Perjanjian pengikatan jual beli lahir karena adanya asas kebebasan berkontrak sebagaimana diatur dalam Pasal 1838 KUH Perdata. Walaupun didasari dengan kebebasan berkontrak perjanjian tersebut tetap mempunyai batasan yaitu tidak bertentangan dengan peraturan perundang- undangan, kesusilaan, dan ketertiban umum. Kaitannya dalam perjanjian pengikatan jual beli tanah maka harus diperhatikan ketentuan yang berkaitan terhadap objek perjanjian tersebut. Dalam putusan Mahkamah Agung Nomor 680 K/PDT/2017 perjanjian pengikatan jual beli dinyatakan batal demi hukum dikarenakan perjanjian bersifat prematur. Penulisan ini membahas kasus jual beli berantai atas objek sebidang tanah. Pada saat jual beli pertama kali dilakukan pada tahun 1991, Notaris/PPAT tidak menuntaskan pengurusan pensertipikatannya sehingga terjadi jual beli berikut dan berikutnya lagi atas tanah tersebut sampai empat kali di tahun 2010. Hal ini berujung pada sengketa ahli waris dari pembeli pertama yang mengganggu pembeli terakhir/pembeli ke empat. Praktek pembuatan akta jual beli tanah menggunakan blangko kosong merupakan kelalaian PPAT karena berkaitan dengan tidak dibacakannya akta tersebut oleh PPAT kepada para pihak. Kasus tersebut dapat menyeret PPAT sebagai pihak pembuat akta ke dalam Pengadilan untuk mempertanggungjawabkan perbuatannya. Jurnal ini membahas pengalihan hak atas tanah yang merupakan harta bersama tanpa persetujuan dari pasangan. Pasal 36 ayat (1) Undang-Undang Perkawinan mewajibkan pasangan suami istri yang hendak bertindak atas harta bersama harus mendapatkan persetujuan dari kedua belah pihak. Despite a recent transparency law and participation in transparency initiatives, Cameroon’s investment environment remains plagued by poor transparency.
In a new report focusing on agribusiness projects in Cameroon, CCSI and the Centre pour l’Environnement et le Développement (CED) find that:
- Communities continue to be excluded from decision-making around investments.
- The government pursues a top-down approach to concession allocation and remains reluctant to recognize all legitimate tenure rights.
- The government faces threats to its legitimacy as the grievances of citizens and investors alike lead to the barring of roads by communities and investor withdrawals.

Transparency is often seen as a means of improving governance and accountability of investment, but its potential to do so is hindered by vague definitions and failures to focus on the needs of key local actors.
In this new report focusing on agribusiness, forestry, and renewable energy projects (“land investments”), CCSI grounds transparency in the needs of project-affected communities and other local actors. Transparency efforts that seek to inform and empower communities can also help governments, companies, and other actors to more effectively manage operational risk linked to social conflict.

Conflicts over “sanctuary” cities, minimum wage laws, and gender-neutral bathrooms have brought the problematic landscape of contemporary state preemption of local governance to national attention. This Article contends that more covert, although equally robust, state interference can be found in property, with significant consequences for our understanding of takings law.
Takings jurisprudence looks to the states to mediate most tensions between individual property rights and community needs, as the takings federalism literature recognizes. It is a near scientific certainty that sea levels will rise between one and eight feet by the end of the century. This will wreak havoc on our infrastructure, ecology, and public health, and cause an unquantifiable amount of economic damage. Given the inevitability of sea level rise, state and local governments must facilitate the managed retreat of people and property away from vulnerable coastal areas. However, governments’ ability to facilitate managed retreat comes head-to-head with the Takings Clauses of the United States and Maine Constitutions, which state that the government may not take private property without paying just compensation. …

Fossil fuel development on federal lands accounts for 24% of all U.S. carbon dioxide (CO2) emissions. These emissions can be reduced significantly by requiring federal oil and gas development activity to mitigate greenhouse gas (GHG) emissions. The Bureau of Land Management (BLM) has authority to define the terms and conditions of new oil and gas leases and to impose conditions of approval on existing leases at the drilling stage. This article provides an in-depth look at Treasury Regulation § 1.170A-14(g)(6)(ii), known as the proceeds regulation. The proceeds regulation is intended to protect the public investment in conservation if a perpetual conservation easement that was the subject of a charitable deduction under Internal Revenue Code § 170(h) is later extinguished. A proper understanding of the proceeds regulation is critical because the public investment in deductible easements is significant—billions of dollars are being invested in such easements annually—and the regulation has recently been subject to challenges regarding its interpretation and validity. Over 4 million people currently live in the Puget Sound area in Washington state, and about 6 million people are expected to reside in the area by 2050. Additionally, Seattle renters faced a 71.2% increase in rent prices from 2010 to 2019. This data supports the need for much of the congested Seattle population to move outward and commute into the city for work. The implementation of a 116-mile system and other efforts to increase public transportation makes this need achievable and affordable.

As public Confederate monuments finally begin to come down across the na- tion, we are seeing an emergence of Confederate monuments on private lands. The number of private Confederate monuments is increasing both with the construction of new monuments and, more significantly, the relocation of monuments from public land. This Article explains why private Confederate monuments are likely to be the next battleground over these controversial and troubling statues. Through ten detailed examples, we show how private Con- federate monuments emerge and how communities are responding to them.
