Penelitian ini membahas mengenai sertipikat pengganti sebagai dasar pembuatan akta hibah, yang mana diketahui bahwa permasalahan sertipikat pengganti dimasyarakat bukanlah hal baru. Sertipikat pengganti terjadi apabila sertipikat asli sebelumnya dinyatakan hilang oleh pemilik, maka pihak Kantor Pertanahan setempat pun akan menerbitkan sertipikat pengganti tersebut dengan adanya pengajuan permintaan sertipikat pengganti dan dinyatakan di bawah sumpah oleh pemilik sertipikat tersebut, atau pihak lain yang diberikannya kuasa. karena Notaris yang meninggal dunia masih meninggalkan pekerjaan-pekerjaan yang belum selesai. Meskipun dalam menjalankan jabatan terdapat Notaris yang merangkap jabatan sebagai PPAT, namun dirinya memiliki dua protokol yang berbeda yang menjadi tanggung jawabnya. Surat pernyataan hibah yang dibuat di bawah tangan dianggap belum memenuhi unsur pembuktian dari perbuatan hukum hibah. Hal ini dikarenakan dalam Pasal 37 ayat (1) PP Pendaftaran Tanah mengatur bahwa peralihan hak atas tanah melalui hibah hanya dapat didaftarkan apabila dapat dibuktikan dengan akta yang dibuat oleh PPAT. Pemberian hibah yang dilakukan kepada salah satu ahli waris pada saat penghibah sakit terhadap seluruh harta penghibah perlu persetujuan ahli waris lainnya sebagaimana tercantum dalam Pasal 726 KHES. Once abundant, the wild growing peyote cactus plants in Texas and Mexico are being drastically reduced and becoming scarce. Peyote, a slow growing cactus contains the hallucinogenic drug mescaline, is a sacred sacrament used in the Native Americans Church (NAC). It is also used religiously by various Indian tribes throughout the country of Mexico. In 2009, Asarco reached a settlement agreement with the Environmental Protection Agency for the arsenic-contaminated East Helena lead smelting facility. As part of the settlement, Asarco was responsible for $111.4 million in cleanup and remediation expenses. Following this payment, Asarco brought a contribution claim under the Comprehensive Environmental Response, Compensation, and Liability Act against Atlantic Richfield. Finally, in 2020, the Ninth Circuit Court of Appeals held that Asarco’s remediation expenses of $111.4 million were not eligible for contribution because the costs were not fully incurred. Zoning is the quintessential wicked problem. Professors Rittel and Webber, writing in the 1970s, identified as “wicked” those problems that technocratic expertise cannot necessarily solve. Wicked problems arise when the very definition of the problem is contested and outcomes are not measured by “right and wrong” but rather by messier contests between winners and losers. During the Survey period, the Supreme Court of the United States in Knick v. Township of Scott gave aggrieved property owners in Georgia a federal taking claim for inverse condemnation resulting from a zoning regulation that the Georgia Supreme Court had previously denied them under state law in Diversified Holdings, LLP v. City of Suwanee. The Georgia Court of Appeals further refined York v. Athens College of Ministry. Finally (on a note inseparable with zoning), the Georgia Supreme Court encountered a case defining the parameters of the Georgia Open Meetings Act.

We study the effects of foreign direct investment (FDI) on the rate of exhaustion of bioproductive physical land. We test for differential ecological performance of FDI in developed vs. developing countries, as well as in “clean” vs. “dirty” sectors. We examine the impact of six sector-level FDI flows on four ecological footprints (EF): Consumption EF, Production EF, Imports EF, and Exports EF, compiled by the Global Footprint Network. We estimate a dynamic panel model incorporating an Environmental Kuznets Curve (EKC) and differentiating across country development levels. The findings are intriguing. “Public Use” Or Public Abuse? A New Test For Public Use In Light Of Kelo, Taylor Haines

The Takings Clause of the Fifth Amendment has long been controversial. It allows the government to take private property for the purpose of “public use.” But what does public use mean? The definition is one of judicial interpretation. It has evolved from the original meaning intended by the drafters of the Constitution. Now, the meaning is extremely broad. This Note argues that both the original and contemporary meaning of public use are problematic. It explores the issues with both definitions and suggests a new test, solidified in legislation instead of judicial interpretation.

In 1981, the Supreme Court issued its decision in Montana v. United States, severely restricting the ability of Indian Tribes to assume civil regulatory and adjudicatory jurisdiction over non-tribal members for activities taking place on non-Indian lands within Indian reservations. The Court in Montana stated that “it could readily agree” with the Court of Appeals’ holding that the tribe could regulate the conduct of non-member on tribal lands.
