Lessons From Greco-Multilateralism For Creditors, Georgakopoulos

Sovereign insolvencies cause enormous losses to lenders, huge disruptions in the debtor's population and its welfare, and extraordinary mobilization of international organizations, such as the International Monetary Fund ("IMF") and the European Central Bank ("ECB"), which were designed to safeguard the financial system. Greece's insolvency displays all these phenomena, but it also demonstrates the improvement that would be available from a sovereign insolvency regime following three simple principles: (1) post-insolvency creditors should have priority; (2) creditors should vote by classes; and (3) restructuring should be conditional on the debtor's compliance with reforms.

Nationality and territory are connected in many ways.' The classical understanding of sovereignty is traditionally rooted in the exercise of authority over people and place. A necessary consequence of understanding the world as inhabited by sovereign countries in charge of separate societies divided by unambiguous borders is the perpetuation of a clear distinction between what is "inside" and what is "outside," both in terms of territory and in terms of people who either "belong here" or "not."2 This vision of the world, which is largely based on the de Vattelian tradition of international relations and law,3 is very much simplified, …

Like most UN reports, particularly those concerned with the doctrine of the "responsibility to protect" (RtoP), the latest report of the UN Secretary-General is filled with plenty of pious guff mixed in with the platitudes that engulf UN diplomacy. But buried within the blathering are also some disturbing prescriptions for how the UN envisages rolling out RtoP around the world. I want to draw attention to three specific points in order to consider what these tell us about RtoP as a political model. African states have, since the colonial encounter, been part of the international regimes on intellectual property rights. Formal accession to various treaties and conventions on intellectual property rights instruments should not be mistaken for actual internalization of the policies, structures and norms required for reaping the promised benefits of participation in such regimes. There is ample evidence showing that most African states do not have the requisite structures for fruitful engagement with international intellectual property rights regimes. Climate change, increasing population density, and unsustainable land use practices continue to contribute to the frequency and exacerbate the impact of environmental disasters. The world population continues to grow, particularly in areas in which the environment is unstable or prone to natural disasters. In 2010 and 2011, alone, earthquakes in Chile, Haiti, Japan, and Turkey led to widespread damage, thousands of casualties, and subsequent international relief efforts, many of which continue, today. Since the 1970s a relatively new phenomenon emerged in the human, world panorama: the plight of Internally Displaced Persons (IDPs), a phenomenon which has significantly affected the Sub-Saharan Africa (SSA) region in particular. According to the United Nations High Commissioner for Refugee (UNHCR), the number of IDPs protected or assisted by the agency, including people in IDP-like situations in the four macro-regions composing the SSA (Central Africa-Great Lakes, East and Horn of Africa, Southern Africa, Western Africa) in 2010 amounted to 6,230,071 individuals against the 4,376,376 million in Asia and 3,672,054 in Latin America and the Caribbean.' Arguably no industry was more affected by the terrorist attacks of September 11, 2001, than the commercial aviation sector. The direct role played by airlines on that fateful day forever changed the industry's financial, economic, and operational dynamics. Recognizing this enormity, the U.S. government and European Commission enacted measures to mitigate some of the impacts of September 11. However, despite the inherent similarities between the European and the U.S. airline industries, the approaches ultimately undertaken by the U.S. government and European Commission were very different. A Muslim woman wearing a face covering, a hijab or burqa, wants to go to her job in Paris, but a recent statute prevents her from setting out for work dressed as she is. The state and the right to religious freedom conflict in many countries but perhaps no more famously now than in France. France has officially embraced secularism, larcit6, as a fundamental value along with libertd, igalitd, fratemitd. Lalcit6 suggests that only characteristics the French hold in common constitute society.' • Automatic information exchange is superior to anonymous withholding for the purpose of combating tax evasion involving the use of foreign financial accounts.

• German ratification of the Swiss-German anonymous tax withholding agreement would stifle the emergence of a multilateral automatic information exchange system. As a result, Germany would be less able to address its own concerns with tax evasion through foreign accounts over the medium term. By ratifying this agreement, Germany would also slow the development of a multilateral system that would allow many …

The ability to harness energy is fundamental to economic and social development. Worldwide, almost 3 billion people have little or no access to beneficial energy resources for cooking, heating, water sanitation, illumination, transportation, or basic mechanical needs. Energy poverty exacerbates ill health and economic hardship, and reduces educational opportunities, particularly for women and children.
