหาของสังคม ณ ขนะนั้นเนื่องจากสังคมมีพลวัตและเปลี่ยนแปลงตามกาลเวลา อย่างไรก็ตามเนื่องด้วยระบบฎหมายในประเทศไทยยังไม่มีกฎหมายรับรองสิทธิและหน้าที่ของคู่สมรสที่เป็นเพศเดียวกัน กล่าวคือ ตามประมวลกฎหมายแพ่งและพาณิชย์ บรรพ 5 กฎหมายลักษณะครอบครัว ไม่ได้บัญญัติรับรองถึงการสมรสของคู่ชีวิตเพศเดียวกัน จึงเป็นผลให้ไม่สามารถจดทะเบียนสมรสเพื่อให้มีผลผูกพันธ์ทางกฎหมายได้ ผลที่ตามมาก็คือบุคคลเหล่านี้ไม่ได้รับการรับรองในเรื่องสิทธิและหน้าที่ตามกฎหมาย และยังมีเรื่องของความไม่เท่าเทียมกันในการใช้ชีวิตคู่ของกลุ่มบุคคลดังกล่าว ทั้งนี้ทางหลักนิติศาตร์ยังไม่ได้มีการยอมรับอย่างเป็นรูปธรรม ในปัจจุบันประเทศไทยยังไม่มีกฎหมายที่รับรองสถานะของการเป็นคู่สมรส หรือกฎหมายที่ให้สิทธิคุ้มครองในการครองคู่แก่คนกลุ่มเพศทางเลือกแต่ประการใด ที่ผ่านมาได้มีการทำสำรวจเรื่อง “สังคมไทยคิดอย่างไรกับเพศที่ 3” จากนิด้าโพลเมื่อเดือนสิงหาคม พ.ศ. 2562 โดยผลการสำรวจพบว่า การยอมรับของประชาชนกรณีมีเพื่อนหรือเพื่อนร่วมงานในองค์กรเป็นเพศที่ 3 ร้อยละ 90.15 ระบุว่า ยอมรับได้ ในขณะที่ร้อยละ 7.78 ระบุว่าไม่สามารถยอมรับได้ ดังนี้แล้วจึงมีเหตุผลและความจำเป็นในการจัดทำเอกัตศึกษานี้เพื่อแสดงให้เห็นถึงประโยชน์ในเชิงเศรษฐศาสตร์ของการให้สิทธิต่าง ๆ ทางกฎหมายแก่บุคคลเพศทางเลือก ตลอดจนเหตุผลสนับสนุนการบังคับใช้พระราชบัญญัติคู่ชีวิต พ.ศ. ... อันจะทำให้กลุ่มเพศทางเลือกมีสิทธิ และบทบาททางสังคมที่เทียบเท่ากันกับบุคคลอื่นในสังคมอย่างแท้จริง ซึ่งจะเกิดผลกระทบในทางเศรษฐศาสตร์ในเชิงบวกโดยตรง ดังนั้น การยอมรับทางสังคมที่เป็นอยู่ในปัจจุบันยังไม่เพียงพอต่อการพัฒนาเศรษฐกิจแต่การยอมรับทางกฎหมายที่เกี่ยวกับการให้สิทธิต่าง ๆ จะสามารถส่งผลในทางบวกต่อการพัฒนาเศรษฐกิจได้ หลายคนอาจมองว่าการจดทะเบียนนั้นไม่สำคัญสำหรับคนสองคนจะเป็นครอบครัวเดียวกันแค่คนสองคนรักกันก็พอ แต่ถ้ามองถึงสิทธิของพลเมือง การจดทะเบียนสมรสควรเป็นสิทธิขั้นพื้นฐานที่ทุกคนพึงจะได้ นอกจากนี้ยังเป็นการยืนยันสิทธิและแสดงหน้าที่ของคนทั้งสองได้มากกว่าแค่ความรัก การจดทะเบียนสมรสอาจจะไม่ใช่สิ่งที่คู่รักทุกคู่ต้องการ ขึ้นกับความสมัครใจของคนสองคน แต่การจดทะเบียนสมรสเป็นสิ่งที่พลเมืองทุกคนก็ควรจะได้รับสิทธิในการจดทะเบียนที่เท่าเทียมกัน แต่บุคคลคนกลุ่มเพศทางเลือกนั้นยังไม่ได้รับสิทธินี้

แนวทางการพัฒนามาตรการทางกฎหมายเกี่ยวกับการส่งเสริมการลงทุนในอุตสหากรรม รถยนต์พลังงานไฟฟ้าของประเทศไทย : กรณีศึกษาประเทศจีน, ปิยรัชต์ เจริญลาภ

การค้นคว้าอิสระนี้มุ่งศึกษาแนวทางการพัฒนามาตรการทางกฎหมายส่งเสริมการลงทุน ในอุตสาหกรรมรถยนต์พลังงานไฟฟ้าของประเทศไทย : กรณีศึกษาประเทศจีน ครั้งนี้ มีวัตถุประสงค์ 3 ประการคือ (1) เพื่อศึกษาข้อจํากัดของมาตรการทางกฎหมายเกี่ยวกับการส่งเสริมการผลิตรถยนต์พลังงาน ไฟฟ้าในประเทศไทย (2) ศึกษาแนวทางการพัฒนามาตรการทางกฎหมายของประเทศจีนด้านการส่งเสริม การลงทุนภาคอุตสาหกรรมรถยนต์พลังงานไฟฟ้าในประเทศไทย และ (3) เพื่อเสนอแนะมาตรการทางกฎหมาย สําหรับการส่งเสริมการลงทุนในอุตสาหกรรมรถยนต์รถยนต์พลังงานไฟฟ้าในประเทศไทยโดยใช้วิธีการศึกษา เชิงเอกสาร (Documentary Research) ผลการศึกษาพบว่า ข้อจํากัดจากมาตรการทางกฎหมายไม่เอื้ออํานวยต่อการส่งเสริมการใช้รถยนต์ พลังงานไฟฟ้า เนื่องจากกฎหมายเกี่ยวกับภาษีศุลกากร ภาษีสรรพสามิต และภาษีมูลค่าเพิ่ม ส่งผลให้รถยนต์ พลังงานไฟฟ้ามีราคาสูงกว่ารถยนต์พลังงานน้ํามัน ในขณะที่ภาคอุตสาหกรรมรถยนต์ไฟฟ้าในประเทศไทย ภาครัฐให้การส่งเสริมการลงทุนด้วยมาตรการและสิทธิพิเศษทางภาษีอากร ยังไม่เพียงพอต่อแข่งขัน เมื่อเปรียบเทียบกับมาตรการของประเทศจีน ประกอบกับข้อจํากัดความพร้อมของสิ่งอํานวยความสะดวก ได้แก่ สถานีเติมประจุไฟฟ้าที่ยังไม่เพียงพอและครอบคลุมในแต่ละพื้นที่ การพัฒนาเทคโนโลยีแบตเตอรี่ มีน้ําหนักมากและราคาสูง ดังนั้นแนวทางการพัฒนามาตรการทางกฎหมายควรทําให้ระดับราคารถยนต์ พลังงานไฟฟ้าที่จําหน่ายในประเทศไทยต่ําลง โดยพัฒนามาตรการทางกฎหมายภาษีศุลกากร และภาษีสรรพสามิต โดยพิจารณาให้สอดคล้องกับกฎหมายส่งเสริมการลงทุนเพื่อให้ต้นทุนการผลิต ของภาคอุตสาหกรรมรถยนต์พลังงานไฟฟ้า ด้วยการให้การส่งเสริมการการลงทุนแก่ผู้ผลิตในอุตสาหกรรม ยานยนต์ไฟฟ้าในประเทศไทยแบบครบวงจร ให้ได้รับสิทธิพิเศษทางภาษีศุลกากร และหรือภาษีเงินได้นิติบุคคล 10 ปีสําหรับการผลิตชิ้นส่วน อะไหล่ มอเตอร์ แบตเตอรี่ และเทียบเท่าการผลิตเพื่อส่งออก รวมถึงการส่งเสริม ภาคเอกชนที่เข้ามาลงทุนในกิจการสถานีบริการเติมประจุไฟฟ้าด้วย พิจารณาภาษีนําเข้าสําหรับรถยนต์ไฟฟ้า จากต่างประเทศ และพิจารณาลดหย่อนภาษีสรรพสามิตเหลือ 0% ใน 3 ปีแรก หรือตลอดอายุการใช้งาน ของรถยนต์เมื่อการพัฒนาแบตเตอรี่ไม่ก่อให้เกิดมลพิษทางสิ่งแวดล้อม

เนื่องจากมาตรา 40 (4) (ช) แห่งประมวลรัษฎากรกําหนดให้เงินได้พึงประเมินจากการ ขายหุ้นของบุคคลธรรมดา หมายถึง ผลประโยชน์ที่ได้จากการโอนหุ้นเฉพาะซึ่งตีราคาเป็นเงินได้ เกินกว่าที่ลงทุน ดังนั้น ในกรณีที่เป็นการขายหุ้นอันได้มาโดยไม่มีค่าตอบแทน ผู้ขายหุ้นจึงต้องนํา ผลประโยชน์ทั้งหมดที่ได้จากการขายหุ้นมาถือเป็นเงินได้พึงประเมินและเสียภาษีเงินได้เมื่อขายหุ้น อย่างไรก็ตาม ในขณะได้รับหุ้น ผู้ขายหุ้นถือว่ามีเงินได้พึงประเมินจากการได้รับหุ้นโดยไม่มี ค่าตอบแทนซึ่งจะต้องนํามาเสียภาษีด้วย จึงทําให้ผู้ขายหุ้นอาจต้องเสียภาษีซ้ําซ้อนจากเงินได้ พึงประเมินบนทรัพย์สินเดียวกัน กล่าวคือ เมื่อได้รับหุ้นและเมื่อขายหุ้นออกไป จากการศึกษาพบว่า เพื่อให้เกิดเป็นธรรมต่อผู้เสียภาษีควรกําหนดให้ผู้ขายหุ้นสามารถนํา ฐานของเงินได้พึงประเมินจากการรับโอนหุ้นเฉพาะส่วนที่ได้เสียภาษีไว้แล้ว มาถือเป็นต้นทุนเพื่อ คํานวณเงินได้พึงประเมินจากการขายหุ้นตามมาตรา 40 (4) (ช) แห่งประมวลรัษฎากร และสามารถ นําเงินได้พึงประเมินที่ได้เสียภาษีจากการรับโอนไว้เฉพาะส่วนเกินจากราคาขายหุ้นหรือภาษีที่ได้เสีย ไปเกินกว่าภาษีที่ควรจะต้องชําระ มาหักออกจากเงินได้พึงประเมินหรือภาษีที่ต้องเสียเมื่อมีการขาย หุ้นได้นอกจากนี้ ผู้เขียนมีข้อเสนอแนะเพิ่มเติมว่าควรจะมีการกําหนดให้สามารถนําค่าใช้จ่ายใดๆที่ได้ จ่ายไปเพื่อให้ได้มาซึ่งหุ้นมาถือเป็นส่วนหนึ่งของเงินลงทุนเพื่อให้สอดคล้องกับมาตรฐานการบัญชี และควรมีการปรับแก้กฎหมายที่อาจเกี่ยวข้องเพื่อให้การปรับใช้กฎหมายเหมาะสมและเป็นธรรมมาก ขึ้น ซึ่งจะช่วยแก้ไขปัญหาความไม่ชัดเจนในการกําหนดเงินได้พึงประเมินจากการขายหุ้นอันได้มาโดย ไม่มีค่าตอบแทนได้เพื่อช่วยหลีกเลี่ยงการใช้ดุลพินิจของเจ้าหน้าที่กรมสรรพากรอันจะส่งผลให้การ จัดเก็บภาษีของกรมสรรพากรมีความยุติธรรมเป็นเอกภาพและมีประสิทธิภาพยิ่งขึ้นอีกด้วย

Article I, Section 9 of the U.S. Constitution provides the Legislative Branch with the power of the purse by granting it the exclusive authority to designate how federal dollars may be spent via appropriations laws. Congress often includes transfer authority, which provides Executive Branch recipients of appropriations the ability to shift funds from one budget account to another. Allowing an agency to transfer funds from one non-specific appropriation to another is arguably an unconstitutional abdication of the Legislative Branch’s exclusive power over the purse strings.

Puerto Rico is suffering through multiple crises. Two are obvious: a financial crisis triggered by the island’s public debts and the humanitarian crisis brought on by Hurricane Maria. Scholars often complain that sellers use trademarks to manipulate consumer perception. This manipulation ostensibly harms consumers by limiting their ability to make informed choices. For example, holding other things constant, consumers spend more money on goods with a high-performance reputation. Critics characterize that result as wasteful, if not anticompetitive. But recent marketing research shows that trademarks with a high-performance reputation may sometimes influence perception to the benefit of the consumer.

Over roughly the past four decades, government officials from around the world have been erecting a framework of economic governance with major – but under-appreciated – implications for intra-national inequality. The components of this framework are thousands of bilateral and multilateral treaties designed to protect international investment. This Article analyzes the history, design, and effectiveness of the highly controversial CEO pay ratio disclosure rule, which went into effect in 2018. Based on a regulatory mandate contained in the Dodd-Frank Act of 2010, the rule requires public companies to disclose the ratio between CEO pay and median worker pay as part of their annual filings with the Securities and Exchange Commission (SEC). The seven-year rulemaking process was politically contentious and generated a level of public engagement that was virtually unprecedented in the long history of the SEC disclosure regime. The doctrine of contractual incapacity allows people with mental disabilities to avoid their contractual liability. Its underlying premise is that the law has an obligation to protect people with such disabilities both from themselves and from unscrupulous people who would take advantage of them; mental incapacity provides this protection by rendering certain contracts unenforceable. The Disability Rights Movement (“DRM”), however, has challenged such protective legal doctrines, as they rest on outmoded concepts about people with mental disabilities.

This Article explores the following question central to trademark law: if a homograph has both a surname and a trademark interpretation will consumers consider those interpretations as intrinsically overlapping or the surname and trademark as completely separate and unrelated words? While trademark jurisprudence typically has approached this question from a legal perspective or with assumptions about consumer behavior, this Article builds on the Law and Behavioral Science approach to legal scholarship by drawing from the fields of psychology, linguistics, economics, anthropology, sociology, and marketing.

The United States is currently confronting an access-to-healthcare crisis, which rural regions are experiencing at a disproportionate rate. Many commentators have touted telemedicine as a solution for the access-to-care issue. Telemedicine uses video and telecommunication technology to allow physicians to treat patients from distant locations and thus facilitates a more equal distribution of physicians throughout the United States.

Private Interests, Public Law, And Reconfigured Inequality In Modern Payment Card Networks, Stephen Wilks

This Article examines two phenomena contributing to the racial stratification of consumers in credit card markets. The first phenomenon pertains to the longstanding conflict between card issuers and merchants over payment processing cost allocation. If successful, First Amendment challenges to existing statutory surcharge bans will allow merchants to impose an additional fee when consumers use credit cards as a form of payment. The Article relies on the interplay between socioeconomic class and behavioral theory to suggest subsistence borrowers would be more likely to pay surcharge fees than wealthier consumers.
