The choice of law problems encountered in workmen's compensation cases resulting from injuries incurred in the course of an employment extending over state lines and the extraterritorial applicability of workmen's compensation statutes was considered in a previous installment of this article. The purpose of this installment is to discuss the influence of the United States Constitution on the choice of the proper law in workmen's compensation cases and to demonstrate how the Constitution might be further utilized by Congress and the Courts to establish some degree of uniformity in this unsettled field.

The provisions of Section 9 of the National Labor Relations Act, as amended, establish a procedure for ascertaining the identity of the representatives of employees with whom an employer will be required to engage in collective bargaining. The ultimate issue of identity involves two component questions of fact: (1) What is the appropriate unit and (2) What union, if any, do a majority of employees within that unit prefer? While the latter issue is resolved through the relatively simple process of an election, the former is more complex. It requires the NLRB to appraise a wide variety of evidential materials …

Largely due to a haphazard process of statutory evolution, the specific steps in the development of which lack coordination, the law of attachment and garnishment in this state-particularly the law of garnishment-has arrived at a degree of complication that requires extended analysis and careful differentiation in order to be reasonably sure of conforming to the statutory requirements in any particular case. In addition to the complications arising from lack of coordination of the various statutory provisions, resulting in application of different methods of procedure to different phases of the remedy, the situation is further confused in some instances by lack …
