The Role Of Affordable Housing In Enhancing Tenants' Economic Stability In Connecticut: A Focus On Income, Employment, And Housing Stability, Osaid Zubi
Dissertations
This study examined the role of affordable housing in promoting economic stability among low- and moderate-income households in Connecticut. Focusing on income security, employment opportunities, and housing retention, this research highlighted the significance of affordable housing as a means to alleviate financial strain, support job retention, and foster community resilience. Utilizing a phenomenological approach, the study gathered insights from tenants, policymakers, and developers through conducting interviews and a focus group. Connecticut was chosen as the study site due to its high cost of living and affordable housing shortage, exacerbated by its proximity to New York City. Findings underscore the economic …

Every Grain Of Sand: 2024 Changes To The Scope Of Higher Education Unionization, William A. Herbert, Joseph Van Der Naald, Jacob Apkarian
Publications and Research
In this research note, we supplement the findings presented in the National Center’s 2024 Directory of Bargaining Agents and Contracts in Institutions of Higher Education. We aggregate and analyze data on changes in academic collective bargaining relationships for faculty, postdoctoral scholars, and graduate and undergraduate student employees in the year 2024. Our findings demonstrate that the growth in academic collective bargaining over the past decade that we documented in the 2024 Directory has continued. However, we find some significant contractions in faculty unionization through institutional closures and the revocation of bargaining units in the state of Florida. The research …

This article presents a paper developed by the AAG Organizing Committee on Locational Information and the Public Interest through a summit held in Santa Barbara, California in June 2022. The summit resulted in goals and ideas for addressing the issues that arise from the present environment for geodata, whereby public, private, and third-sector entities can tap into publicly available locational information with relatively little regulation on its access or use. The Committee articulates four goals: (1) develop a research agenda extending across disciplines, (2) outline educational resources and strategies to guide ethical practice, (3) devise a pathway to increase public …
Gender Inequality And Productivity Impact In Egypt, Hammad Elsaid Omar
Gender Inequality And Productivity Impact In Egypt, Hammad Elsaid Omar
The Undergraduate Research Journal
This study examines the relationship between gender inequality in Egypt's workforce and productivity across various sectors. Utilizing a comparative research design, the analysis employs quantitative data from sources such as the World Bank and the International Labor Organization. Key indicators of gender inequality—including the gender pay gap, the percentage of women in managerial positions, and female labor force participation rates—are correlated with productivity metrics like GDP per capita and productivity per employee (Figure 3). Findings reveal a strong negative correlation between the gender pay gap and productivity, with sectors exhibiting smaller pay disparities achieving higher productivity levels. Regression analysis indicates …
The Healing Power Of Antitrust, Theodosia Stavroulaki
The Healing Power Of Antitrust, Theodosia Stavroulaki
Northwestern University Law Review
Millions of Americans live in hospital deserts—communities where people lack geographic access to hospitals and primary care physicians. People living in these deserts often miss doctor appointments, delay necessary care, and stop adhering to their treatment. In this way, hospital deserts exacerbate the health disparities plaguing America. This Article demonstrates that hospital deserts are not inevitable but the result of several business strategies—including noncompete agreements and merging with competitors—and antitrust enforcers’ unwillingness to recognize these harmful practices as antitrust violations. To cure the issue of hospital deserts, this Article makes three proposals. First, antitrust enforcers and the courts should expand …

Reports
The Officers’ Union of International Seamen (OUIS) commissioned the World Maritime University (WMU) to conduct the Work & Health Balance at Sea (WHEAB) project to examine some dimensions of seafarers’ working lives.
Building on exploratory interviews, a survey was designed and administered. The current report presents findings on work patterns (onboard and home periods), working hours, work-related stress, safety management system, shore leave, mental well-being, and career intention.
The survey gathered responses from 4,372 seafarers, mainly from India (n=1,098; 25.1%), the Philippines (n=690; 15.8%), the United States (U.S.) (n=501; 11.5%), and other worldwide regions (n=2,083; 47.6%). The overrepresentation of U.S. …
Algorithmic Governance And Nondiscrimination Rights In The Workplace, Pauline Kim
Algorithmic Governance And Nondiscrimination Rights In The Workplace, Pauline Kim
Scholarship@WashULaw
This chapter analyzes existing legal responses to the problem of discriminatory algorithms in the workplace. As firms increasingly rely on algorithms or automated decision systems, a type of artificial intelligence, to manage their workforces, concerns have grown that these tools can systematically exclude historically disadvantaged groups. One response is to rely on traditional anti-discrimination law. These laws clearly prohibit certain forms of algorithmic discrimination; however, the complex, opaque nature of algorithms makes identifying and proving discriminatory harms challenging. Another response looks to broader frameworks of data protection and algorithmic regulation to protect against workplace discrimination. These initiatives are promising, but …

¿Qué Futuro Les Espera A Los Trabajadores Latinos? El Calor Extremo, Las Promesas Vacías Y La Incertidumbre Política, Yunior Rivas Garcia
Capstones

Against the background of globalization and the constant evolution of economic relations, the protection of trade secrets in labor relations becomes a necessity to ensure the sustainable competitiveness of enterprises in the international market. This article analyzes the multifaceted dimensions of trade secret protection, covering global business strategies, intercultural labor practices, international economic relations, and public policy fundamentals. Through the analysis of international agreements such as the TRIPS Agreement and the European Union Directive on Non-Competition Provisions, the article explores how various legal systems address trade secrets in labor relations, emphasizing the need for global harmonization. It also considers cultural …
An Empire Of Anti-Democracy: The Imperial Legacies Of American Territorial Labor, Jedidiah J. Kroncke
An Empire Of Anti-Democracy: The Imperial Legacies Of American Territorial Labor, Jedidiah J. Kroncke
Washington Law Review
A great deal of recent attention has been given to acknowledging the full historical scope of American empire and its legal foundations. A recurrent focus of this attention has been the impact of the Insular Cases—a set of early twentieth century doctrines that legitimate American territorial acquisitions while denying their full incorporation under the United States Constitution. Issues of political citizenship and property have thus predominated critical work on the Insular Cases.
This Article expands on this resurgent interest by focusing on another critical element of this acknowledgment: the history of territorial labor which has long been central …

Cartel Breakdown: The Impact Of Demonopsonization On Market Concentration, Nathan Ashby, Miguel A. Ramos-Gonzalez
Hunt Institute Working Paper Series
The exogenous removal of labor restrictions mandated by Alston vs. NCAA (National Collegiate Athletic Association) has provided a unique natural experiment for analyzing the impact of demonopsonization on market concentration. Using basketball tournament data between 2003 and 2024 we find evidence of increased concentration in performance among higher-tiered programs. The larger magnitude of estimates for women’s programs likely results from wider dispersion in market demand for participating programs predating the reforms. We also analyze parity in regular-season conference play and fail to detect a relationship between the changes and dispersion for higher-tiered conferences, but we do find a relationship for …

An Extremely Important Document: Khea's Struggle For A Contract, 1974-1978, John L.S. Daley Dr
KNEA 50th Anniversary
In 1973, the Kansas State College, Pittsburg administration fired thirteen faculty members without cause. In order to improve administration-faculty relations, remaining faculty organized, petitioned for recognition, and drafted PSU/KNEA's first contract with PSU/KBOR, which went into effect five years later. The narrative covering this period draws on Axe Library's KNEA Collection and interviews of former faculty.
Labour And Democracy, Kate Andrias
Labour And Democracy, Kate Andrias
Faculty Scholarship
Democracy has always been a central project of labour law, but it is all the more important today, with authoritarianism on the rise and democracy under threat across the globe. This chapter examines the relationship between labour law and democracy. It explores the central tension between democracy and labour under capitalism; traces how ideas and arguments about workplace democracy have evolved over time; and explores the relationship between workplace democracy and political democracy, including how and when unions serve as a bulwark against authoritarianism. Ultimately, it argues that a critical task for labour law scholarship is to rethink the body …

Subjective Beliefs About Contract Enforceability, J. J. Prescott, Evan Starr
Subjective Beliefs About Contract Enforceability, J. J. Prescott, Evan Starr
Articles
This article assesses the content, role, and adaptability of subjective beliefs about contract enforceability in the context of postemployment covenants not to compete (noncompetes). We demonstrate that employees tend to believe that even clearly unenforceable noncompetes are enforceable, including their own. We provide evidence for both supply- and demand-side stories that explain employees’ persistently inaccurate beliefs. Moreover, we show that believing that unenforceable noncompetes are enforceable likely causes employees to forgo better job opportunities and to perceive that their employer is more likely to sue them if they choose to compete. Finally, we use an information experiment to inform employees …
Abortion, Citizenship, And The Right To Travel, Rebecca E. Zietlow
Abortion, Citizenship, And The Right To Travel, Rebecca E. Zietlow
Employee Rights and Employment Policy Journal
This article considers the changed landscape for abortion rights since the United States Supreme Court’s opinion in Dobbs v. Jackson Women’s Health. Before Dobbs, the right to choose an abortion was a fundamental right under federal law, enforceable against all state governments. After Dobbs, the scope of one’s right to choose an abortion depends on the state in which one lives, and if abortion is illegal in their home state, their right to travel to another state where abortion is legal. The right to travel is particularly important for workers who must live in an anti-abortion state because their …

Master's Theses
In contemporary society, social media platforms have emerged as powerful tools for advocacy and activism. This thesis explores the potential of Instagram in raising awareness and fostering dialogue around workplace equity for women in Belgium. Inspired by influential women's advocacy accounts, I embarked on a journey to fill a noticeable gap in the digital landscape – the absence of Belgian-centric content addressing workplace empowerment for women. Grounded in the unique intersections of Belgian national policies, European Union directives, and global socio-economic dynamics, this capstone delves into the multifaceted challenges faced by Belgian women in the workplace.

A Qualitative Exploration Of Social Capital And Its Influence On Baccalaureate Degree Completion Of First-Generation African American Men At The University Of Louisville., Joseph Marshall Goodman Iii
Electronic Theses and Dissertations
This qualitative dissertation was designed to examine influences which various forms of social capital have on post-secondary degree attainment of first-generation individuals who self-identify as African American men. Additionally, the sample population consisted of Black men who successfully matriculated to earn baccalaureate credentials across differing academic disciplines at a public historically White institution located in the mid-south region of the United States. The research data was extracted from one-on-one, semi-structured interviews using authentic dialogue through open-ended questions. Theoretical paradigms of the study involved a phenomenological approach and an ontological philosophical assumption, integrated with critical theory, critical race theory and social …

Kidfluencers: New Child Stars In Need Of Protection, Mikayla B. Jayroe
Arkansas Law Review
Despite the explosive growth of social media and various lobbying efforts, the legal system has fallen woefully behind in extending labor protections to children engaged in social media production. This Comment will offer a solution to the current gray area surrounding kidfluencers and the lack of protections they are afforded. First, this Comment will discuss the emergence and growth of the kidfluencer industry and explore the legal history of child labor laws in the United States, specifically evaluating protections historically provided to child actors. Second, this Comment will explain why posts by kidfluencers should be considered work, explore the harms …

This book chapter from Contingent Faculty and the Remaking of Higher Education: A Labor History traces the history of faculty bargaining unit composition in higher education. It examines the evolution in higher education from wall-to-wall bargaining units to professional craft units of tenured, tenure-track, and contingent faculty to separate contingent faculty units. The chapter presents historical examples of bargaining units, starting with early CIO wall-to-wall units in the 1940s, and the facts, preferences, and legal doctrines that has resulted in faculty being placed in combined or separate bargaining under collective bargaining laws. It will also explore the conflicting and congruous …
Human Capital Disclosure & Corporate Governance: The New Evidence, George S. Georgiev
Human Capital Disclosure & Corporate Governance: The New Evidence, George S. Georgiev
Faculty Articles
This Article explores the evolution of human capital disclosure—firm-supplied information about various workforce-related matters—as a factor in contemporary corporate governance. Regulatory and nonregulatory developments from recent years have upended longstanding practices and generated extensive new evidence. Most notably, the Securities and Exchange Commission (SEC) adopted a human capital management (“HCM”) disclosure mandate in 2020, which, though long overdue, was criticized from the outset for its modest scope and lax design. In the meantime, courts have taken a renewed interest in board of directors’ oversight responsibilities in a number of areas, including HCM, while labor’s power has unexpectedly increased in some …

Staff Matters: Are There Risks To Using Ai In Our Practice?, Jodi Schafer Sphr, Shrm-Scp
The Journal of the Michigan Dental Association
As your practice adopts AI for hiring processes, it brings efficiency but also potential pitfalls. The increasing use of AI, such as ChatGPT, streamlines tasks like resume screening, but caution is essential. Recent executive orders emphasize safety assessments and civil rights in AI. The Equal Employment Opportunity Commission focuses on transparency and consent in recruitment AI use. Legal compliance is vital to prevent discrimination; criteria like education and experience must be applied consistently. Additionally, employee monitoring AI requires careful implementation, ensuring transparency and human oversight. While AI offers benefits, its workplace integration demands careful consideration, testing, and ongoing evaluation.
Limitations Of The “Four-Fifths Rule” And Statistical Parity Tests For Measuring Fairness, Pauline Kim, Manish Raghavan
Limitations Of The “Four-Fifths Rule” And Statistical Parity Tests For Measuring Fairness, Pauline Kim, Manish Raghavan
Scholarship@WashULaw
To ensure the fairness of algorithmic decision systems, such as employment selection tools, computer scientists and practitioners often refer to the so-called “four-fifths rule” as a measure of a tool’s compliance with anti-discrimination law. This reliance is problematic because the “rule” is in fact not a legal rule for establishing discrimination, and it offers a crude test that will often be over- and under-inclusive in identifying practices that warrant further scrutiny. The “four-fifths rule” is one of a broader class of statistical tests, which we call Statistical Parity Tests (SPTs), that compare selection rates across demographic groups. While some SPTs …
Profit, Mission, And Protest At Work, Marion Crain
Profit, Mission, And Protest At Work, Marion Crain
Scholarship@WashULaw
The classic understanding of capitalism maintains that the social responsibility of business is to increase its profits. But in the last decade, many firms have announced commitments to various social justice issues, folding them into corporate mission statements, codes of corporate social responsibility, and branding. Firms engaging in so-called “woke capitalism” signal their virtuous support for progressive social causes favored by both their consumer base and their idealistic young workers. This has become particularly important in a tight labor market: by targeting workers’ values, savvy firms increase recruiting yields, enhance productivity, and reduce training costs as retention rates rise, while …
