The Same-Sex Marriage Cases And Federal Jurisdiction: On Third-Party Standing And Why The Domestic Relations Exception To Federal Jurisdiction Should Be Overruled, Steven G. Calabresi, Genna L. Sinel

In this paper, we consider two questions. First, we address whether there was proper standing for the Article III courts to decide United States v. Windsor, 570 U.S. 133 S. Ct. 2675, 2696 (2013) and Hollingsworth v. Perry, 133 S. Ct. 2652, 2668 (2013). We conclude that the third-party appellants lacked standing in federal court. Second, we examine whether cases challenging state same-sex marriage bans were and are cases in “law and equity” or instead, barred under the domestic relations exception for the purposes of federal question jurisdiction. The Power Of A Secret: Ireland’S Secret Societies Involvement In Irish Nationalism, Sierra M. Harlan
Scholarly and Creative Works Conference (2015 - 2021)
The Irish Republican Brotherhood (I.R.B.) and the Irish Volunteer Force (I.V.F.) altered Irish Nationalist tactics from Parliamentary supported Home Rule to a republican movement for Irish Independence. The actions of these secret societies between the years of 1900 through 1917, before the Irish Revolutionary period,[1] are the reason that Ireland gained independence from United Kingdom in 1921. The change from political negotiations by the ineffective Irish Parliamentary Party to the republican movement would never have happened without the Easter Rising of 1916. Effects Of International Judgments Relating To Awards, Maxi Scherer
Pepperdine Law Review
This Article looks at those judgments relating to international arbitral awards (award judgments) and, more precisely, at their extraterritorial effects. It analyzes whether an award judgment rendered in one jurisdiction has effects in other jurisdictions. For instance, if the award has been set aside6 in country A, does the set-aside judgment have effects on enforcement proceedings in country B? Similarly, if country C refuses to enforce an award on the basis that the tribunal has no jurisdiction, does this have a preclusive effect on enforcement proceedings pending in country D?
